These petitions involve common factual and legal issues,

and are heard and disposed of together.

2. The common prayer is that the concerned Zilla Parishads

may be directed to grant the benefit of the Assured Career

Progression Scheme (ACP) from the date of appointment of the

petitioners as Junior Engineers, and not from the date of

upgradation as Sectional Engineer.

3. The petitioners submit that the issue involved is not

res integra and is considered by the Coordinate Bench in

judgment dated 06-2-2019 rendered in Writ Petition 2605/2017.

The petitioners would rely in particular on the observations of the

Coordinate Bench in the said decision which we may extract :-

“42. In this view of the matter, the denial of the


‘second benefit’ under the MACP Scheme, with
reference to an exercise of cadre restructuring and the
revision in pay scale, in the year 1984, appears to be
legally unsustainable. We are, thus, inclined to answer
the aforesaid question in the ‘negative’. We hold and
declare that the upgradation under GR dated 16th
April, 1984 does not constitute grant of nonfunctional
pay scale and cannot be treated as the ‘first benefit’

within the meaning of Clause 2(b)(3) of the GR dated


1st April, 2010. We are, thus inclined to allow the
petition.”

4. The petitioners are serving/superannuated employees of the

Nagpur, Chandrapur, Wardha, Gondia, Bhandara, Yavatmal

Amravati and Buldhana Zilla Parishads.

5. The petitioners were appointed as Junior Engineers by the

concerned Zilla Parishads in the District Technical Service

(Engineering) Class-III.

6. On 16-4-1984, the State Government decided to confer the

status of “Gazetted Officer” upon degree holders and other Junior

Engineers. While Junior Engineers who had degree were

immediately conferred the status of gazetted officer and the

diploma holder and unqualified Junior Engineers were conferred

the status after putting in specified years of service, the degree

holders were designated Assistant Engineer Grade-II and the

diploma holders and unqualified Junior Engineers were

designated as Sectional Engineers. Both the Assistant Engineers

Grade-II and Sectional Engineers were however assigned the same

pay scale.

7. The ACP Scheme was modified by Government Resolution

dated 01-4-2010, and Clause-2(b)(3) of the Government

Resolution dated 01-4-2010 provided that the benefit of non

functional pay structure shall be considered as the first benefit

under the ACP Scheme. The said clause reads thus :

8. While the petitioners assert, drawing support from several

decisions of the Coordinate Benches, that the re-designation of the

post of Junior Engineer as Sectional Engineer as a part of cadre

review is not non functional pay structure, the Zilla Parishads

would disagree. We note that the affidavits-in-response are filed

only by the Zilla Parishad, Nagpur in Writ Petition 5008/2022 and

Writ Petition 7006/2022. It is emphasized that the petitioners

have not continued to work as Junior Engineers for twelve years

from the date of the appointment. The Zilla Parishad contends

that the post of Sectional Engineer is a newly created post with

higher pay scale and since the petitioners were absorbed in the

post of Sectional Engineer with higher pay scale, the period of

twelve years shall be reckoned from the date of designation as

Sectional Engineer.

9. The learned Counsel for the petitioners would submit, and

justifiably so, that the issue involved is considered and answered

in favour of the employees, by the decisions of the Coordinate

Benches. While in the counter-affidavit, which is filed on behalf of

the Nagpur Zilla Parishad, there is a general statement that the

decisions of the Coordinate Benches would not apply, no attempt

is made to point out any distinguishing feature as would render

the decisions of the Coordinate Benches inapplicable. In fairness

to the learned Counsel who appeared on behalf of the Zilla

Parishads, it is not even seriously argued that the issue involved is

not covered.

10. We may now consider the decision of the Coordinate Bench

in Association of the Sub-ordinate, Kolhapur v. State of

Maharashtra, 2019(4) Mh.L.J. 629, which appears to have been

followed in later decisions.

11. The Coordinate Bench considered the Government

Resolution dated 16-4-1984 whereby the Government resolved to

confer the status of Gazetted Officers upon the degree holders and

other Junior Engineers. The submission on behalf of the

employees was that the MAT did not properly construe the nature

of the upgradation under the Government Resolution dated

16-4-1984, and that the exercise of cadre restructuring was prior

to the introduction of the time bound promotion/ACP Scheme.

