I hereby agree and acknowledge that my loan application with SMFG India Credit will be considered based on the declarations and
undertakings being provided by me and where SMFG India Credit grants me a loan/facility in furtherance to my loan application, SMFG India
Credit will have all rights to recover any outstanding amounts from me basis my below declarations/undertakings:
1. I certify that the information furnished above and documents provided are true & accurate and no material information has been
withheld / suppressed. In case any of the above information is found to be false or untrue or misleading or misrepresenting, I are aware
that I may be held liable for it. I understand that such information and documents shall be used and relied upon by SMFG India Credit
Co. Ltd. (SMFG India Credit) for the purpose of sanctioning and granting the loan /credit facility(ies).
2. I hereby state that I am a citizen of India. I have read the application form and brochures and am aware of the product features of the
loan I have applied for and its terms and conditions including the general terms and conditions which would be integral part of the
Loan documents and shall be read in conjunction with other loan/facility documents for availing Personal/Business loan registered with
the Sub-Registrar's office Chennai, Tamil Nadu, a copy of which is available on SMFG India Credit website
(https://assets.smfgindiacredit.com/sites/default/files/Personal-Business-Loan-with-LPC.pdf) (hereinafter referred to as “GTC” which
term shall include amendments to the same and any additional terms mentioned by SMFG India Credit from time to time) of availing
finance and/or facility (ies) from SMFG India Credit.
3. I hereby expressly consent SMFG India Credit to share and disclose the my information to service providers, consultants, credit
information companies, information utilities, other banks and financial institutions, regulators, investigating agencies, judicial, quasi-
judicial and statutory authorities, or to SMFG India Credit’s employees, service providers, consultants, affiliates, group companies,
subsidiaries, or to other persons/institutions/entities as may be necessary in connection with the contractual or legal requirements or in
the legitimate interests of the SMFG India Credit or as per the consent, undertake to process information including by way of storing,
structuring, organizing, reproducing, copying, using, profiling, etc. as may be deemed fit by SMFG India Credit and for the purposes of
KYC information verification, credit appraisal, credit risk analysis, fraud detection, anti-money laundering obligations, for entering into
contract, for developing credit scoring models and business strategies, for monitoring, for evaluating and improving the quality of
services and products, or for any purposes as the SMFG India Credit may deem fit, or to any assignees / potential assignees or
transferees, who may need, process and publish information in such manner and through such medium as it may be deemed
necessary by the publisher/ RBI, including publishing the name as part of wilful defaulter's list from time to time as also use for KYC
information verification, credit risk analysis, or for other related purposes. I waive the privilege of privacy & privity of contract and such
disclosure shall not amount to breach of any law, rule, regulation etc. in force. In hereby further consent SMFG India Credit to contact
me via phone, SMS, email or social messaging platforms (eg. WhatsApp, etc.), by itself or its third party service providers, for the
purpose of processing of this application and where loan/credit facility is granted by SMFG India Credit, for the purpose of loan
servicing, communications in relation to the loan/credit facility and payment reminders.
4. I confirm that no insolvency/winding up proceeding or suits for recovery of the outstanding dues or monies whatsoever or for
attachment of my assets or properties and/or criminal proceeding have been initiated and /or are pending against me and that I have
never been adjudicated insolvent by any court or other authority.
5. I understand that sanction/grant of the loan/credit facility(ies) is at the sole discretion of SMFG India Credit and SMFG India Credit shall
be entitled to reject my application without assigning any reason thereof. Further, disbursement of the loan will be subject to execution
of necessary documents, furnishing of security(ies) and completion of other formalities as required by SMFG India Credit. I further
agree that my loan/credit facility (ies) transaction shall be governed by the rules of SMFG India Credit, which may be in force from time
to time.
6. I confirm that loan/credit facility(ies) shall be used for the stated purpose and will not be used for any speculative or antisocial purpose.
7. I hereby undertake to inform/update SMFG India Credit in writing regarding any change(s) in my mobile number/email ID/residential or
employment address for communication and / or other KYC details within 30 days of such change. I hereby undertake to furnish any
additional documents as and when requested and / or required by SMFG India Credit.
