Abstract:
The penal mediation is one of the most applications of
restorative justice in penal article, It is a result of the philosophy
of the modern penal policy which withdraws it methodology
from conciliatory thought in order solve all penal conflicts which
did not succeed through the justice traditional mechanism in
the field of alleviating the criminal phenomenon the Algerian
legislator has adapted himself with that philosophy by creating
a system of mediation as a tool of compensation for the public
action to solve some penal conflicts in virtue of the decree 02-15
modifying and completing the penal proceeding and the law n°
12-15 related to the protection of children.
In order to give efficiency to the disposals of penal
mediation have the utmost importance as regards the public
action since the transfer of penal conflicts to mediation leads to
the end of the application of the prescription of the public
action the obtained results in this field of mediation is to
influence on the public action. The success of mediation leads
to the ending of the public action. As regards the failure there
will be an obligation to follow the rules of the public action
starting by it involving.
