4. Payment Terms
- Payment is due in full prior to the rental period unless otherwise agreed in writing.
- The renter agrees to pay for the rental duration, any additional time, and any applicable fees
including cleaning, refueling, late returns, towing, tickets, or damages.
5. Renter Responsibilities
By signing this agreement, the renter agrees to:
1. Return the vehicle in the same condition as received (including fuel level and cleanliness).
2. Only allow the approved driver to operate the vehicle.
3. Not smoke or allow pets inside the vehicle without prior approval.
4. Refrain from any illegal activity, racing, towing, or off-road driving.
5. Immediately report any damage, accident, or theft.
6. Upload pre- and post-trip photos (360° exterior and dashboard) for mutual protection.
7. Cover all costs for tickets, tolls, parking violations, or towing during the rental period.
6. Use Restrictions
The renter may not:
- Drive off-road or on unpaved surfaces.
- Use the vehicle for commercial ride-sharing or delivery unless authorized.
- Operate the vehicle under the influence of alcohol or drugs.
- Allow any unlisted driver to operate the vehicle.
- Disable GPS or tamper with tracking devices.
- Use the vehicle outside Oahu without permission.
7. Return Policy
- Return vehicle to the agreed location by the scheduled time.
- Keys must be returned in the RFID bag and lockbox under the front passenger seat.
- Late returns may incur additional charges.
- Guest is responsible for parking fee upon return (typically under $20).
8. Damage, Loss, & Insurance
- Renter is fully responsible for any damage, theft, or loss during rental.
- Document pre-existing damage with photos.
- Report all incidents immediately with necessary documentation.
- Renter covers costs not covered by insurance.
9. Liability Disclaimer
Hawaii Rent A Car is not liable for:
- Injuries, accidents, or damages during the rental.
- Lost personal items.
- Delays or mechanical issues.
- Losses due to misuse or agreement violations.
10. Termination & Cancellation
- Owner may terminate rental if terms are violated.
- Renter may cancel with proper notice.
- No refunds for early returns without agreement.
11. Agreement Acknowledgment
By signing, renter agrees to all terms. This agreement is legally binding in Hawaii.
