“TAMIL CULTURAL TRUST”
THIS DEED OF TRUST made on this day of April 04 th 2025 by Mr.
BALAKRISHNAN MALAIYANDY, [AADHAAR: 3452 0224 1156, PAN:
FOYB1178F], Son of Mr. Malaiyandy, aged about 49 years, residing at Door
No. Nilakkottai Taluk, Dindigul District, Tamil Nadu - 624 208, hereinafter
called the FOUNDER and PRESIDENT of the Trust which expression unless
repugnant to the context or meaning thereof includes their heirs, executors,
and administrators, etc., whereas FOUNDER and PRESIDENT of the Trust is
possessed of and otherwise well and sufficiently entitled to the sum of
Rs.1000/- (Rupees One Thousand Only) hereinafter referred to as said
property.

Whereas the FOUNDER and PRESIDENT of the Trust desire to
irrevocably endow the said funds upon trust for public, educational and
cultural as hereinafter expressed and contained in this presence and in
pursuance of such purposes, desire have already transferred paid and handed
over the said property to the trustees mentioned below.
WHEREAS it is the desire of the FOUNDER and PRESIDENT of the
Trust that the Corpus of the Trust may be further augmented from time to
time by flow of funds and other assets including moveable and immovable
and any other kind by way of gifts, donations, acquisitions, allotments, grant
exchange or otherwise.
WHEREAS the following persons are appointed to be trustees for holding
the said property in trust for the purposes detailed in this Trust Deed,
1. Mr. BALAKRISHNAN MALAIYANDY, Son of Mr. Malaiyandy, aged
about 49 years, residing at Door No. Nilakkottai Taluk, Dindigul District,
Tamil Nadu - 624 208, herein after called the FOUNDER and
PRESIDENT.
2. Mr. VEL MURUGAN, Son of Mr. Balamurugan, aged about 21 Years,
residing at No 3/451, B-19, Bakan Nagar, Paramakudi Po, Paramakudi,
Ramanathapuram District – 623 707, herein after called the
SECRETARY.
3. Mr. ARUMUGAM MURUGAN, Son of Mr. Murugan, aged about 49
Years, residing at No. 1/352, Indira Nagar, Kamutnakudi,
Ramanathapuram District – 623 707, herein after called the Trustee.
NOW THIS DEED OF TRUST WITNESSETH AS FOLLOWS: -
1. Name The Trust hereby established shall be named as “TAMIL
CULTURAL TRUST”
2. Place Office of the Trust shall be situated at Door No. Nilakkottai Taluk,
Dindigul District, Tamil Nadu - 624 208, place in India as the
Trustees may from time to time think fit.

3. Objectives
The objectives for which the Trust is founded are:
1. Preservation and Promotion of Tamil Culture
To preserve and promote the rich cultural heritage of the Tamil
people, including their traditions, customs, and values.
To document and archive Tamil cultural practices, traditional
knowledge, and indigenous practices for future generations.
To conduct research on Tamil history, civilization, and contributions
to various fields such as literature, philosophy, architecture, and
science.
To establish museums, libraries, and cultural centers that showcase
Tamil heritage.
To encourage intergenerational knowledge transfer by organizing
sessions where elders can share traditional wisdom with younger
generations.
2. Development and Promotion of Tamil Language and Literature
To promote the learning and usage of Tamil as a classical language
by conducting Tamil language classes, workshops, and literary
meets.
To encourage and support Tamil writers, poets, and researchers by
providing financial assistance, awards, and publishing opportunities.
To undertake the translation of Tamil literary works into other
languages and vice versa, ensuring global access to Tamil literature.
To conduct Tamil literary festivals, book fairs, and storytelling
sessions to enhance public engagement with Tamil literature.
To digitize rare Tamil manuscripts and historical documents for
preservation and public access.
3. Promotion of Tamil Arts, Music, and Dance
To safeguard and encourage Tamil traditional performing arts such
as Bharatanatyam, Karagattam, Silambattam, Villu Paatu, and other
folk and classical forms.

