“AN ORDINANCE TRANSFERRING OWNERSHIP AND TURNING OVER


POSSESSION OF THE PORT OF AMANDAYEHAN IN BARANGAY
AMANDAYEHAN, BASEY, SAMAR TO THE PHILIPPINE PORTS AUTHORITY
(PPA)”
WHEREAS, the Sangguniang Bayan received a request from the Honorable
Municipal Mayor for the transfer of ownership and turnover of possession of the Port
of Amandayehan to the Philippine Ports Authority (PPA);
WHEREAS, the Port of Amandayehan, located in Barangay Amandayehan,
Basey, Samar, is owned, operated and managed by the management of the Local
Government Unit (LGU) of Basey;
WHEREAS, due to limitations in the LGU’s technical and financial capacity to
maintain and develop port facilities, there is a need to assign and turn over the
port’s management and operations to the PPA;
WHEREAS, the PPA has the authority, capacity, and technical expertise to
effectively manage and operate ports in accordance with national standards, and its
assumption of the Port of Amandayehan is in line with its mandate to regulate and
promote the growth of the country’s port system;
WHEREAS, the transfer and turnover are also seen as a strategic response to
the logistical challenges brought about by the imposition of weight restrictions on
the San Juanico Bridge, and the Port of Amandayehan is expected to play a role in
rerouting cargo traffic to ensure uninterrupted movement of goods between Samar
and Leyte;
WHEREAS, the Barangay Council of Amandayehan has expressed no
objection to the proposed turnover of the port to the PPA;
NOW, THEREFORE, on motion of Hon. Ariel P. Duran and duly seconded
by the august body, be it:
RESOLVED, as it is hereby RESOLVED, to transfer ownership, operation,
management and turn over possession of the Port of Amandayehan to the Philippine
Ports Authority thru Deed of Conveyance to be signed by the Municipal Mayor, is
hereby authorized for that purpose;
RESOLVED FURTHER, to furnish copies of this Ordinance to the Office of the
Municipal Mayor, the Philippine Ports Authority, Sangguniang Panlalawigan and
other concerned agencies for their information and appropriate action.
