CONTRACT NO. WS 7802: SOUTHERN AQUEDUCT UPGRADE WP#05 CONSTRUCTION
OF APPROXIMATELY
1850M OF DN1400 FROM ROGER SISHI ROAD TO WESTVILLE TUNNEL ENTRANCE TO
REPLACE THE EXISTING
PRESTRESSED CONCRETE PIPE AND AUGMENT THE EXISTING STEEL PIPE
ASSESSMENT OF FIRST PROGRAMME IN TERMS OF NEC4, CLAUSE 31.3
1. PROGRAMME OF WORKS
The first programme received in terms of Clause 31.1 of the NEC4 refers:
The programme was assessed for the required elements described in Clause 31.2 of the NEC4
and PS.1.2 of the Contract. We note the following:
The starting, access, key, commencement and completion dates were correct.
The sequence, timing, and resources for carrying out the works were assessed;
however, inconsistencies have been identified and will be discussed in detail under item
2 below.
The dates for instructions, inspection, tests and information required to execute the
Works have not been comprehensively indicated. For an example, the is no indication
for submitting of mix designs and their approvals. This is also applicable for traffic
management plan.
Float is not comprehensively shown. This is a requirement as risks are anticipated which
may negatively affect the project. Various items show false dependency and thus
present a risk to the client and not the project.
A detailed cashflow and resource schedule was not provided, a clarity is required,
whether these will be submitted with detailed method statements?
The whole project is shown to be on Critical path. The Contractor is required to justify
and provide supporting documents with evidence.
Consideration to made to shift the expected date of construction work permit 30 days
after 10th of January 2025
Consideration be made to shift the issuance of water use license to date closer to
activity that will be critically be affected if not in place, i.e., item #65: Excavations. This
must take into account the predecessor activities such as all necessary mobilization.
Time allowance has not been provided for anticipated delays relating to services
relocation in line with Sub Clause PS.1.2.1 (5).
Allowance for work required out of normal hours for connection to the existing pipes
requiring temporary shutdown of the existing aqueduct/s in operation must be provided.
27 April 2026 to be included as a non-working day.
The Contractor is requested to provide statement addressing the following:
- Quality Management Plan measures in line with contract specification (i.e., plans to
expedite required control tests and sequencing of activities).
- Maintenance of traffic accommodation and ensuring that the access to adjacent
properties remains operational during construction. The traffic management must
also take into account non-motorised traffic.
- Maintenance of the Temporary deviations whilst they are in use.
- Anticipated Occupational Health and Safety Audits and compliance monitoring.
- Jacking will not be considered for road crossings or towards the tunnel exit/entry to
minimize disruptions to community
2. Contents of the Programme
The following aspects of the programme were assessed and several queries have been
identified which require further clarity. The queries have been grouped 2 headings, namely,
Sequencing of Works and Scope of Works. Please refer to the summary of findings below:
2.1 Sequencing of Works
2.1.1 Item #6, contractor to clarify why the Access date has a dependency on
appointment of CLO and CPG Plan approval.
2.1.2 Item #15, consideration for presentation and adoption of CPG Plan by the project
PSC. Sufficient duration to be programmed, taking into account mobilisation period
and engagement with stakeholders to mitigate risk of project disruptions. The
duration of the activity should therefore be extended to a reasonable time.
2.1.3 Item “81 has a false dependency on #68. Contractor to confirm if they are executing
the works with one (1) team i.e., working on one front? This comment is applicable
for all the recurring items under all sections of the works.
2.2 Scope of Works
Clarity on #item17 – Which PSP are referred to? Note that since this item has
successors, the clarities sought for these revisions of the programme may not be
conclusive, therefore a meeting will be required prior to the Contractor finalizing the
amendments from the assessment of rev00 programme.
Item #34 is this date in line with supplier timeframes? Will the entire order be delivered
at once? If not, does the contractor not see a need to indicate a leg? Furthermore, a
method statement is requested clarifying how the contractor intends to store the pipes
on delivery to site.
Item #44: The programme for cathodic protection will need to be finalized once the
appointed service provider is onboard. It should be noted that there may be information
required from external service provider which could take more than the time allowable
on this current programme, therefore it is recommended that a float be considered by
the contractor to accommodate such for the project, in the spirit of NEC.
Item #60 – Contractor to take into account the lead time required for approval of traffic
management plan, engagement with eThekwini Transport Authority and Roads
Provisions for traffic accommodation plans which are to be implemented especially on
Roger Sishi Rd. The allowable days seems unrealistic.
Construction of layerworks, AV chamber and SV chambers seem to have unrealistic
production durations. The contractor is requested to provide a statement to justify the
production specified and as well as further breakdown activity in the programme.
The Contractor is to submit a statement to justify the basis of scheduling all project
activities to be on critical path
The are several acivities which the cntracftor has not scheduled. The contractor must
submit a statement justifying the omission on the initial programme. These activities
include the following “high level activities identified”:
- Dealing with existing services, protecting liaison with service provider including
delays associated with this activity
- Time required for services relocations
- Clearing and grub
- Repairs on the existing prestressed concrete / include EPDM seals and detailed
investigations
- Removal of prestressed concrete pipe (PCP)
- Temporary cross connections to PCP
- Permanent cross connections to existing steel pipe line (to make twin steel at
specified intervals by Supervisor/Project Manager)
- Jacking: Road Crossings/Trenchless excavations
- Method statement clarifying how many fronts; they are working. Currently it
seems they are working with a single front? Is this due to space constrains? This is
reason programme shoes false dependency on scheduled activities
In general, the contractors programme does not seem to indicate of leg for material import,
inspections, tests, and approvals. The programme also does not show any project float.
Whilst the contractor has indicated items that are to be done by the CPG, a CPG
implementation plan is also not yet in place and therefore the Project Manager is not in position
to assess the first programme comprehensively. The current submitted information by the
Contractor showing intended work activities for CPG is not in line with the contractor and
therefore it is also not possession to be approved.
3. APPROVAL OF THE PROGRAMME
Taking the above assessment in account, we hereby instruct the Contractor to amend or
provide supporting documentation so substantiate the first programme in terms of sequence
and scope of works. We further urge the Contractor to reassess the programme for accuracy
prior to the final submission in order to expedite the approval process. We are willing to meet
and discuss the final programme if required.
Please ensure that the final submission in terms of Clause 31 of NEC is received by no later
than 15h00, on 29 January 2025.