To organize cultural programs, workshops, and training camps to
support artists and students interested in Tamil arts.
To collaborate with schools, colleges, and cultural institutions to
introduce Tamil art forms in the curriculum.
To recognize and felicitate outstanding artists, musicians, and
dancers for their contributions to Tamil culture.
To establish scholarships for aspiring artists to receive training
under renowned masters.
4. Celebration and Promotion of Tamil Festivals and Traditions
To celebrate important Tamil festivals such as Pongal, Tamil New
Year, Deepavali, Karthigai Deepam, and others with traditional
practices.
To organize public awareness programs about the significance of
Tamil festivals and traditional rituals.
To revive and encourage participation in traditional Tamil games and
folk performances that are gradually disappearing.
To promote eco-friendly celebrations of Tamil festivals, emphasizing
sustainability and traditional practices.
5. Heritage Conservation and Restoration
To identify, document, and support the conservation of Tamil
temples, ancient inscriptions, heritage sites, and traditional
architectural structures.
To collaborate with historians, archaeologists, and cultural
institutions to protect Tamil heritage from destruction or
modernization.
To organize heritage walks, seminars, and exhibitions to educate
people about the importance of Tamil historical sites.
To work with government and private organizations for funding and
technical support in restoring ancient Tamil structures.
6. Education and Awareness Programs
To establish and support Tamil cultural and educational institutions
that promote Tamil knowledge and traditions.

To conduct awareness campaigns, seminars, and lectures on Tamil
history, culture, and identity.
To introduce Tamil language and cultural studies as an integral part
of school and college education.
To provide scholarships and financial aid to students pursuing Tamil
language, literature, history, or fine arts.
To create digital learning platforms, e-books, and online courses on
Tamil culture and history.
7. Community and Social Welfare Initiatives
To provide financial and logistical support to rural artisans, weavers,
and traditional craftsmen to sustain their livelihoods.
To promote traditional Tamil handicrafts, handlooms, and indigenous
industries by organizing fairs and exhibitions.
To encourage organic and traditional farming practices that align
with Tamil agricultural heritage.
To support Tamil-speaking communities by addressing their social
and economic challenges through welfare programs.
To undertake projects for the welfare of Tamil Nadu’s tribal and
marginalized communities while preserving their indigenous
knowledge.
8. Strengthening the Global Tamil Identity
To connect with Tamil communities across the world and facilitate
cultural exchanges.
To organize global Tamil cultural conferences, summits, and forums
for intellectual and artistic collaboration.
To establish partnerships with Tamil organizations worldwide for the
preservation and promotion of Tamil heritage.
To promote Tamil heritage tourism by curating special tours focused
on historical and cultural sites.
9. Digital and Media Initiatives for Cultural Promotion
To create and distribute digital content such as documentaries, short
films, and social media campaigns to raise awareness about Tamil
culture.

To launch a Tamil cultural magazine, website, or YouTube channel to
document and share Tamil traditions and history.
To support independent filmmakers, writers, and content creators
producing content related to Tamil heritage.
To leverage modern technology like augmented reality (AR) and
virtual reality (VR) for immersive cultural experiences.
10. Collaboration with Government and Non-Governmental
Organizations
To work with state and central government agencies in formulating
and implementing policies that support Tamil culture.
To collaborate with NGOs and cultural bodies to conduct programs,
exhibitions, and research initiatives.
To seek grants, funding, and sponsorships from public and private
organizations for the trust’s activities.
11. Legal and Administrative Objectives
To acquire and manage funds, properties, and assets required to
fulfill the trust’s objectives.
To establish endowment funds for the long-term sustainability of
Tamil cultural activities.
To maintain transparency and accountability in all financial and
operational matters of the trust.
To appoint committees and experts to guide the trust’s activities in
an efficient and professional manner.
The trust shall be an irrevocable public educational, cultural trust for the
benefit of all persons belonging to whatever community irrespective of caste,
creed or religion. The Trustees shall stand possessed of the said amount of
corpus endowed by the FOUNDER and PRESIDENT of the trust and such
other properties (both movable and immovable) as may be acquired from
time to time by the trust, by purchase, exchange, grant, allotment,
subscription, endowment, donation, gift, contribution, or in any manner to
whatsoever (all of which shall be designed as Trust properties) on the trust
herein mentioned.

