I. ABOUT THE COMPETITION

The Centre for ADR in collaboration with the Centre for IPR at IFIM
Law School is organizing the Annual INTRA MED-ARB
COMPETITION 2024, from 22nd to 23rd June 2024, in accordance with
these rules. The object of the Competition is to provide a means for
students to practice and improve their Mediation and Arbitration skills, as
it forms the basic premise upon which any dispute can be resolved in an
amicable manner.

II. ELIGIBILITY

The IFIM Intra Med – Arb Competition 2024 is open to students who are:
Pursuing an integrated 5-year LL.B program at IFIM Law School.
Pursuing a 3-year LL.B program at IFIM Law School.

III. LANGUAGE OF THE COMPETITION

The Official language of the competition shall be English. All written and
oral submissions before the Panel and the Organising Committee shall be
made in English.

IV. FORMAT OF THE COMPETITION

The Competition will comprise a total of 4 (four) rounds:


Preliminary Rounds- Each team shall participate in two (2) Mediation,
Qualifying rounds. Each team will mandatorily have to present both
the sides of the given dispute.
Quarter- Finals Rounds- Each team shall participate in one
(1)Mediation, Knock-out round.
Semi-Finals Rounds: Each team shall participate in one (1)
Arbitration, Knock-out round
Finals Rounds: The Final round shall be an Arbitration round.

V.TEAM COMPOSITION

Each participating team shall constitute a maximum of 3 members,


Comprising of one negotiating pair and one mediator for the Mediation
rounds, which will later assume the roles of two speakers and one
researcher in the Arbitration rounds.
Changeability of the roles:
Participants are permitted to select their preferred roles for both the
Mediation and Arbitration rounds. However, once a role has been chosen,
it cannot be changed between rounds. For example, if a participant
chooses to be a mediator for a team, they must fulfil that role in both the
mediation rounds. However, they may choose to be a speaker in the
arbitration rounds. The same shall be filled accordingly in the
Registration forms circulated by the OC.
Kindly Note that the Mediators shall be marked separately for the purposes of
adjudication of the Best Mediator Award, however, the qualification of the team shall
be based on the cumulative scores of the Mediator and the Negotiating Pair.

VI. REGISTRATION

Any interested team shall register their interest through this Google

There is no registration fee for the competition.
Every Participating team will get its unique Team Name, no requests
for the change of the same shall be entertained.
No team shall reveal their identity to other teams or the Panel or in
the written submissions.
All communications must be made in reference to this Registered
Team Name.

VII. DRESS CODE

The Dress Code for the Competition shall strictly be smart formals.

VIII. GUIDELINES FOR THE WRITTEN SUBMISSIONS

Each team will be required to submit two sets of Arbitration Memorials


(from both sides) for the Arbitration proposition circulated on or before
10 p.m. on 16th of June 2024. The teams are not required to submit
Strategy Papers for Intra Med-Arb 2024.

The memorials would be scored and taken into consideration in cases of a


draw between two teams as well as the adjudication of the “Best Memorial
Award”.

Marking Criteria for the Memorials:


1. Proper inclusion of parties, identification of issues and nature of relief
sought.
2. Knowledge and application of facts and law,
3. Persuasiveness of arguments,
4. Use of authorities and Exhibits/Other relevant evidence,
5. Proper citation and correct format,
6. Originality in presentation,
7. General impression and clarity of thought,
8. Grammar and style of presentation.

Structure of the Written Submissions:


1. Cover Page- (Claimant Cover Page- Blue in Colour and Respondent
Cover Page-Pink in Colour)
2. Table of Contents
3. Table of Abbreviations
4. Index of Authorities
5. Statement of Jurisdiction
6. Statement of Facts
7. Issues Raised
8. Summary of Arguments
9. Arguments Advanced/Pleadings; (not more than 15 pages)

Format of the Arbitration Memorial:


1. Font Style – Times New Roman
2. Title Font Size – 14
3. Body Font Size – 12
4. Line Spacing – 1.5
5. Footnote Font Size – 10
6. Footnote Line Spacing – 1
7. Citation Format – 20th edition of Bluebook Citation
8. Team Name - The team names provided by the Organizing
Committee have to be mentioned on the top right corner of the cover
page of the Arbitration Memorials.

The Memorials shall be submitted to the organizing committee by way of


mail to [email protected] cc to [email protected], Subject of the mail
shall be “MEMORIAL SUBMISSION _ Team Name”.

