I. Introduction简介

This course provides an introduction to the latest legal developments and areas of significance in
modern China. Topics covered include Chinese legal system, legal institutions, civil law, corporate law,
finance law and dispute resolution. Through this module, students will benefit from learning substantive
aspects of modern Chinese law and will be conversant with Mandarin in the legal context. This course
is conducted PRIMARILY in Chinese (Mandarin) and is intended for students who possess a
basic level of Chinese (Mandarin).
本课程介绍了现代中国的最新法律发展和重要领域。涵盖的主题包括中国法律制度、法律机构、
民法、公司法、金融法和争端解决。通过本课程的学习,学生将能接触到大量现代中国法律,
并能在法律语境下使用普通话。本课程主要以中文(普通话)进行,适合具有基本中文(普
通话)水平的学生。

Unfamiliarity with Chinese legal materials and inability to comprehend legal Chinese are common
disadvantages faced by Singapore lawyers advising clients who do business in or with China. This course
aims to deal with this by offering practical skills in the context of an understanding of the broader legal
system and legal culture of China. Students are given selected Chinese legal articles, statutes,
court decisions and other legal documents to read and are required to undertake practice assignments in
Chinese. After the study, students will be expected to be able to interpret Chinese legal concepts in
Chinese. Particularly, we will

• apprehend the historical, political and economic contexts in which Chinese law has evolved and
operated, and understand the role of law in China's sustainable development;
• analyse original Chinese legal documents including legislations, court decisions, contracts, and
journal articles.
• obtain the skills and methods essential to the practice of Chinese business law, such as case
analysis, legal writing and dispute resolution.

II. Course Materials 课程材料


A different set of readings will be assigned for each class. At least one week prior to each class, I will
post the final set of readings.

The reading assignment for each class comprises primarily articles written by academics and
practitioners. For each seminar, there are required readings and background readings. Required
readings should be read prior to the seminar. Background readings provide you with relevant knowledge
to understand the classes better or to develop your interest in specific topics. I may occasionally add
latest newspaper articles, website references or recent articles to the background readings.

III. Course Methodology 课程方法


The course will be conducted through weekly seminars. I intend to use the Socratic Method - each of
you is expected to take ownership of your own learning by coming to class prepared to discuss the
relevant concepts. As the course explores different laws in China which are likely unfamiliar to many of
you, you are required to read the assigned materials before class. Doing so will help you understand the
contents better.
本课程将每周以研讨会形式进行。我打算使用苏格拉底教学法--希望你们每个人都能对自己的

IV. Course Assessments 课程评估


The course will be evaluated by a final essay, a group presentation and class participation.

Attendance 考勤
• There will be an automatic penalty of 2% deducted from your final grade for each class that you
fail to attend—unless you provide me with a valid reason, supported by the relevant
documentation, for your absence.

Presentation 小组展示
• All students will be required to form groups by themselves.
• Each group will present the main points in approximately 40 minutes at the beginning of the
seminar followed by 20 minutes Q&A from the class and the lecturer.
• You are free to support your class presentation by additional materials such as PowerPoint slides
or handouts.
• If you are using slides for the presentation, please upload the slides to Canvas at least two days
before the presentation.

Please upload your research paper into the “Final Essay Submission” folder by the deadline.

ANY LATE SUBMISSION WILL BE PENALISED. For example: if submission is up to 15


minutes late, a B+ may drop to a B; from 16 to 30 minutes, a B+ may drop to a C+ and a C+
may drop to an F. Any paper submitted more than 30 minutes late will receive a failing grade
unless it is also submitted with an explanation of serious attenuating circumstances (i.e. yellow
form -- medical certificate, and other documents must be attached).

The paper must not exceed 4,500 words (excluding footnote and bibliography, if provided).
You will be penalised for exceeding the word limit. The essay must be written in Chinese,
although you can refer to English materials in the footnote.

Citation 引用

Citations may take any form so long as it is consistent and fully identifies the work cited.

You may go beyond the prescribed materials and class discussions in writing the paper, but it is
suggested that you do so by way of adducing facts and statistics or supporting major arguments.

Plagiarism 剽窃行为

You must work individually on this paper. The research paper will require you to demonstrate
an understanding of legal arguments, use evidence and logical arguments to support your views,
and critique those of other writers. You are always required to cite the source when the idea does
not belong to you. PLAGIARISM IN ANY FORM IS NOT ACCEPTABLE and you may be
responsible for the violation of NUS non-plagiarism policy in this regard.

• Show knowledge, understanding and response to the relevant prescribed readings and
the class discussion; and
• Show appreciation of issues discussed during the course.

The research paper will be assessed based on the following criteria:

• The overall structure of your paper and the presentation of a clear thesis;
• The research methodologies employed (doctrinal, empirical, economic or comparative);
• The strength of the arguments, depth of your analysis of the issues, and understanding
of the prescribed piece(s); and
• Your appreciation of opposing arguments and ability to respond to them fairly and
effectively.