8. That no discount or free gift or any other commitment whatsoever is given to me by SMFG India Credit or any of its authorized
representative(s) other than what is documented in this application form the Terms and Conditions/ Agreement pursuant to the
Loan/credit facility(ies).
9. I confirm having understood the terms and conditions applicable to this loan and accept the terms and conditions unconditionally and
agree that these terms and conditions may be changed by SMFG India Credit at any time and I will be bound by the amended terms and
conditions.
10. I hereby agree and expressly consent to SMFG India Credit that in an event where SMFG India Credit is unable to contact me for any
purposes due to change of my current contact details or otherwise, SMFG India Credit shall have a right to use and process my
information provided by me and use all reasonable tools, modes and means to obtain my contact information including mobile number,
residential and office address, from various sources including but not limited to my past and present employers, references provided in
my loan application form, my friends, family and known associates and my information available in public database/records or on social
media and contact me on the same, and I hereby understand, acknowledge and agree that such actions of SMFG India Credit shall not
be considered to be breach of my privacy and confidentiality of my information. I hereby undertake to indemnify and protect SMFG
India Credit from all claims, actions, suits and demands made against, or, losses, damages, costs and expenses incurred or suffered by
SMFG India Credit on account of SMFG India Credit undertaking the aforementioned activity of obtaining my contact information and
contacting me.
11. I am aware that the upfront application fees and the applicable taxes collected from me at the time of application are non-refundable
under any circumstances.
12. I am not an applicant taxable as a US person under the laws of the United States of America (US) or any state or political subdivision
thereof or therein, including the District of Columbia or any other states of the US. Further, the I am not an applicant taxable as a tax
resident under the laws of the counter outside India. I agree to submit a new form within 30 days if any information or certification on
this form becomes incorrect.
13. I confirm that, I am a resident of India and I am not a politically exposed person (PEP) and none of my immediate family member, close
associates or business partners are politically exposed person (PEP). I confirm that, my professional work and business activity do not
belong to any of these Industries listed in this list.
14. I hereby certify that my annual household income is greater than Rs. 3 Lakhs.
15. I hereby declare that I am are not empanelled with SMFG India Credit as a DSA/Channel Partner.
16. I authorise SMFG India Credit to verify/authenticate my KYC/OVD/PAN/Aadhaar number/loan or facilities documents through third party
agencies via digitally/ physical for legitimate business purpose. I hereby consent to SMFG India Credit to contact me in future for the
periodic, updation of KYC / re-KYC records and obtain declaration in this regard from time to time as per applicable law.
17. I hereby declare that providing Aadhaar is voluntary and I can avail SMFG India Credit's services through submitting hard copies of any
of my KYCs/officially valid documents (OVDs) as prescribed by RBI from time to time. I, the holder of the Aadhaar Number and declare
that I have voluntarily, at my own discretion, hereby submitted my Aadhaar number to SMFG India Credit for the purpose of processing
my loan application at SMFG India Credit’s end. I hereby further acknowledge and declare that I understand the following:- a) nature of
information, including my Aadhaar Number and/or Biometric coordinates and/or demographic details that will be shared with UIDAI or
governmental or regulatory authority for the purpose of my KYC authentication as necessitated by the governmental or regulatory
authority; b) choices of all means or modes of sharing my KYC information whether in physical or electronic form; and c) that the said
information will be used for the purpose of consideration and processing my loan application with SMFG India Credit and/or any
analytics associated with my said loan application, before or after disbursement, specifically restricted to my loan servicing with SMFG
India Credit, or for such purposes as may be required by law. I hereby voluntarily give my consent to SMFG India Credit to use my
Aadhaar Number and Biometrics/OTP and/or associated demographic information as required for the aforesaid purpose of
authenticating with UIDAI. I understand that my biometrics/OTP and/or like personal information will not be stored/shared and will be
submitted to Central Identities Data Repository (CIDR) only for performing eKYC authentication and/or for all or any of the aforesaid
purpose(s). I acknowledge that upon successful authentication / transaction, SMFG India Credit will receive a confirmation email and/or
appropriate electronic feedback from UIDAI basis my aforesaid loan application will be processed. I, fully understand that information
shall be used only for the purpose of providing loan/financial services and/or for all or any of the aforesaid purpose(s). I further
understand that my personal data will be retained necessarily to fulfil the KYC requirement and/or for purposes and conditions within
the laws and regulations governing eKYC authentication. I also understand that SMFG India Credit shall ensure security /confidentiality
of my personal identity data provided for the purpose of this transaction. I hereby declare that all the information voluntarily furnished
by me to SMFG India Credit is true, correct and complete in all respects. I will not hold SMFG India Credit or any of its
officials/representatives responsible in case of any incorrect and/or incomplete information/data provided by me. I understand that the
above mentioned information shall be used for KYC and periodic KYC updation process as per the Prevention of Money Laundering Act
2002 and relevant RBI guidelines. I hereby consent to SMFG India Credit to contact me in future for the periodic updation of KYC/re-KYC
records and obtain declaration in this regard from time to time as per applicable law.
