LEAVE AND LICENSE AGREEEMENT


THIS LEAVE AND LICENSE is made and entered
into at Mumbai, on 29th Day of July 2024

SURYAKANT MAHADEV MASAYE, age 60 years,


Indian Inhabitant, residing at 2/177 Shivraj Bhavan
Building No. 02, B.M. Marg, Elphinstone Road,
Prabhadevi, Mumbai 400013, hereinafter referred to as
the “THE LICENSOR” (which expression shall unless
it is repugnant to the context or meaning thereof shall
mean and include his heirs, executors, administrators
and assigns) of the ONE PART

AND

IBRAHIM RAZZAK PATEL , age 37 year, Indian


Inhabitant, residing at Room No. 169, Shivraj Bhavan
Building No. 02, B.M. Marg, Elphinstone Road,
Prabhadevi, Mumbai 400013 hereinafter referred to as
the “LICENSEE” (which shall mean and include his
heirs, executors, administration and assign) of the
OTHER PART.

WHEREAS the Licensor is seized and possession


of or otherwise well and sufficiently entitled at 2/177
Shivraj Bhavan Building No. 02, B.M. Marg,
Elphinstone Road, Prabhadevi, Mumbai 400013,
hereinafter referred to as the ‘THE SAID ROOM
PREMISES’:

AND WHEREAS the Licensee is in need of an


accommodation for residential purpose and the
licensee has approached to the Licensor with request
to give the said room premises for temporary period.

AND WHEREAS the Licensor has accepted the


request of the Licensee and permitted the Licensee to
use and occupy the said room premises for residential
purpose for temporary period of 08 months, which is
commencing from 01st August 2024 to 31st March

2025 on leave and license basis.

NOW THEREFORE THIS AGREEMENT

WITNESSETH AND THE PARTIES HERETO HAVE

AGREED BY AND BETWEEN THEMSELVES AS

UNDER:

1. That the Licensor have agreed with and also hereby


permits the Licensee to use and occupy the 2/177
Shivraj Bhavan Building No. 02, B.M. Marg,
Elphinstone Road, Prabhadevi, Mumbai
400013, for a period of 08 months on Licensee basis
commencing 01st August 2024 to 31st March
2025.

2. That the Licensee has agreed to Rs. 10,000/-


(Rupees Ten Thousand Only) per month to the
Licensor for such use and occupation of the said
room premises.

3. That the Licensee has not paid any Security Deposit,


to the Licensor.

4. That the licensee shall abide by all the rules and


regulation laid down by the Bombay Municipal
Corporation, Central and state Government or any
other local body and shall keep the licensor duly
indemnified against any breaches or contraventions,
of such rules by himself or his agent or servants.

5. That the Licensor shall have rights to enter into the


said room premises for inspection purpose at any
reasonable time.

6. That the licensee hereby further agrees and


undertakes to use, occupy the said room premises

lawfully without indulging in any illegal and/or anti


social activities therein, much less storage of any
hazardous materials.

7. That the licensee agrees and undertakes to pay the


followings acts and when due.

(a) Municipal licensee fee or any other charges or


fees levied by and other local authorities for
conducting of the said room premises
(b) The licensee have no right title or claim of
whatsoever nature in the tenancy/ownership of the
said room premises.

8. This agreement shall be governed under all


applicable statutory laws/ rules/ notification as in
forces or amended time to time by the State/ Central
Govt. of other concerned authorities of this
agreement and more particularly under the Indian
Contract Act, 1872 and the Maharashtra Rent Control
Act, 1999.

9. That the licensee hereby agrees and undertakes not


be pledge, mortgage or create any lien over the said
premises including the articles of furniture and
fixtures provided by the licensor in the said room
premises.

10. It is agreed by and between the parties hereto that if


the licensee fails to vacant they said room premises
after expiry of this agreement of earlier
determination hereof, as aforesaid, the licensor
forcibly with the help of Police can vacate the place.

11. The Licensee shall not apply for ration card or any
such document on the address of the said room
premises.

12. The Licensee shall not create any bank liability over
the aforesaid premises and will keep the same free
from all encumbrances and liabilities.

13. Subject of Mumbai Jurisdiction.

IN WITNESS WHEREOF the parties hereto have hereunto


set and subscribed their respective hands hereunto on the
day and year hereinabove written.

hereinafter collectively referred to as the


“LICENSEE” (which shall mean and include his
heirs, executors, administration and assign) of the

WHEREAS the Licensor is seized and possession


of or otherwise well and sufficiently entitled at

Savarkar Rd, Chandrakant Dhuru Wadi, Dadar
West, Mumbai, Maharashtra 400028, including the
following furnishings and appliances:

hereinafter referred to as the ‘THE SAID ROOM


PREMISES’:

AND WHEREAS the Licensee is in need of an


accommodation for residential purpose and the
licensee has approached to the Licensor with request
to give the said room premises for temporary period.

AND WHEREAS the Licensor has accepted the


request of the Licensee and permitted the Licensee to
use and occupy the said room premises for residential
purpose for temporary period of 02 months, which is
commencing from 21st May 2024 to 21st July 2024
on leave and license basis.

NOW THEREFORE THIS AGREEMENT WITNESSETH


and the parties hereto have agreed by and between
themselves as under:

14. That the Licensor have agreed with and also


hereby permits the Licensee to use and occupy the
801, Amrita Apartment, Swatantrya veer
Savarkar Rd, Chandrakant Dhuru Wadi, Dadar
West, Mumbai, Maharashtra 400028, for a
period of 24 months on Licensee basis commencing
21st May 2024 to 21st July 2024.

15. That the Licensee has agreed to Rs. 15,500/-


(Rupees Fifteen Thousand Five Hundred Only) each
per month to the Licensor for such use and
occupation of the said room premises.

16. That the Licensee has paid to the Licensor a sum

of Rs.30,000/- (Rupees Thirty Thousand Only) as a


interest free and refundable Security Deposit, the
receipt of which the Licensor hereby admit and
acknowledge.

17. The Licensee had already paid the two month


advance compensation rent i.e. Rs. 30,000/- (Rupees
Thirty Thousand Only) each to the Licensor, Whereas
the Licensor admit and acknowledge the same.

18. That the licensee shall abide by all the rules and
regulation laid down by the Bombay Municipal
Corporation, Central and state Government or any
other local body and shall keep the licensor duly
indemnified against any breaches or contraventions,
of such rules by himself or his agent or servants.

19. That the Licensor shall have rights to enter into


the said room premises for inspection purpose at any
reasonable time.

20. That the licensee hereby further agrees and


undertakes to use, occupy the said room premises
lawfully without indulging in any illegal and/or anti
social activities therein, much less storage of any
hazardous materials.

21.That the licensee agrees and undertakes to pay the


followings acts and when due.

(a) Electricity bill of the energy consumed during the


period of this agreement
(b) The telephone bill for the telephone number
provided in the said room premises.
(c)Municipal licensee fee or any other charges or fees
levied by and other local authorities for conducting

of the said room premises


(d) The licensee have no right title or claim of
whatsoever nature in the tenancy/ownership of the
said room premises.
