Regulations for the Control of Pollution by
Noxious Liquid Substances in Bulk
Definitions (Ref. Chapter 1 – General, Reg.1)
• Noxious Liquid Substance (NLS) means any substance
indicated in the Pollution Category column of chapter 17
or 18 of the International Bulk Chemical Code or
provisionally assessed under the provisions of Regulation
6.3 as falling into category X, Y or Z.
• Residue means any noxious liquid substance which
remains for disposal.
• Residue/water mixture means residue to which water
has been added for any purpose (e.g. tank cleaning,
ballasting, bilge slops). 2

Definitions (Ref. Ch.1 – General, Reg.1)
• Tanker
– Chemical tanker means a ship constructed or
adapted for the carriage in bulk of any liquid
product listed in Chapter 17 of the International
Bulk Chemical Code.
– NLS tanker means a ship constructed or
adapted to carry a cargo of NLS in bulk and
includes an “oil tanker” as defined in Annex I when
certified to carry a cargo or part cargo of NLS in
bulk.

Regulation 2 : Application
• The provisions of Annex II shall apply to all ships
certified to carry Noxious Liquid Substances in bulk.

Chapter 2 – Categorization of
Noxious Liquid Substances

Reg. 6 : Categorization and listing of noxious
liquid substances and other substances
• For the purpose of the regulations of this Annex, noxious
liquid substances shall be divided into four categories as
follows:
.1 Category X : Noxious liquid substances which, if discharged
into the sea from tank cleaning or deballasting operations, are
deemed to present a major hazard to either marine
resources or human health and, therefore, justify the
prohibition of the discharge into the marine environment;
.2 Category Y : Noxious liquid substances which, if discharged
into the sea from tank cleaning or deballasting operations, are
deemed to present a hazard to either marine resources or
human health or cause harm to amenities or other legitimate
uses of the sea and therefore justify a limitation on the
quality and quantity of the discharge into the marine
environment; 5
.3 Category Z : Noxious liquid substances which, if discharged into the sea
from tank cleaning or deballasting operations, are deemed to present a
minor hazard to either marine resources or human health and therefore
justify less stringent restrictions on the quality and quantity of the
discharge into the marine environment.
.4 Other Substances : Substances indicated as OS (Other Substances) in
the pollution category column of chapter 18 of the International Bulk
Chemical Code which have been evaluated and found to fall outside
category X, Y or Z as defined in regulation 6.1 of this Annex because they
are, at present, considered to present no harm to marine resources,
human health, amenities or other legitimate uses of the sea when
discharged into the sea from tank cleaning or deballasting operations. The
discharge of bilge or ballast water or other residues or mixtures containing
only substances referred to as “Other Substances” shall not be subject to
any requirements of the Annex. 6

Chapter 5 – Operational discharges
of residues of NLS
Reg. 13 : Control of discharges
of residues of NLS
• The control of discharges of residues of NLS or ballast water,
tank washings or other mixtures containing such substances
shall be in compliance with the requirements of Annex II.
• A summary of the discharge criteria is given in the next slide.
• The discharge into the sea of clean or segregated ballast shall
not be subject to the requirements of this Annex.
• Discharges in the Antarctic Area
- Antarctic Area means the sea area south of latitude 60°S.
- In the Antarctic Area any discharge into the sea is prohibited.

Reg. 14: Procedures and Arrangements Manual
• Annex II requires that each ship which carries NLS
in Bulk shall be provided with a Procedures and
Arrangements (P&A) Manual.
• The main purpose of the P&A Manual is to identify
for the ship’s officers the physical arrangements
and all the operational procedures with respect to
cargo handling, tank cleaning, slops handling,
cargo tank ballasting and deballasting which must
be strictly followed in order to comply with the
requirements of Annex II.
• Carrying out operations in accordance with the
ship’s P&A Manual, ensures that all pollution
regulations are complied with.

Reg. 15 : Cargo Record Book
• Every ship to which this Annex applies shall be provided
with a Cargo Record Book (CRB) or as an electronic
record book in the form specified in appendix II.
• After completion of any specified operation, it shall be
promptly recorded in the CRB. Each entry shall be signed
by the officer(s) in charge of the operation. Each page
shall be signed by the master.
• The CRB shall be kept in such a place as to be readily
available for inspection. The competent authority of the
Govt. of a Party may inspect the CRB while the ship is in
its port. They may make a copy of any entry and may
require the master to certify that the copy is a true copy.
• In the event of an accidental discharge of a NLS an entry
shall be made in the CRB stating the circumstances of,
and the reason for, the discharge.

• A completed CRB, verifies that all operational
requirements have been observed, such as :
(A) Loading of cargo;
(B) Internal transfer of cargo;
(C) Unloading of cargo and efficient stripping;
(D) Mandatory Prewash (P&A Manual) and
efficient stripping;
(E) Cleaning of cargo tanks, final wash, ventilation;
Tank washings transferred;
(F) Discharge into the sea of tank washings;
(G) Ballasting of cargo tanks;
(H) Discharge of ballast water from cargo tanks;
(I) Accidental or other exceptional discharge;
(J) Control by authorized surveyors. 20
Chapter 7 – Prevention of pollution arising from an
incident involving noxious liquid substances
Reg. 17 : Shipboard marine pollution emergency
plan for noxious liquid substances
• Every ship of 150 gross tonnage and above, certified to
carry NLS in bulk, shall carry on board a
“Shipboard Marine Pollution Emergency Plan (SMPEP)”
for NLS approved by the Administration.
• In the case of ships to which regulation 37 of Annex I also
applies (SOPEP), such a plan (SMPEP) may be
combined with the Shipboard Oil Pollution Emergency
Plan. (SOPEP / SMPEP).
• Such a combined Plan should fulfil the requirements for
an oil spill mitigation and additionally it should have a
mitigation plan for NLS. (Ref. Syllabus 2.10) 21
Reg. 17 : Shipboard marine pollution
emergency plan for noxious liquid substances
SMPEP shall be written in a working language
understood by the master and officers and shall
consist of :
- procedure to report a NLS pollution incident
- list of authorities or persons to be contacted in the
event of a NLS pollution incident
- a detailed description of the action to be taken
immediately by persons on board to reduce or
control the discharge of NLS following the incident
- the procedures and point of contact on the ship for
co-ordinating shipboard action with national and
local authorities in combating the pollution.

Chapter 8 – Reception facilities
Reg. 18 : Reception facilities and cargo
unloading terminal arrangements
• The Government of each Party to the Convention
undertakes to ensure the provision of reception facilities
according to the needs of ships using its ports, terminals or
repair ports as follows :
.1 Ports and terminals involved in ships’ cargo handling shall
have adequate facilities for the reception of residues and
mixtures containing such residues of NLS resulting from
compliance with this Annex, without undue delay for the
ships involved.
.2 Ship repair ports undertaking repairs to NLS Tankers shall
provide facilities adequate for the reception of residues and
mixtures containing NLS, calling at that port.

• Solidifying substance means a NLS which:

- in the case of a substance with a melting point of less


than 15°C is at a temperature of less than 5°C above
its melting point at the time of unloading; or

- in the case of a substance with a melting point of


equal to or greater than 15°C , is at a temperature of
less than 10°C above its melting point at the time of
unloading.

• Non-solidifying substance means a NLS, which is


not a solidifying substance. 36

– High - viscosity substance means a noxious
liquid substance in category X or Y with a viscosity
equal to or greater than 50 mPa.s at the unloading
temperature.