18. I understand that the information provided under this application shall be used for KYC and periodic KYC updation process as per the
Prevention of Money Laundering Act 2002 and relevant RBI guidelines. I hereby consent to SMFG India Credit to contact me in future for
the periodic updation of KYC/re-KYC records and obtain declaration in this regard from time to time as per applicable law. I hereby
expressly consent to and authorize the SMFG India Credit (whether acting by itself or through any of its service providers, and whether
in automated manner or otherwise), to collect, store and process my application details, personal data and sensitive information about
me, information, papers and data relating to know your customer (KYC), credit information, and any other information about
me/pertaining to me or not as may be deemed relevant by the SMFG India Credit (collectively, “information") and I hereby also expressly
consent to and authorize the SMFG India Credit to download KYC details from the CKYC registry using my CKYC ID for the purpose of
(product) loan application and periodically receive my updated KYC details from CKYC registry or update my KYC details on CKYC
registry during the currency of the loan. I hereby consent to receiving information from central KYC registry through SMS/ Email on the
above registered number/email address.
19. I confirm GST registration information and registration number provided is true and correct. I understand that if my GST registration
number is not provided or is incorrect, then GST Authority may not grant me GST Input Credit for GST on charges and accordingly I
indemnify SMFG India Credit against any and all claims arising in this regard.
20. I agree and understand that the insurance and / or any third party products are not mandatory for the purpose of the Application and
disbursement of Loan hereunder. It shall be sole discretion of the Customer to avail such insurance and/or any third party products
sourced along with the Loan Application. I hereby provide my consent to SMFG India Credit to adjust any refund / payment against
claim (in whichever manner described) from the Insurance company against my loan outstanding with SMFG India Credit.
21. I confirm that No payment in cash, bearer cheque or kind along with or in connection with this loan application has been collected from
me and that I have submitted self-attested copies of the documents listed in the checklist.
22. I acknowledge that the Loan is subject to assessment as per internal policies of SMFG India Credit. Accordingly, SMFG India credit shall
have right, to accept or reject the loan application(s) or repudiate or cancel the Loan documentation even after execution, which fails to
meet the internal policies of SMFG India Credit.
23. I hereby declare that I have read and understood and agree to SMFG India Credit’s privacy policy which is available at
www.smfgindiacredit.com. I understand that SMFG India Credit may from time to time update the privacy policy and the updated
version of the privacy policy shall automatically become applicable.
1. The interest will be charged on the principal amount of the loan advanced and outstanding from time to time, at the rate agreed
between the parties and as stated in the loan/ credit facility(ies) documents.
2. Processing fee/ documentation fee as deemed fit by SMFG India Credit will be charged towards loan application. Processing fees will be
non-refundable. Taxes as maybe applicable will be charged in connection with the loan/credit facility(ies).
3. SMFG India Credit will not be liable for loss or delay in receipt of documents. Incomplete/defective applications will not be processed
and SMFG India Credit shall not be responsible in any manner for the resulting delay or otherwise.
4. SMFG India Credit reserve the right to retain documents/photographs submitted with this application will not return the same, under
any circumstances to the Applicant. Approval of the application is at sole discretion of SMFG India Credit.
5. If my application is accepted and/ or my credit facility(ies) is/are sanctioned all and/or any disbursals may be made through a mode of
Cheque/NFTS/RTGS and I shall provide all such necessary information to facilitate the same.
