• (a) The date of first appointment to a service
The seniority of a person in a service, class, category
or grade shall, unless he has been reduced to a lower
rank as a punishment, be determined by the date
of his first appointment to such service, class,
category or grade.
As we were appointed as Junior Panchayat
Secretaries on 11-04-2019 and after completion
of 4 years of probation got transfer from category
of Junior Panchayat Secretary to Panchayat
Secretary Grade IV post, where after completion
of 3 years probation as per recruitment

notification, as per this rule which justifies for
considering 11-04-2019 and corresponding dates
of first appointments of the consecutive recruited
incumbents as effective date, since it is the date
of first appointment to a service as criteria.
21. CONFIRMATION:
(a) Confirmation of a member of a service:- As soon
as a person appointed initially in a service or class of
a service is declared to have satisfactorily completed
his probation or deemed to have satisfactorily
completed his probation, he shall be confirmed as a
member of that service, by the appointing authority.
The seniority of the person shall however be
regulated in terms of rule 33 of these rules.

With reference to G.O.Ms.No.84, PR&RD(Mdl-
II) Department, dt:24.02.2010 cited, Rule (8) para(2)
& (3) envisages as under:
(2) Every person appointed to any of the posts
either by promotion or by transfer shall, from the
date of which he commences probation, be on
probation for a total of one year on duty within a
continuous period of two years.
(3) The District Collector shall be the authority
competent to declare the probation on completion of
the prescribed period of probation for the categories
under class A and categories I & II of class B.
In this regard, we request your goodselves to
kindly declare the probation period of Panchayat
Secretary Grade-IV, as we were transferred from
category of Junior Panchayat Secretaries to
Panchayat Secretaries Grade-IV for which the
probation period is one year which is already
completed and deemed to be completed
retroactively in line with Rule 18 of Telangana

RE/B2/2017, dt:31.08.2018 and orders were
issued through District Selection Committee
as JPS with consolidated pay of Rs.15,000 and
later enhanced to 28,719/- vide G.O.Ms.26,
dt:15.07.2021 and whereas the OPS/CPS were
paid through agencies with mere pay of
Rs.15,000/- deducting the ESI etc.,net pay is
around Rs.10,000 to Rs.12,000 varies from
district to district based on agencies, which is
vivid unjustifiable and difficult for their
perpetuation.
It is also pertinent to note that as all the

certificates like Birth, Death, Marriage etc.,
Pensions enquiry, GP Resolutions, Financial
transactions and Audits etc., executed are
entrusted to Panchayat Secretaries for
implementation of various Government
Schemes and Administration sanctions, as
these welfare programmes are also
implemented by Outsourcing Panchayat
Secretaries as Executive Authorities at GP
level corresponding to other Regular
employees, then what is the sanctity of the
works implemented by OPS are valid.
Hence, as an Executive Authority at GP level,
implementing the welfare schemes to public,
So why the welfare of the OPS are not
considered.
As per Election Manifesto, it has been
promised that the services of all the newly
recruited Panchayat Secretaries will be
regularized.
Writ petitions have been filed challenging G.O.

dated 12.03.2021 and 15.03.2021 issued by
respondent for cancellation of appointment of
the petitioners as Junior Panchayat
Secretaries under Sports Quota.

W.P. Nos.5539, 5758, 13738, 13849, 21724,
24057, 24790 OF 2021 AND W.P. Nos.10629,
11415, 11546 and 12291 OF 2019.
As the issues involved in all these writ
petitions are the same, they are being disposed
of by common order.
Though the petitioners have contended that
they have participated at National Level and
other selected candidates participated at State
and District levels and the petitioners should
have been appointed being more meritorious
in sports, there is no material to that effect
filed by the petitioners. The petitioners have
neither pleaded nor explained to as to how the
selected candidates are less meritorious than
them and comparative assessment of the
petitioners vis-à-vis the selected candidates is
also not available on record;
The facts in W.P. No.13849 of 2021 are taken
up for disposal of this batch of writ petitions.
Hence, the 98 sports quota candidates are
to be reinstated as the writ petitions are
disposed on 25th April, 2023, and no further
orders are implemented, though the cases
are disposed off.
The Panchayat Secretary is of dire need as

approval, basing on those reports submitted by
Panchayat Secretary the schemes are
implemented.
Simultaneously under MGNREGS Scheme
enhancing the rural livelihood by providing
employment to the needy and eradicating poverty
by imparting awareness on scheme.
These above facts justifies for enhancing the
statutory mandate of Panchayat Secretaries by
classifying into Grade A (Superintendent Cadre)
and Grade B(Senior Assistant Cadre) respectively.

Level.
Later on after several requests, the Field
Assistants were reinstated and presently
working in the Gram Panchayats.
Keeping in view of above facts, kindly delist
Panchayat Secretaries for exemptions in Social
Audits of MGNREGS Scheme.