4. Number of Trustees:
The number of Trustees including the FOUNDER and PRESIDENT of
the Trustees shall not be less than two and not more than Five Persons. The
Board of Trustees Shall nominate and invite person/persons to be the other
trustees for such period, as they may deem fit and proper.
In case of diminution of any of the above trustees, her/his spouse or
son/daughter (heir) shall become a trustee as a successor for such trustees as
they are agreed and expressed their interest in writing to the existing board
of Trustees.
5. Term of Office of the Trustees:
These Trustees shall hold office for such duration as may be specified
by the board of trustees.
6. President:
There shall be a president for the administration of this trust, nominated
by the board of Trustees, who shall be one amongst trustees as specified in
Para (4) above for such period, in such manner as may be specified in this
behalf.
7. Managing Trustee:
(i) The day-today administration of the Trust shall be looked after by
the FOUNDER and PRESIDENT under the guidance, control and
supervision of the board of trustees.
(ii) The Board of trustees shall nominate one amongst the trustees as
specified in Para (4) above to be the FOUNDER and PRESIDENT,
who shall hold office for such period, as may be decided by the
Board of trustees.
(iii) The FOUNDER and PRESIDENT shall perform all functions,
discharge such duties as or specifically entrusted to him/her in
writing by the Board of trustees.
8. Vacancies:

Any vacancy among the Members of the Board of Trustees may be filled
by the trustees as specified in Para (4) above or their successors and they
shall hold office for such duration as may be specified by the Board of
Trustees.
9. Termination of Office of the Trustees:
(a) Trustee shall cease to hold office:
(i) if he/she dies,
(ii) if he/she resigns
(iii) if he/she is adjudged insolvent or found guilty of an offence
involving moral turpitude.
(iv) if he/she is found to have acted against the interest of the
Trust.
(v) if it is unanimously decided by the Trustees specified in para
(4) above that his continuation in the office is against the
interest of the Trust.
(vi) Upon expiry of the period up to which the Board of trustees
have nominated the trustee.
10. Meeting and Proceedings of the Trustees:
The Trustees shall ordinarily meet once in two Months or as often as
may be necessary for the satisfactory conduct of the affairs of the trust.
11. Notice:
Seven days’ Notice shall ordinarily be given in writing for a meeting of
board of trustees.
12. Quorum:
The Quorum for the meeting of the board of trustees shall be three
Members quorum is required for a meeting adjourning for want of Quorum.

A minute book shall be kept by the FOUNDER and PRESIDENT.
Minutes of entry into the office of every new trustee and of all proceedings of
the meeting of the board of trustee shall be entered in the minute book and
shall be signed by the president of the meeting.
13. Voting:
Decisions of the Board of Trustees may be made at a meeting or by
circulation of papers to them. Normal matters of routine nature may be
circulated and decision obtained. The important matters are to be decided at
the meeting. All matters arising for disposal shall be decided by a majority of
the Board of Trustees present at the meeting. The president of the board of
trustees shall have a casting vote in the event of equality of votes, in addition
to his own.
14. Powers, Functions and Duties of the Trustees:
1. All Property of the Trust Movable or Immovable or of any other kind,
shall vest in trust, the trustees shall manage the whole property and
affairs of the trust and shall have all powers, duties and functions
necessary proper and incidental to the promotion and carrying out of
the object of the trust.
2. In particular and without prejudice to the generality of the foregoing the
trustees shall for the purpose of this trust have the following powers,
duties and functions:
To acquire by Gift, Grant, Purchase, Exchange, Lease or otherwise,
lands, buildings, or other immovable properties and also any
movable property.
To construct and maintain buildings, to alter, to demolish or improve
them and equip them suitably.
To accept gifts, donations, endowment and contributions for the
trust and shall be treated as the income of the trust.

To raise loans to receive money, securities or other movable
property on behalf of the trust.
To accept any trust, trust fund or endowment so long as the
provisions of such trust or endowment are in consonance with the
objectives of this trust.
To award scholarship and make donations calculated to promote the
objectives of the trust.
To enter into contracts, or engagements on behalf of the Trust.
To consider such proposals submitted by sub-committee appointed
by this trust and allocate such funds, if necessary, as deemed
necessary for the implementation of the programs.
To make, sign and execute all such documents instruments, as may
be necessary or proper for carrying on the management of the
properties and affairs of the trust.
To invest such money and funds of the trust and to vary the
investment as and when it may seem necessary or proper provided
that such investments shall be made only upon immovable
properties or upon securities as the board of trustee may deem fit,
under section 20 of the Indian Trust Act, 1882.
To sell, transfer or otherwise dispose of any immovable property of
the trust provided all the trustees unanimously resolve that it is in
the interest of the trust to do so to sell or lease, mortgage or
otherwise dispose of any movable and immovable properties of the
Trust.
Alienation of immovable property shall be done after due intimation
to the Director of Income Tax (Exemptions) 30 days before the
alienation.
To appoint Committee/Committees of management for such terms
and with such powers as may be specified from time to time, for
carrying on the routine management of the affairs of the Trust.
To appoint such employees on such terms and conditions as the
Trustees may deem fit for carrying out the work of the trust and

