about it. There have been numerous instanceswhere serious breachesof peaceculminatedin
cas s of rioting including myrder have ta-keplace during the pendencyof such proceedings
in Ccurt. Thana Circie and Dis;rict Officers should not feel that their responsibilityceases
after submissionof proceerJings, rill the proceedings
are disposedof in Court and necessary
orders demandingbonds or deciaiing plrties in possession,as the case may be, are passed,
it meansnothing. As there has to be som:time laps fbr observingthe proceduralrequiiements
-provision
and inconductingthe required entluiries after the proceedi,gs reach th-e }dagistrate,
for obtaining interim bonds under slction l17 (3) Criminal Procedure Code, fbr" seizing
property in disputeunder section116, Criminal ProcedureCode have been made. While making
prayers lbr taking such bonr,ls or seizing such properties in deserving cases,,, the Thana
Officers should take interest that the time laps for the disposalof the proceedingscan be
as short as possible. They sball not only ensure their attendanceon due datesln Courts
but also take stepsso that the rvitnesssesdo also attend the Courts on due dates. They
shall also take prompt sieps to ensure proper serviceand executionof all notices, summons
and orders issued in this csnnection.
Whenever there is any unnecessarydelay the SubdivisionalPolice Offieers and Circle
Inspector shall take thio up with the SubdivisioiralOfficer at the Subdivisionallevel and the
Superintendent of Police with the District Magistratesat district level.

For maintaining check about disposal of these proceedingsit is hereby ordered that a
quartelly..statement.of all pending proceedingsunder sectionslgTil4llll? .CriminalProcedure
Code shall be submitted so as to reach the C. L D., Crime Branch by the l5th of January,
4pril, July and October in fhe attachedpro forma. The statement for the quarter ending,
the 30th June 1964 shoq'ingall the casespendingtill the 30th August 1964shouldbe submitte-d
immediately.
It is presumedthat proceedingsunder section 144, Criminal ProcedrireCode are disposed
of with due expedition and necessaryorders passed by the Magistrate. Wheneverany delay
is noticed, it should be brought to my notice through the erime Branch grving aU the
necessaryparticulars.

There have been complains from some quarters that in many cases the Thana Ofrcers
submit proceedingsunder sections 107ll45ll47. Criminal Procedure Code not from the
consideration of the real emergencybut for other considerationsand in some casesthe first
pafties and second partie_s,in dispute are also shown in the proceedingsin the reverseway
for the same reason. If this is true even in a single case,-it is utterly reprohensibleand
I would like to make it clear that very severeaction will be taken against the Thana Officers
concernedwheneversuch instancescoms to notice or the conduct of the officers is reasonably
suspected. All Circle Inspectors_should.. whenever possible, supervise the cases or where
supervisionis not pos.ible test them. In few cases,they should either themselvessupervise
or test or entrust some Gazetted Officer to do the same. Care shouldbe S. Ps., taken to
ensure that while in all deserving cases preventive actions are taken promptly, correctly
impartially and honestly, in no case should it be resortedto unnecessarilyfor any motive,
whatever.
