REASONS FOR REFUSAL NRA v 1.0
You have applied for a Short-term Student visa for the UK.
In deciding whether you meet the requirements of paragraph Short-term Student (STS) of
the Immigration Rules (https://www.gov.uk/guidance/immigration-rules/immigration-rules-
appendix-short-term-student-english-language), I have considered:
• your application and any additional relevant information you have provided with it
• your immigration history
The decision
I have refused your application for a short-term student visa because I am not satisfied that
you meet the requirements of paragraph(s) STS 5.2 and 8.1 of Appendix Short Term
Student (English Language) because:
Paragraph STS 8.1 of the Immigration Rules Appendix Short-Term Student (English
Language) states:
STS 8.1. If the decision maker is satisfied that all the suitability and eligibility
requirements for a Short-term Student are met the application will be granted,
otherwise the application will be refused.
Paragraph STS 5.2 of the Immigration Rules Appendix Short-Term Student (English
Language) states:
STS 5.2. The applicant must intend to leave the UK within 30 days of the end of their
English language course, or at the end of 11 months, whichever is sooner.
As part of your application, you have submitted an employment letter from Pharma Care.
The employment letter you have provided does not state when your employment started.
During which time a higher level of English does not appear to have been necessary to fulfil
your role.
While I note you have been granted time off to attend this course, you have provided nothing
from your current employer or potential employers indicating that you require a higher level
of English.
The submitted documents state that you will be returning to the same position after the
completion of your intended course
I also note the documentation submitted in support of your application does not outline a
reason for why you are required to learn English specifically within the United Kingdom.
While this is not a prerequisite, you have not fully explained how this course will benefit you,
especially when considering the significant financial outlay involved in participating in a
course of this length in the UK. Nor have you satisfactorily explained why you have not
undertaken any English language training or qualifications locally or online. This therefore
damages the overall credibility of your application and leads me to question whether English
proficiency is essential in your line of work.
Open-source checks have also shown that the business only operates in Bangladesh and
does not operate or serve clients internationally.

There is no evidence that this business operates or has any office or branch in any other
country.
This makes me further question if English is a necessity for this position and your rationale
for undertaking the intended course.
You have provided a letter from your employer stating you have been granted permission to
travel to the UK for these proposed studies and that you will return to the same role.
The employment letter provided does not state that you will be receiving any increase in
remuneration after completing this course in the UK.
Considering the significant financial outlay involved in participating in a course of this length
in UK, I am not satisfied that your given reasons are credible as you have not indicated any
career progression or remuneration after completing this course in UK
While you have stated your reasoning for wishing to learn English, it does not outline a
reason for why you are required to learn English specifically within the United Kingdom. Nor
have you satisfactorily explained why you have not undertaken any English language
training or qualifications in Bangladesh or utilised any other options at your disposal prior to
your application for entry clearance.
I acknowledge that you have stated the quality of teaching in the UK is better, however, I am
aware that other English language providers operate in Bangladesh.
and that they offer courses of a high standard which are significantly less expensive than
what you are proposing to spend.
Furthermore, Open-source checks also suggest that the course provider of your intended
course also provides online courses.
Given the significant financial outlay and additional costs of studying overseas, I am not
satisfied of your rationale to travel to UK to undertake the intended course.
This causes me to doubt that you intend to leave the UK at the end of your studies.
Therefore, I am not satisfied you intend to leave the UK within 30 days of the end of your
English language course, or at the end of 11 months.
Given the above, I am not satisfied of your rationale for attending this course, which leads
me to question the purpose and reasoning for wanting to travel to the UK.

I have therefore refused your application because I am not satisfied, on the balance of
probabilities, that you meet all the requirements of STS 5.2 and STS 8.1 of Appendix Short
Term Student of the Immigration Rules.
Because your application has been refused, the Health Surcharge payment made in relation
to this specific application for a visa/entry clearance will now be refunded automatically. The
refund will be made to the card used to pay the Health Surcharge. You should note that you
may be required to make a fresh Health Surcharge payment with any fresh application.

Immigration Health Charge
If you have paid the Immigration Health Charge it will be refunded:
• if you do not apply for administrative review within 6 weeks from the date you
received the refusal decision

within 6 weeks of your administrative review being finally determined.