The Coordinate Bench considered the issue thus :

“31. It is evident that the aforesaid GR was an


exercise in cadre review. The principal object of the
aforesaid GR was to give gazetted status (ClassII) to
junior engineers working at the lowest level. Not only
the restructuring was done in the lowest cadre of
junior engineers but also the immediately superior
cadre of Assistant Engineer ClassII and ClassI were
restructured. Yet, most importantly, the duties and

functions which the erstwhile junior engineers


discharged, were mandated to be discharged by the
Assistant Engineers GradeII and Sectional Engineers.

32. The primary purpose of the aforesaid GR was,


thus, restructuring of the cadre and rechristening of
the designation of the post. The placement of the
underqualified and unqualified junior engineers in the
newly designated post of sectional engineers was
deferred, till they put in the specified years of service.
It is pertinent to note that no new posts were sought to
be created under the said GR. The fact that a new pay
scale was prescribed for both Assistant Engineers
GradeII and Sectional Engineers, was incidental.

37. A profitable reference, in this context, can be


made to a judgment of the Supreme Court in the case
of Bharat Sanchar Nigam Limited vs. R. Santhkumari
Velusamy and others, wherein in the context of
applicability of reservation, after a survey of the
rulings relating to the promotion and upgradation, the
following principles were expounded.
“29. On a careful analysis of the principles relating
to promotion and upgradation in the light of the
aforesaid decisions, the following principles
emerge:
(i) Promotion is an advancement in rank or grade
or both and is a step towards advancement to a

higher position, grade or honour and dignity.


Though in the traditional sense promotion refers to
advancement to a higher post, in its wider sense,
promotion may include an advancement to a
higher pay scale without moving to a different
post. But the mere fact that both that is,
advancement to a higher position and
advancement to a higher pay scale are described by
the common term “promotion”, does not mean that
they are the same. The two types of promotion are
distinct and have different connotations and
consequences.
(ii) Upgradation merely confers a financial benefit
by raising the scale of pay of the post without there
being movement from a lower position to a higher
position. In an upgradation, the candidate
continues to hold the same post without any
change in the duties and responsibilities but merely
gets a higher pay scale.
(iii) Therefore, when there is an advancement to a
higher pay scale without change of post, it may be
referred to as upgradation or promotion to a
higher pay scale. But there is still difference
between the two. Where the advancement to a
higher pay scale without change of post is available
to everyone who satisfies the eligibility conditions,
without undergoing any process of selection, it will

be upgradation. But if the advancement to a higher


pay scale without change of post is as a result of
some process which has elements of selection, then
it will be a promotion to a higher pay scale. In
other words, upgradation by application of a
process of selection, as contrasted from an
upgradation simplicitor can be said to be a
promotion in its wider sense that is advancement
to a higher pay scale.
(iv) Generally, upgradation relates to and applies
to all positions in a category, who have completed
a minimum period of service. Upgradation, can
also be restricted to a percentage of posts in a
cadre with reference to seniority (instead of being
made available to all employees in the category)
and it will still be an upgradation simplicitor. But if
there is a process of selection or consideration of
comparative merit or suitability for granting the
upgradation or benefit of advancement to a higher
pay scale, it will be a promotion. A mere screening
to eliminate such employees whose service records
may contain adverse entries or who might have
suffered punishment, may not amount to a process
of selection leading to promotion and the
elimination may still be a part of the process of
upgradation simplicitor. Where the upgradation
involves a process of selection criteria similar to

those applicable to promotion, then it will, in


effect, be a promotion, though termed as
upgradation.
(v) Where the process is an upgradation
simplicitor, there is no need to apply rules of
reservation. But where the upgradation involves
selection process and is therefore a promotion,
rules of reservation will apply.
(vi) Where there is a restructuring of some cadres
resulting in creation of additional posts and filling
of those vacancies by those who satisfy the
conditions of eligibility which includes a minimum
period of service, will attract the rules of
reservation. On the other hand, where the
restructuring of posts does not involve creation of
additional posts but merely results in some of the
existing posts being placed in a higher grade to
provide relief against stagnation, the said process
does not invite reservation.” (emphasis supplied)

The propositions expounded at Serial Nos.(ii), (iii)


and (iv),if read cumulatively, govern facts of the
case. The designation as section engineers was
available to all the junior engineers who satisfied
the eligibility condition i.e. putting in a specified
years of service. Secondly, there was no change in
the duties and responsibilities but they were given

a revised pay scale. There was no element of


selection except the process of elimination.