The Hard Copies (5) of the memorials shall be required to be submitted by


the teams qualifying to the Semi-final Rounds only. The teams qualifying
to the Final Rounds shall be required to submit additional (2) two copies
of their Arbitration Memorials. (The teams are permitted to get their
Memorials printed in a double-sided manner).

IX. MODE OF THE COMPETITION.

The IFIM Intra Med-Arb Competition, 2024 shall take place physically.
The Parties will be assigned their roles on the basis of draw of lots.

X. IMPORTANT DATES

Commencement of Registrations 1st May 2024

Last Day for Registrations 15th May 2024

Problem Release 16th May 2024

Last Day for Seeking Clarifications 26th May 2024

Release of Clarification 31st May 2024

Last day for Submission of Memorials 16th June 2024

XI. TIME-ALLOTED FOR THE ROUNDS

The participating teams shall strictly maintain the time allotted and
failure of which will result in a penalty (Penalties are mentioned in
Section XIV)
If the participating teams require more time, it shall be the discretion
of the Panel to allow the same. However, the timings mentioned
below are inclusive of the caucus time for the mediation rounds and
exclusive of the feedback time for the teams.
The time allotment for each round is as follows:

XII. PRIVATE CAUCUS

The overall time for Mediation continues to run during Caucus,


which shall not exceed for 3 minutes per team in the Preliminary
Rounds and 5 minutes in the Quarter-Final Rounds.
The Competing Team (Negotiating Pair) or the Mediator can call for
a caucus when they believe that there is a deadlock in the Joint
Session during Mediation. It is pertinent to note that if a Caucus is
called by the Mediator, the Negotiating Pairs are at the liberty to deny
or postpone the same, however if the Competing Team (Negotiating
Pair) call for a caucus the mediator has to oblige with the same.
Cross-Caucus and Private Discussions within the Negotiating Pair
shall not be allowed.

XIII. GUIDELINES FOR THE ROUNDS

PRELIMINARY ROUNDS
The two Preliminary Rounds shall be Mediation sessions, wherein, the
teams shall be allotted a total of 30 minutes including the Private
Caucus session.
The top 8 teams shall qualify for the Quarter Final Round.
The confidentiality for the preliminary round will be sent 20 minutes
prior to the rounds, through email.

QUARTER-FINAL ROUNDS
The Quarter-Final Round shall be a Mediation session.
The match-up for the Quarter-finals will be determined by a draw of
lots.
The top 8 teams shall compete in this round, which will be a
knockout round, after which 4 teams in total shall proceed to the next
round.
This round shall be a total of 40 minutes, including the Private Caucus
session.
The confidentiality for the quarter-final round shall be sent 15
minutes prior to the rounds.

SEMI-FINAL ROUNDS
The Semi-Final round shall be an Arbitration round.
The match-up for the Semi-finals shall be determined by a draw of
lots.
A total of 50 minutes will be given to the teams to present their case
(Each team- 25 minutes inclusive of rebuttals).
The parties can request an extension of time to present their
arguments which shall be granted at the discretion of the bench.
This Round will be a knock-out round, from where two (2) teams
shall qualify for the Final round.

FINAL ROUNDS.
The Final Round will follow the Semi-Finals Round, which would be
an Arbitration round.
A total of 60 minutes will be given to the teams to present their case
(Each team- 30 minutes inclusive of rebuttals).
The parties can request an extension of time to present their
arguments which shall be granted at the discretion of the bench.
The team with the highest cumulative score in this round will be
declared the Winner.

XIV. PENALTY

ORAL ROUNDS

Mediation rounds: If the teams exceed the time allotted to their


session, without the prior permission of the panel, a penalty of 0.5
marks for every exceeding minute shall be borne by each team present
in that session
Arbitration Rounds: Any team exceeding the time limit without the
prior permission of the Panel, shall result in a penalty of 0.5 marks for
every exceeding minute.

WRITTEN SUBMISSIONS:

Failure to submit the strategy paper before the deadline shall result in
a penalty of one (1) mark for every extra hour, not exceeding a total of
five (5) marks a day. The Organising Committee shall not accept any
memorials submitted 36 hours after the submission deadline, i.e. 10
a.m. on the 18th of June 2024.
Failure to follow any other guidelines in the aforementioned rules and
regulations will result in a penalty of one (1) mark for every breach or
disqualification of the team depending on the gravity of the breach
and the discretion of the Organising Committee.

XV. AWARDS

E-certificates of participation shall be given to all participants.


The teams/persons adjudicated the winner of any award shall be
awarded with Certificates and Trophies.

b. Runners-up
c. Best Arbitration Memorial
d. Best Mediator (Prelims)
e. Best Negotiating Pair (Prelims)