6. Quantum of the loan/credit facility(ies) will be finally decided by SMFG India Credit and has not made any commitments to me
regarding the same.
7. Equated Monthly Instalment (EMI) will be due on 4th or 5th of every month.
8. Loan Prepayment charges deemed fit by SMFG India Credit will be charged towards loan closure before end of tenor.
9. Loan prepayment charges are levied / calculated on the Principal Loan Amount Outstanding on the date of prepayment.
10. Other Charges or such other amount as may be specified by SMFG India Credit from time to time plus applicable taxes and/or other
statutory levies would be applicable as mentioned in the Loan Agreement and SMFG India Credit website and is subject to change as
deemed fit by SMFG India Credit.

By and Between
The Borrower(s), details whereof is/are more particularly described in the LSS specified below and, wherever the context so requires,
includes a Co-Borrower(s) named therein and hereinafter collectively (if there is more than one Borrower referred to as the Borrower(s)
of the ONE PART,
AND
SMFG India Credit Company Ltd., a company registered under the Companies Act, 1956 having its registered office at Commerzone IT
Park, Tower B, 1st Floor, No.111, Mount Poonamallee Road, Porur, Chennai, Tamil Nadu, Pincode - 600 116. and inter alia a Branch
Office at the address stated in the LSS appended hereto (and hereinafter referred to as SMFG India Credit which expression, unless
repugnant to the context, shall be deemed to include its successors and assigns) of the OTHER PART.
Definition:
a. “Products” shall mean specified consumer durables, digital, life style products and/or such other products and/or services as
may be provided by the Business Partner and approved for granting loan by SMFG India Credit in its sole discretion from time to
time.
b. ”Business Partner” refers to merchants / dealers / vendors / agency / manufacturer who are registered and/or enrolled with
SMFG India Credit in connection with purchase of the Products by the Borrower.
c. “Purpose” shall mean the reason for which the Borrower has requested for loan from SMFG India Credit and as represented in
the application. For instance, purchase of the Products from Business Partner or for personal use / business use / professional
use.
WHEREAS the Borrower(s) have agreed to this Agreement by affixing his/her/its physical signature or by way of electronic acceptance,
the same are construed as express consent under the existing laws of India. The Borrower(s) has requested SMFG India Credit for
availing a loan for the Purpose. SMFG India Credit has agreed to grant the Loan (as defined hereinafter) upon the Borrower(s) accepting
the terms and conditions hereinafter appearing.
AND WHEREAS THE BORROWER BY CONSENTING TO THIS AGREEMENT ACCEPTS THE TERMS AND CONDITIONS
INCLUDING THE MITC AS SET OUT HEREINAFTER:-
All captalized terms mentioned in this Agreement shall have the meaning as specified in the GTC mentioned below
1.1 That the Borrower(s) after having read and understood, has consented to the sanction terms mentioned in the sanction
letter received through [email protected].
1.2 Subject to the terms and conditions contained in the General Terms and Conditions applicable to the Borrower(s) for availing
Personal/Business loan registered with the Sub-Registrar's office Chennai, Tamil Nadu, a copy of which is available on SMFG
India Credit website (https://assets.smfgindiacredit.com/sites/default/files/Personal-Business-Loan-with-LPC.pdf)(hereinafter
referred to as “GTC” which term shall include amendments to the same and any additional terms mentioned by SMFG India
Credit from time to time), the Borrower(s) herein agrees to borrow from SMFG India Credit and SMFG India Credit agrees to
lend to the Borrower(s) the sum specified in the Loan Summary Schedule (which sum is hereinafter referred to as the “Loan”)
hereto. The most important terms applicable for the Loan are mentioned in the LSS. All other terms of the Loan sanctioned
will subject to the terms mentioned in the GTC. The specific and most important terms applicable to the Loan is mentioned in
the LSS and KFS.