38. In the light of the above, we are of the


considered view that the learned Tribunal had
committed an error in construing that the exercise of
restructuring of the cadres, without there being any
consequent creation of new posts and any change in
the duties and responsibilities, constituted the grant of
nonfunctional pay scale for the mere reason that the
pay scale of all the junior engineers was revised, as a
class.

39. Another factor, which has a material bearing on


the claim of the applicants is that under ACP and
MACP Scheme, the basic postulate is the benefit of pay
scale of the promotional post. It is nobody's case that
under the GR dated 16th April, 1984 the applicants
were given the benefit of the pay scale of the
promotional post. Mere revision of the pay scale can
not be equated with the grant of pay scale of the
promotional post. On the contrary, it is pertinent to
note that under the same GR, the Government had
redesignated the next higher post as Assistant
Engineers GradeI and Assistant Executive Engineers.”

12. The Coordinate Bench as such held that there was no

creation of new post or change in the duties and responsibilities

and it cannot be said that non functional pay scale or structure

was granted only on the premise that the pay scale of all Junior

Engineers was revised, as a class.

13. The Coordinate Bench further noted that while the pay scale

of the degree holder Junior Engineers was also revised by the

same Government Resolution dated 16-4-1984, the degree holder

Junior Engineers were given the second benefit under the MACP

Scheme. The Coordinate Bench found that the discrimination

between the degree holder Assistant Engineer Grade-II and who

were given the same revised pay scale under the Government

Resolution dated 16-4-1984 is invidious. The relevant

observations of the Coordinate Bench reads thus :

“41. Even on this count, we find that the


discrimination between the degree holder Assistant
Engineers Grade II and the Sectional Engineers, who
were given the same revised pay scale under the GR
dated 16th April, 1984, is invidious. The sectional
engineers, concededly, were brought at par with the
Assistant Engineers Grade II, after putting in the
specified years of service. Thereafter, the absence of

promotional avenues and actual promotion, leaving to


stagnation, affected both the Assistant Engineers Grade II
and Sectional Engineers.”

14. Bunch of petitions came to be filed at Nagpur Bench

claiming relief on the basis of the judgment in the case of

Association of the Sub Ordinate, Kolhapur. These petitions came

to be disposed of by the Coordinate Bench vide order dated

12-4-2022 which reads thus :-

“The Petitioners are seeking a writ of mandamus against


Zilla Parishad, Nagpur to direct them to grant benefit
from the date of appointment as Junior Engineer under
the Assured Career Progression Scheme in view of the
judgment of this Court in Writ Petition No.2605/1017
(The Association of the Sub-Ordinate Service of
Engineers Maharashtra State and others v/s. The State of
Maharashtra and others) dated 6 February 2019. A writ
of mandamus is sought to give effect to the law laid
down by this Court but none of the Petitioners have
demonstrated that benefit flowing from judgment which
the Petitioners seek to rely upon is denied by their
employer. That be so, it is open to the Petitioners to
apply to the employer annexing the copy of the
judgment. If the same is done, Respondent employer

will examine the law laid down by this Court and if it is


found that Petitioners are entitled, proceed to give effect
to the claim of the Petitioners.

2. Writ petitions are accordingly disposed of.”

15. Bunch of petitions were also filed at the Aurangabad Bench

by similarly situated employees and by judgment dated 02-8-2022

in Writ Petition 8009/2021 and connected matters, the Coordinate

Bench held that the issue is not res integra. The relevant

observations read thus :-

9. The grievance of the petitioners is that despite the


judgment dated 6 February 2019, as well as the circular
darted 21 August 2019, some of the Zilla Parishad,
particularly Zilla Parishad Parbhani and the Zilla
Parishad Jalna are not extending the benefits of the
judgment to the petitioners.

