Please note that EPA no longer accepts FOIA Appeals by email. Per our FOIA Regulations, effective in November 2023, email is not an approved submission method. Please
refer to the instructions in your fee waiver determination letter and see below.

To appeal an adverse determination, a requester must submit an appeal in writing within 90 calendar days from the date of the letter communicating the Agency's adverse
determination, and by one of the following methods:

(1) EPA's FOIA submission website, linked to at www.epa.gov/foia;

(2) U.S. Mail sent to the following address: National FOIA Office, U.S. Environmental Protection Agency, 1200 Pennsylvania Avenue NW (2310A), Washington, DC 20460; or

(3) Overnight delivery service to National FOIA Office, U.S. Environmental Protection Agency, 1200 Pennsylvania NW, Room 7309C, Washington, DC 20460.

Dear EPA

The above referenced FOIA request was denied an expedited process which allows

90 days to appeal. The project currently impacting coastal resources is likely to

destroy 1000 year old coral animals in coastal waters that bear not just one or two, but

seven critical habitat designations for stony corals.

Two communications and phone call have been completed with local EPA who on the ground has failed to see that actions are taken to stabilize the grounds now destroying the
corals from erosion and sedimentation to coastal waters. It only takes a few weeks to kill the ancient corals.

The people had an injunction hearing this information was important too - and we have to question why the SWPPP is such a secret. It does not appear in the folder with public
information online and local EPA refuse to share it.

Our account holds an old phone number so we cannot verify to enter our site.

EPA gives 90 days to appeal an expedited FOIA process indicating we cannot expect information to be expedited before 90 days anyways?

The corals at risk today grow to form a 1,000 surf break.

Please help us to

1) update our new contact phone to 787-390-3133 without having to delete account and set up a new one, and

2) please help us to see if we can expedite the SWPPP for this complicated shoreline project before any actions are rendered academic.