1.3 The Borrower(s) certifies that the information and documents provided to SMFG India Credit for availing the Loan are true &
accurate and no material information has been withheld / suppressed. The Borrower(s) hereby authorize and give consent to
SMFG India Credit to disclose without notice to them, information furnished by them or related documents executed or to be
executed in relation to the facilities availed from SMFG India Credit, to SMFG India Credit's other branches, subsidiaries,
affiliates, Credit Bureaus, Ratingagencies, Service Providers, Banks/Financial Institutions, Government/Regulatory authorities
or third parties for KYC information verification, credit risk analysis, or for other related purposes that SMFG India Credit may
deem fit.
1.4 The Borrower(s) further agrees that this Loan transaction shall be governed by the GTC as specified above. The Borrower(s)
confirm having received a copy of the GTC which is hosted on the website of SMFG India Credit. The Borrower(s) further
confirm that he/she/they have read and understood the terms and conditions mentioned in the GTC applicable to this loan

and accept the terms and conditions unconditionally and agree that theseterms and conditions may be changed by SMFG
India Credit at any time and accordingly he/she/they will be bound by the amended terms and conditions.
1.5 The Borrower(s) also note and acknowledge that SMFG India Credit is obliged to give prospective effect to any revision of
interest rates or other charges, whether upwards or downwards, on all existing advances/financial assistances having regard
to the RBI guidelines/directives, applicable regulations, conditions in the money market, cost of fund and availability of
loanable funds at the relevant time.
1.6 On the happening of any of the Events of Default, SMFG India Credit shall have the right, but not the obligation to recall the
entire Loan and demand payments outstanding on the date of such demand made in respect of the Loan together with
further interest from the date of the Event of Default till the date of payment in full or realization of the total amounts due
and payable and upon the Borrower failing to make the said Payment within 7 (seven) Business Days from the date of such
demand, the SMFG India Credit may, at its sole discretion by a notice in writing to the Borrower(s) and without prejudice to
the rights and remedies available to SMFG India Credit under the Loan Terms or any other Loan Document and SMFG India
Credit shall have, inter alia, the following rights (notwithstanding anything to the contrary in the Loan Terms and/or the other
Loan documents and irrespective of whether the entire Loan or Borrower(s)’ Dues has/ have been recalled) without any
further notice or other legal formalities of any kind namely:
i. in the event the Loan is being disbursed by SMFG India Credit in various disbursements, suspend further drawings of
the outstanding commitment of SMFG India Credit;
ii. SMFG India Credit shall be entitled to exercise any right, power or remedy permitted to it by law, including by suit, in
equity, or by action at law, or both, or otherwise, whether for specific performance of any covenant, condition or term
contained in these General Terms and Conditions or for an injunction against a violation of any of the terms and
conditions of these General Terms and Conditions. The rights and remedies provided to SMFG India Credit in these
General Terms and Conditions are cumulative and not exclusive of any rights or remedies provided by law.
1.7 The Borrower understands and acknowledge that subject to their consent, SMFG India Credit may fetch its data like banking
details, capital market, GSTN etc as the case may be from the participants in the account aggregators(“AA”) ecosystem. The
AAs is a RBI regulated entity that helps secure access and share authorised data between regulated financial institution. The
Borrowers understands that he/she would receive an sms message from our partner AA alongwith the link requesting
consent to share such data with SMFG India Credit. Consent once received shall be valid throughout the tenure of the loan
and SMFG India Credit shall be entitled to fetch such data on a periodic basis through AA for the purpose of periodic review
and monitoring of loan account(s).
1.8 Service Providers:
It is agreed by the Borrower(s), that without prejudice to any rights of SMFG India Credit, all acts/steps as are necessary for
SMFG India Credit to take in order to monitor the Loan and its utilisation and/or the obligations of the Borrower(s), and/or
the Borrower’s compliance with the terms hereof, and/or to recover amounts due to SMFG India Credit or any part or portion
thereof, shall and/or may be carried out by and/or through such other person (including a company or body corporate) as
may from time to time be appointed by SMFG India Credit in respect thereof and that SMFG India Credit will at all times be
entitled to share with any such other person that may thus be appointed by SMFG India Credit, all documents statements of
accounts and other information of whatsoever nature pertaining to the Borrower and/or the Loan. Further, the Borrower(s)
expressly recognises and accepts that SMFG India Credit shall, without prejudice to its rights to perform such activities either
itself or through its officers or servants, be absolutely entitled and have full power and authority to appoint one or more
third parties/recovery agent(s) of SMFG India Credit’s choice and to transfer or delegate to such third parties/recovery
agent(s) the right and authority to collect on behalf of SMFG India Credit all unpaid amounts and to perform and execute all
acts, deeds, matters and things connected therewith or incidental thereto including attending the office or residence of the
Borrower(s), receiving the amounts due, and generally performing all lawful acts as the third party/recovery agent(s) may
consider appropriate for such purposes.