exercise control all such employees including the power of
suspension, dismissal and removal.
To delegate to the managing trustee or any appointed committee
such powers, duties and functions as are vested in the Trustees.
To frame Byelaws and such other regulations as are required for
achieving its objectives.
Out of the income of the trust property shall be entitled to spend or
incur the following expenses namely.
o All rates, taxes, cess, assessments, dues and duties if any payable
to the government to any municipal or other public bodies in
respect thereof or any part thereof.
o The premium for the insurance of the buildings or any other
insurable property movable or immovable for the time being
forming part of the trust property.
o The costs of ordinary repairs and for providing any amenities to the
buildings for the time being forming part of the trust property.
o The cost of making such additions/alterations or improvements to
or in the buildings forming part of the trust property, as the
trustees shall think fit.
o Wages and salaries of any manager, supervisor, accountant, clerk
servant or other employees employed by the trustees in the
carrying out of this trust.
o Cost and expenses of keeping the trust property in good condition.
o Cost and expenses for installing and renovating the electrical and
other installations in the building for the time being forming part of
the trust property.
o The architect's fee and legal charges and fee payable to other
professionals engaged in the course of administration of the trust.
o All other costs, charges and expenses, incidental to the
management and administration of the trust property in
accordance with the objectives and purposes hereof or which may
be incidental thereto.

o Not more than 5% of the income of the Trust / Institution would be
applied for any religious purpose or given to religious institution.
After deducting the costs charges and expenses incurred by the trustee's as
aforesaid out of the total gross income received by them from the trust
property the balance that is the net income will be utilized for the objectives
of the trust as decided by the board of trustees.
15. Book Account.
(i) The Board of Trustees may open such Bank Account or Accounts in any
of the Banks in the name of “TAMIL CULTURAL TRUST” such
accounts shall be operated by the FOUNDER and PRESIDENT and
SECRETARY.
(ii) The trust may open Bank Account/s in the name of institution /
organization founded by the trust. Such Bank Accounts shall be
operated by such persons as authorized by the board of trustees from
time to time.
16. Application of the properties of the Trust:
The properties and funds of the Trust Shall be applied only for the
purpose of the Trust and for the due administration of its business affairs and
properties provided however that this shall not preclude payment of any
remuneration or allowance or giving of residential accommodation or any
perquisites to any trustee in connection with the work carried out by him/her
for the purpose of the Trust.
17. Accounts:
The trustees shall maintain a true and correct record of the receipts,
payments incomes and expenses and transactions of the trust. The Books of
Account of the trust shall be audited by a qualified auditor or a chartered
Accountant every year i.e., commencing from 1st April to the 31 st of March of
next year.
18. Defects of Procedure immaterial:

No act of Trustees shall be invalidated by reason only of any vacancy in
the Board of Trustees or any irregularity in the proceeding of the Board of
Trustees or any committee thereof.
19. Amendments:
Any amendment to the instrument would be carried out only with the
approval of the Director of Income Tax (Exemptions).
20. Dissolution:
In the event of dissolution of winding up of the trust the assets of the
trust remaining on the date of dissolution shall under no circumstance be
distributed among the trustee, but the same shall transferred to other trust,
society, association or institution whose objectives are similar to those of this
trust.
21. Investment Of Trust Funds
The Trust funds shall be invested, from time to time, in accordance with
the provisions of the section 13(1) (d) read with Section 11(5) of the Income
Tax Act, 1961.
The contribution to any religious purpose or religious institution, if any,
shall not exceed more than 5% of the income of the Trust during any financial
year.
22. Acquisition/Alienation of Immovable Property
No immovable property shall be acquired or alienated by the Trust
without the prior approval of the Director of Income Tax (Exemptions)
Chennai.

23. Winding Up
The Trust may be wound up if the Board of Trustees by not less than
three fourths majority so decide.
In such event the assets of the Trust shall be transferred to other
Trusts, Societies or Associations with similar objectives and enjoying
exemptions u/s 11 and 80G of the Income Tax Act.
24. Assets Of the Trust
There are no other movable or immovable properties in the name of the
trust at the time of executing this except the corpus fund contributed by the
Author of this trust.