10. On behalf of the Zilla Parishad, Parbhani, an


affidavit-in-reply is filed, in which the principle
enunciated by this Court in its judgment in the case of
The Association of Subordinate Service of Engineers
Maharashtra State and Ors (supra) has not been
disputed. However, some averments are made with
regard to the eligibility of some of the petitioners for
grant of financial upgradation. Same is the case with

regard to the affidavit-in-reply filed by the Zilla Parishad,


Jalna in Writ Petition No. 9485 of 2021.

11. We, however, do not propose to go into the


individual cases and entitlement of the individual
petitioners for grant of a particular financial upgradation,
under ACP/MACP Scheme. Since this Court has already
laid down law that the non functional upgradation
granted on the post of Sectional Engineering cannot be
counted as set off for any financial upgradation under
the ACP/MACP Scheme, the direction is binding on the
respondents including the Zilla Parishad, Parbhani and
the Zilla Parishad, Jalna.

12. Accordingly, the present petitions are allowed.


The respondents are directed to grant admissible
financial upgradation under ACP/MACP Scheme to the
respective petitioners, by ignoring non functional
upgradation granted/admissible, on the post of Sectional
Engineer. The consequential benefits be paid to the
respective petitioners.

16. It appears that pursuant to the order dated 12-4-2022 in

Writ Petition 1908/2022 the petitioners did call upon to consider

Zilla Parishads to do the needful, but in vain.

17. We may note from paragraph 8 of the judgment rendered at

Aurangabad Bench that there is a reference to the Circular dated

21-8-2019 issued by the Government of Maharashtra that

directions in paragraph 44 of the judgment dated 06-2-2019 in

Writ Petition 2605/2017 be implemented.

18. Be that as it may that it is not in dispute that while some

Zilla Parishads have implemented the judgment dated 06-2-2019,

some like the respondents-Zilla Parishads have not.

19. We see no reason to take a different view from the view of

the Coordinate Benches and which appears to have been accepted

and directions implemented by some Zilla Parishads.

20. The learned Counsel for the Zilla Parishads Mr. Sk. Majid

invites our attention to the decision of the Hon’ble Supreme Court

in the case of The State of Maharashtra and another v. Madhukar

Antu Patil and another in Civil Appeal 1985/2022. The Hon’ble

Supreme Court set aside the judgment of the MAT and the High

Court and held that the contesting respondent shall be entitled to

first time bound promotion on completion of twelve years from

the year 1989 i.e. from the date on which he absorbed on the post

of Civil Engineering Assistant. The Hon’ble Supreme Court noted

that the contesting respondent was appointed on 11-5-1982 as a

Technical Assistant on work charged basis and was absorbed on

the newly created post of Civil Engineering Assistant in the year

1989 which carries a different pay scale. The Hon’ble Supreme

Court held that since the post of Technical Assistant was

altogether different than the newly created post of Civil

Engineering Assistant, the department was right in holding that

the period of twelve years shall be reckoned only from the date of

absorption on the post of Civil Engineering Assistant. We have

already noted the view of the Coordinate Bench that Government

Resolution dated 16-4-1984 did not create any new post as such

and the fact that different pay scale was assigned to all the Junior

Engineers as a class, as a part of the cadre restructuring without

any change in duties or responsibilities on the re-designation as

Sectional Engineers, did not attract Clause 2(b)(3), which we

have already extracted supra.

21. Falling in line with the views of the Coordinate Benches, we

dispose of the petitions by directing that the cases of the

petitioners be considered in accordance with the decision in Writ

Petition 2605/2017 and on the basis that the upgradation under

Government Resolution dated 16-4-1984 does not constitute grant

of non functional pay scale and cannot be treated as first benefit

within the meaning if Clause 2(b)(3) of the Government

Resolution dated 01-4-2010.

22. We expect the respondents-Zilla Parishads to do the needful

within eight weeks from uploading this judgment on the website

of the High Court.