1.9 Customer Grievance Redressal Mechanism: The details of the recovery mechanism are annexed in Schedule- 1
Below is SMFG India Credit’s customer grievance redressal mechanism, which is also available on SMFG India Credit’s website
on https://www.smfgindiacredit.com/policies/grievance-redressal-mechanism-vernacular.aspx and on the notice board of
SMFG India Credit branches: The grievance redressal process for SMFG India Credit consist of a 3 level grievance redressal
mechanism to ensure complaints are treated in an efficient, transparent and fair manner, where the Borrower(s) is not
satisfied with the services provided by SMFG India Credit.
Level 1:
Borrower(s) can submit their complaint at any of the following customer touch-points: (a) Mobile App - SMFG India Credit m-
Connect, available on both Android & IOS; (b) Customer Portal on www.smfgindiacredit.com; (c) Email at
[email protected]; (d) Call SMFG India Credit Customer Toll-free Helpline: 1800 103 6001 (Timings: 9 a.m. to 7 p.m. -
Monday to Saturday excluding public holidays & fourth Saturday of the month); (e) Visit SMFG India Credit branch (Branch
timings: 9:30 a.m. to 6:30 p.m. on Monday to Saturday, excluding public holidays and first Saturday of the month); or (f) Write
on address: “SMFG India Credit Co. Ltd., Ground Floor, Embassy 247, Gandhi Nagar, LBS Marg, Vikhroli West, Mumbai-
400083”.
Level 2:
If there is a delay in the resolution of the complaint or Borrower is not satisfied with the resolution provided to it, Borrower
may write to Customer Complaint Redressal Cell (CCRC) at Email ID - [email protected], or on Address – “Customer
Complaint Redressal Cell, SMFG India Credit Co. Ltd, Ground Floor, Embassy 247, Gandhi Nagar, LBS Marg, Vikhroli West,
Mumbai-400083” or call on tel.no.- 022-69581104. Borrower(s) will receive an acknowledgment/interim response within 7

business days from the receipt of the complaint.
Level 3:
If the Borrower is dissatisfied with the resolution provided by CCRC, Borrower may write to Grievance Redressal Officer (GRO)
at Email ID - [email protected], or on Address – “Grievance Redressal Officer, SMFG India Credit Co. Ltd., Ground Floor,
Embassy 247, Gandhi Nagar, LBS Marg, Vikhroli West, Mumbai-400083”.or call on tel.no.- 022-69581104. Borrower(s) will
receive an acknowledgment/interim response within 2 business days from the receipt of the complaint.
In case the Borrower(s) is dissatisfied with the resolution provided by GRO, the Borrower(s) may write to Principal Nodal

The Borrower understands that SMFG India Credit shall be entitled to modify the customer grievance redressal mechanism
under sub-clause (i) above, in its sole discretion, by communicating the Borrower through such means as may be determined
by SMFG India Credit including but not limited SMS, Email, or publishing on its official website.
1.10 Notwithstanding anything contained in GTC, the Interest on the Loan shall begin to accrue from the date of disbursement /
date of NEFT or RTGS/ date of handover of the Loan cheque to the Borrower (irrespective of the time taken for realization of
the cheque by the Borrower(s) or its bank.
