ORDINANCE NO. 17-19-G-03

AN ORDINANCE REGULATING THE DOMESTICATION OF DOGS IN THE MUNICIPALITY OF


TAMBULIG, AND PROVIDING PENALTIES FOR ANY VIOLATION THEREOF.

Be it ordained by the Sangguniang Bayan of the Municipality of Tambulig, that:

Section 1. Title. This Ordinance shall be known as the Anti-rabies Ordinance of 2017 of
the Municipality of Tambulig.

Section 2. Definition of Words and Phrases. The following words and phrases, as used in
this Ordinance, shall be construed as follows:

(a) Dog shall apply to a specific domestic animal (canis amiliarities) male or female.
(b) Vaccination against rabies means the inoculation of a dog with a rabies vaccine
licensed for and specified by the Bureau of Animal Industry, Department of Agriculture (DA),
such vaccination must be performed by a trained individual from the BAI or Department of
Health (DOH).
(c) Owner shall mean any person keeping, harboring or having charge or control of, or
permitting any dog to habitually be or remain on, or be lodged oR fed within such person’s
house, yard or premises.
(d) Municipal Rabies Control Authority is the duly authorized person or persons
responsible for enforcement of this Ordinance (policemen, BAI/DOH personnel, trained
vaccinator, and barangay officials).
(e) Has been bitten means has been seized with the teeth, so that the skin of the person
has been wounded or pierced, including scratches.
(f) Enclosed premises refers to the owner’s house or fenced yard where other persons
have no reason to enter except to conduct business or visit with the members of the
household.
(g) Restrained means tethered, leashed or caged.

Section 3. Rabies Vaccination.

(a) Every dog three (3) months of age and older should be submitted by the owner for
vaccination against rabies every two (2) years or as indicated on the label/nature of the
vaccine. Young dog shall be vaccinated within thirty (30) days after they have reached three
(3) months old.

(b) During free mass dog vaccination campaign, every dog 3 months old and older
should be submitted by the owner for vaccination. Dogs not submitted on the scheduled
date or within 5 days shall be destroyed under the supervision of the rabies vaccination
campaign covering at least eighty (80) percent (%) of the dog population.

Section 4. Certificate of rabies vaccination. It shall be the duty of the trained vaccinator
when vaccinating any dog to complete a certificate of rabies vaccination form (in duplicate)
for each dog vaccinated. The Certificate shall include the following information:

(a) Owner’s name, address and telephone number (if any);


(b) Description of dog (color, sex, marking, age, name (breed if any);
(c) Date of vaccination and vaccine expiration (if known);
(d) Rabies vaccination tag number;
(e) Vaccine producer;
(f) Vaccinator’s signature; and
(g) Veterinarian’s license number/vaccinator, which shall be securely attached to the
collar of the dog.

The dog owner shall be provided with a copy of the certificate. The
veterinarian/vaccinator shall retain one copy for the duration of the vaccination. A durable
metal or plastic tag, serially numbered, shall be issued by the veterinarian/vaccinator, and
shall be securely attached to the dog’s collar.

Section 5. Vaccination Cost. The cost of the vaccination shall be borne by the owner of
the dog as determined by the Local Government Unit of Tambulig.

Section 6. Dog registration and Licensing. Every dog shall be registered by their owner
upon reaching the age of three (3) months and every year thereafter. Unvaccinated dogs
registered after reaching the age of three (3) months and dogs three (3) months old and
above not previously registered shall be determined by the Office of the Municipal
Agriculturist. The registration officer shall provide the owner with a certificate of registration
for the dog and affix to it a distinguishing collar tag as proof of registration.

Section 7. Elimination of Unregistered Dogs. Unregistered dogs over the age of four (4)
months shall
be seized and humanely destroyed under the supervision of a licensed veterinarian or the
Municipal Rabies Control Authority.

The licensed veterinarian/trained vaccinator of the Municipal Rabies Control Authority


shall give the guidance on the destruction methods to be used (shooting, poisoning, carbon
dioxide or anesthetic overdose or decapitation) in different environments (areas of
habitation, market place, rubbish dumps, open countryside, etc). The licensed
veterinarian/trained vaccinator, the Municipal Rabies Control Authority or a police officer
may enter any land for the purpose of seizing or destroying a dog.

Section 8. Reporting of Biting Incidents. The owner of a dog which has bitten any person,
and the person who has been bitten, shall within twenty-four (24) hours of the occurrence
report the incident to the Municipal Rabies Control Authority. A health care worker or a
police officer receiving such information shall immediately transmit it to the Municipal
Rabies Control Authority for investigation.

Section 9. Liability of owners of biting dogs. The owner of a dog which has bitten any
person shall be responsible for all the treatment and dog examination or related expenses
incurred by the bite victims unless the bite was inflicted by a restrained dog or had occurred
within the owner’s enclosed premises, in which case arrangements shall be made between
the owner and the bite victim.

Section 10. Implementation. There is hereby created the Municipal Rabies Control
Authority to be composed of the following:

(a) Police Officer;


(b) Health Personnel; and
(c) Trained Vaccinator.

The Municipal Mayor shall issue an executive order for the implementation of this
Ordinance.

Section 11. Penalty. Any dog owner who violates this Ordinance shall be penalized
accordingly:

(a) First Offense – P 1,000.00;


(b) Second Offense – P 1,500.00; and
(c) Third Offense – P 2,500.00 and imprisonment of not more than six (6) months.

Section 12. Effectivity. This Ordinance shall take effect upon approval.
