HOUSE RENT (LEASE AGGREMENT)
This Agreement to Lease is made and entered into the 15 th May, 2024 C.Y. Whereas the
Mr. Ammar Bahadur Chhetri holding the Citizenship No. 6458, Dhading issued on
2042/02/02 B.S. (Here after called owner) of Dhola VDC Ward No. 02, Dhading, Nepal
and Currently now Ratnanagar Municipality, Ward No: 02, Chitwan, Nepal is willing to
rent 10 rooms on the First & Second floor with kitchen and attached bathroom for the
purpose of residence and whereas Mr. Rohit Kumar Khadka holding the Citizenship No.
973/4947, Khotang issued on 2038/12/29 B.S. (Here after called tenant) of Sabik Simpani
VDC, Ward No. 05, Khotang, Nepal is willing to agree to take 10 rooms of the building,
located at the Residential area of Debauli 8, Chitwan now Ratnanagar Municipality, Ward
No: 02, Chitwan, Nepal, at plot no: 1216, area 0-0-10 on following terms and Conditions.
Terms and conditions agreed both by the owner and the tenant are as below.
1. The owner hereby lease to the tenant which is located at the residential area of
Ratnanagar Municipality, Ward No: 02, Chitwan, Nepal. The tenant agreed to take
and the owner agreed to give a lease above mentioned 10 rooms of the building at
monthly rent of Rs. 40,000 /- (Annual Rent Rs. 480,000) (In words : Four Lakh
Eighty Thousand Only).
2. That the rental payment by the tenant to the owner will be paid a month advance.
3. That the tenant will have a right for the partition’s alternations inside the premises
without any loss or damage to their original condition.
4. That all the taxes related to the premises including house and land tax revenue on
land, rent tax and such other taxes as stipulated / may be levied by Nepal
Government shall be paid by the owner. Advance rental tax as per existing law to
be deducted at source by the tenant and paid to the tax department.
5. That the tenant shall permit the owner at all reasonable time during the period of
the lease to enter upon the premises and to inspect the condition there of.
6. The owner agrees that the tenant paying the rent here by reserved and observing
and performance the conditions here in contained shall quietly and peacefully enjoy
the occupation of the said premises without interruption and disturbance by the
owner.
7. That say to day minor repairs of the premises shall by undertaken by the tenant at
his own cost but in case of any major repairs of any damage to the building
structure or any related item shall be attended to and repaired by the owner at his
cost.
8. The owner shall have no right to terminate this agreement during the lease period if
the tenant is paying the rent according to the terms and conditions. However, if the
tenant wants to vacate the tenant shall give three-month advance notice to the
owner.
9. Not with standing anything contained in this agreement if both parties mutually
agree to terminate this agreement it can be terminated.
10. The lease shall commence on the 15 th day of May 2024 with and shall be for a
period of five years i.e. 15th day of May 2029, if both parties agree this period may
be extended for two year with 15% escalation.
11. If any acts or circumstances imputable to the tenant should occur such as those
attributable to force major acts of Nepal or third party to the decision of Nepal
Government authorities which renders the premises of Nepal government
authorities which renders the premises lease not usable for its intended purposes
this shall become null and void and neither party shall make any claims for damage
against the others.