1.11 The Borrower(s) hereby agrees that SMFG India Credit, it officers, employees and agents or external auditors appointed by
SMFG India Credit shall have a right to inspect/audit Borrower’s financial statements/accounts/books/ records, assets and
properties and Borrower(s) hereby undertake to fully cooperate with and provide all information, documents or records to
SMFG India Credit or such external auditors for the purpose of completion of the audit/inspection
1.12 The Borrower(s) agree that the credit facilities shall be used specifically for the purpose mentioned in the sanction letter
issued by SMFG India Credit and the same have not been diverted/siphoned off. In this context the Borrower(s) agree to
provide the necessary end-use certificates, further documents and proof as requested by SMFG India Credit from time to
time so as to enable SMFG India Credit to independently confirm the end use. The Borrower(s) further agree that SMFG India
Credit shall have the right but not an obligation to engage a third-party auditor/professional to obtain a certification as to
whether the Borrowers have engaged in diversion or siphoning of funds sanctioned by SMFG India Credit and to rely on the
certificates issued by such auditor/professional. Where SMFG India Credit reasonable determines that the Borrower(s) have
provided incorrect certifications/declarations or have misrepresented the facts or have diverted/siphoned off the funds,
SMFG India Credit shall, without prejudice to any remedy available under law or contract, be entitled to initiate appropriate
proceedings, civil and/or criminal, against the Borrower(s).
1.13 The Borrower(s) agree that the interest/fee/charges or terms and conditions of Loan may be
amended/changed/modified/replaced/revised by SMFG India Credit at any time, by giving a reasonable prior notice to the
Borrower(s) by such means as SMFG India Credit may consider appropriate, including but not limited to by way of SMS, e-mail
and/or letter sent on The Borrower(s) mobile no., email id or address, respectively, as available in SMFG India Credit’s records
and the Borrower(s) will be bound by such amended terms and conditions.
1.14 I/We hereby understand and explicitly agree that under no circumstances shall SMFG India Credit renew/ enhance/ provide
fresh facility(ies) or restructure existing facility(ies) provided to me/us, so long as my/our name and/or promoter and/ or the
director(s) and/or the person in charge and responsible for the management of the affairs of the entity remains in the list of
wilful defaulters issued by RBI from time to time.

The Borrower(s) (applicable for other than the No Cost EMI Loan) shall pay to the Lender interest on the
principal amount of the Facility outstanding from time to time and other amounts due under or in
respect of the Agreement at the applicable Interest Rate (as reset from time to time) from the date of
each disbursement.
Pre Installment Interest, will be computed from date of disbursement to the due date of the next month
as mentioned in the MITC. It will fall due on the due date falling on the next month, however, will be
charged separately on the due date of the subsequent month following the next month along-with First
EMI (For the purpose of illustration the loan is disbursed on 15th of October, and the due date is 4th of

Terms and Conditions applicable to the borrower(s) for availing Personal/Business loan registered with
the relevant Sub-Registrars office situated in the state of Tamil Nadu, a copy of which is available on

Additional Terms shall prevail in case of inconsistency with the terms mentioned in the GTC
Day-end process: At the end of every calendar day, SMFG India Credit shall run a process to determine whether an account will be
treated as overdue or not. In case of NACH/ e-NACH mandates/ standing instructions, if by the time the day-end process is run, the dues
from the customer are not received into the designated bank account of SMFG India Credit, the amount would be considered as not
received and therefore will be treated as overdue. In case of collection by cash, the date of issuance of money receipt by SMFG India
Credit shall be treated as the date when the amount has been duly received by SMFG India Credit. In case of collection by cheques, the
value date shall be considered as the date when the amount has been received by SMFG India Credit, unless the cheque is subsequently
returned as dishonoured by SMFG India Credit’s bank(s), in which case the instalment/ EMI amount shall be considered as overdue at
the end of day on the value date, i.e. the due date of such payment.
Special Mention Account (SMA): RBI guidelines require a lender like SMFG India Credit to immediately recognize incipient stress in
borrower account by classifying them as SMA. RBI prescribes three levels for SMA recognition, viz., SMA-0, SMA-1 and SMA-2. For
definition of SMA and grading mechanism, you may want to refer RBI circular no. DBR.No.BP.BC.45/21.04.048/2018-19 dated June 7,
2019 on ‘Prudential Framework for Resolution of Stressed Assets’.
Illustration:
In case the due date for an account is 4th calendar day of every month (say, 4th July 2021). The SMA and NPA classification in such cases
shall be as follows:
1. If the EMI/ entire dues of a particular account are not received into the bank account of SMFG India Credit before the day-end
process is run on the 4th calendar day, i.e. the due date, the account shall be treated as overdue after day-end process.
