STATES THAT:

Count 1: MISDEMEANOR BATTERY, DOMESTIC ABUSE - INFLICTION OF PHYSICAL PAIN OR


INJURY

The above-named defendant on or about Wednesday, March 12, 2025, at 3932 West Vliet Street, in
the City of Milwaukee, Milwaukee County, Wisconsin, did cause bodily harm to DT, by an act done with
intent to cause bodily harm to that person, without that person's consent, contrary to sec. 940.19(1),
939.51(3)(a), 968.075(1)(a)1 Wis. Stats.

Upon conviction for this offense, a Class A Misdemeanor, the defendant may be fined not more than
Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

And further, invoking the provisions of sec. 968.075(1)(a)1 Wis. Stats., because this charge is an act of
domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under
sec. 973.055(1) Wis. Stats.

Count 2: MISDEMEANOR BATTERY, DOMESTIC ABUSE - INFLICTION OF PHYSICAL PAIN OR

The above-named defendant on or about Wednesday, March 12, 2025, at 3932 West Vliet Street, in
the City of Milwaukee, Milwaukee County, Wisconsin, did cause bodily harm to MGS, by an act done
with intent to cause bodily harm to that person, without that person's consent, contrary to sec.
940.19(1), 939.51(3)(a), 968.075(1)(a)1 Wis. Stats.

Upon conviction for this offense, a Class A Misdemeanor, the defendant may be fined not more than

Probable Cause:
On the above date around 11:38pm, Officer Taylor Zube was dispatched to 3932 W Vliet St for a
battery call. Upon arrival, he was met at the door by caller MGS. MGS led officers upstairs, where they
met DTS, MAM and EDUARDO FLORES-RUIZ (DOB: 5/23/1994), the above-named defendant.

Additional officers were dispatched due to MGS being the only individual that spoke Spanish.

MGS stated that she was lying in bed when she heard screaming from the kitchen. MGS went into the
kitchen and observed DTS breaking up a fight MAM and the defendant. MGS stated that is when she
called police, and DTS was accidentally struck while trying to break the two up.

On-scene the defendant claimed it was a mutual fight between himself and MAM that arose because
the defendant was playing loud music. At this time, MAM stated the defendant was just a friend that
was staying the night at the residence.

Officers observed red marks and scratches to both MAM and the defendant.

On March 13th, 2025 around 7:00pm, MAM and DTS walked into MPD District 3 to elaborate in the
previous night. They stated that the defendant actually lives at the residence, and has been living there
for the past year.

MGS was re-interviewed, and stated that as she was trying to break up the fight in the kitchen, the
defendant intentionally elbowed her in the left arm without consent, causing pain. MGS showed officers
a bruise on her arm. MGS stated she was confused the day before, and that the defendant was living at
the residence, and had been living there when she first moved there in January of 2025.

MAM stated that the altercation began the night before when he confronted his roommate, the
defendant, about playing music too loudly. MAM sent a text message to the defendant asking him to
turn down the music. MAM stated the defendant then walked into the kitchen and began to yell
obscenities towards MAM. The defendant then began to strike MAM in the face and body with a closed
fist approximately 30 times, without consent and causing pain. MAM stated while being struck, he fell to
the ground, and his girlfriend, DTS, tried to get between the two of them. MAM stated while DTS got
between them, the defendant began focusing his attacks on DTS, striking her in the forehead and arm
with a closed fist before shoving her into the kitchen, causing her to fall.

MAM stated he was able to regain his footing and place a chair between himself and the defendant to
gain separation, but the defendant was able to grab MAM by the neck, impeding his breathing for about
6 seconds while punching MAM with his off-hand. MAM stated that they began wrestling on the ground
before DTS’s cousin (MGS) intervened and attempted to break them up.

After the defendant was separated from MAM, the defendant stated he would really show him what he
was about the following day. MAM and DTS then went to the hospital for their injuries, where they
received Tylenol and Ibuprofen.

MAM, MGS, and DTS did not consent to being struck by the defendant.
