Brief facts of the case are while on the way to agricultural field Rajbir and Partap stopped Sumit
(complainant) who was also on his way to his agricultural field claiming he has hit their ox with
his tractor and started fighting him Sumit grabbed the phone from one of the villagers and called
his brother Amit who came from home and rescued him Meanwhile Pratap has thrown a brick to
Amit leading to injury to back of his head leading to fracture thereafter Sumit reached the
Nearest Bapoli police station and registered an Fir against Rajbir S/o RISHIPAL and Pratap S/o
RISHIPAL under the IPC SECTION 323,341,506,34 for hurt.

FACTS:
Claimants/DHS Saina widow, Sameer minor son, Summayya minor daughter and Rihan minor
son of deceased Islam filed present application for seeking direction to JD no.3-New India
Assurance Company Ltd. for re-issuance of cheques described in the application on the ground
that applicants could not deposit the cheques in question through their banker due to lack of
knowledge.
A perusal of the record revealed that MACT, Panipat vide an award dated 14.3.2023 passed in
claim petition no.296-2022 titled Saina & Ors. Vs. Javed & Ors. Awarded compensation and
ordered that compensation of Saina would be given to her whereas compensation of minor
Sameer, Summayya and Rihan shall be deposit in some fixed deposit scheme in some
nationalized bank.
Accordingly, cheques in question were drawn by New India Insurance Co. of HDFC Bank,
Harmony Tower, G.T. Road, Panipat (photocopies attached with the application)

Fresh intimation regarding issuance of fresh cheques again not received from JD no. 3 Insurance

FACTS:
Claim petition received by way of assignment. It be checked and registered. Notice of the
petition be issued to respondents for 20.11.2023 on filing of copy, PF etc. Long date is given due
to heavy pendency of the sessions trial as well as priority given to the action plan cases of 2023-

A perusal of the case file reveals that the investigating officer has not intimated with regard to the
accident in question to the claim Tribunal within 48 hours of the accident and also failed to
produce detail accidental report (DAR) before the claim Tribunal within 60 days of the accident.
In view of the observations given by Hon’ble Supreme Court of India in case titled as M.R.
Krishna Murthi Versus The New India Assurance Co. Ltd. & Others arising out of SLP (C) Nos.
31521-31522 of 2017, wherein the reliance has further been placed on the case law titled as
Rajesh Tyagi & Ors Versus Jasbir Singh & Ors, FAO 842/2003. Hence, a notice in this regard be
issued to the investigating officer to appear in person in the court and directed to submit DAR as
mentioned above.
In compliance of the observations given in the aforesaid M.R. Krishna Murthi’s (supra) case, the
claimants are also directed to open their saving bank account(s) in a nationalized bank near the
place of their permanent residence and the said bank is hereby directed not to issue any cheque
book(s) and/or debit card(s) to the claimant(s) and if the same have already been issued, the said
bank is directed to cancel the same and make an endorsement on the passbook of the claimant(s)
to the effect that no cheque book and/or debit card shall be issued to the claimant(s) without the
permission of the court.
The claimant(s) are directed to produce the copy of this order to the concerned bank upon which
the bank is directed to make an endorsement on the passbook. The claimant(s) are further
directed to produce their passbook(s) with necessary endorsement as well as Aadhar card and
PAN card before the Tribunal till next date of hearing.

FACTS:
File put up before me in pursuance of order passed by the Ld. District & Sessions Judge, Panipat
conveyed vide endorsement No. 916079 dated 27.07.2015.
Arguments on charge not addressed. Ld. Counsel for the accused request for adjournment for
addressing arguments on the ground that due to some unavoidable circumstances, he cannot
address the arguments. Heard. His request not opposed. Now, the case is adjourned to 21.08.2019
for arguments on charge.
Arguments heard. A prima facie case for the commission of offences punishable under Sections
380 and 457 read with section 120B of Indian Penal Code Act is made out against the accused.
Charge is framed accordingly to which the accused pleaded not guilty and claimed trial. Now,
case to come up on 05.05.2020 for evidence of the prosecution. All unexamined PW’s be
summoned to be brought at his own responsibilities.