Accordingly, this account shall be classified as SMA-0.
2. If this account remains continuously overdue even after the completion of day-end process on 30th day from the initial due date,
after its classification as SMA-0, the account shall be classified as SMA-1, immediately after running of day-end process, if the full
dues are not received before day-end process is run on the 30th day.
3. If the account continues to remain overdue for 60 days, it shall be classified as SMA-2 upon running day-end process on the 60th
day from the initial due date.
4. If the account remains continuously overdue for 90 days, it shall get classified as NPA upon running day-end process on the 90th
day from the initial due date.
5. Once an account is classified as NPA, it may be upgraded as ‘standard’ only after the entire arrears/ overdue of interest and
principal are paid fully.

SMFG India Credit is entitled to add or modify any of the aforesaid terms and conditions which shall be intimated in advance and
the same shall be binding on me/ us.

In case of any conflict between English version of the Loan Document and any vernacular version, English shall prevail.
I/We hereby undertake to inform/update, SMFG India Credit in writing regarding any change(s) in my/our mobile number/email
id/ residential or employment address for communication and/or other KYC details within 30 days of any change. I/We hereby
undertake to furnish any additional documents as and when requested and/or required by SMFG India Credit.
I/We are aware that the Loan agreement, GTC and other incidental documents executed by me/us integrate all the conditions
mentioned herein or incidental thereto, and supersede all negotiations or prior writings, except for those provisions specified
herein. In the event of any conflict between the terms, conditions and provisions of the Loan agreement/GTC/documents
executed incidental thereto with the terms mentioned herein, then in such an event the terms, conditions and provisions of
mentioned herein shall prevail.
I/We understand that the approval of loan from SMFG India Credit does not certify, represent or warrant in any manner
whatsoever, the nature or quality of Product provided by Business Partner.
I/We understand and agree that any discrepancy/dispute related to the Product shall be reported to Business Partner, I also
acknowledge that SMFG India Credit shall has no role to intervene, if there is a discrepancy/dispute between the Borrower and
the Business Partner in relation to the Product or its use.
In view of the above, I/We understand that SMFG India Credit shall not be responsible or liable for any acts or omissions by the
Business Partner, including but not limited to the wrongdoings, quality, delivery, service fulfillment or effectiveness of Products.
As a part of SMFG India Credit tie-up with Business Partner, the Business Partner shall pay the interest on the Loan, entirely or
subsidized interest directly on behalf of the Borrower, strictly applicable in case of a Subvention/ No cost EMI/ Subsidised
Interest Loan only.
I hereby agree and acknowledge discharge/pay the outstanding Loan dues, to the full satisfaction of SMFG India Credit.
I/ We agree that the content of the KFS have been explained to me and hereby affirm that I have understood the contents of KFS as per
below:
Cancellation:
I/We understand that there shall be no refund of Processing Fees paid to SMFG India Credit in case of cancellation of Product for
any reason whatsoever attributed to Business Partner or to me/us.
I/We have read and understood the cancellation policy of the Business Partner and I shall be responsible and accountable to
abide by the same and shall not raise any claim on SMFG India Credit in case of any dispute between me/us and the Business
Partner.
I/We shall perform necessary formalities with the Business Partner to ensure prompt refund of the outstanding Loan amount
due and payable to SMFG India Credit after the applicable adjustments to the same (if any) as per the cancellation policy.
I/We understand that in the event of Loan cancellation, the cancellation charges if any plus interest from date of disbursal till
receipt of cancellation request as applicable (once the cancellation is confirmed with Business Partner) shall be borne by me/us.
In the event the Product is cancelled, I/we shall continue to be liable for the balance outstanding on Loan account. It would be
my/our responsibility to check the entire outstanding is cleared and a no due certificate to be obtained to that effect from SMFG
India Credit.

SMFG India Credit shall not be liable for non-credit or crediting remittance amount to wrong beneficiary on account of incorrect
information furnished by me/ us in this application form.
Beneficiary bank may levy charges on inward remittance and deduct the same from the remitted amount.
I understand that all National Electronic Fund Transfer (NEFT) instructions are irrevocable and there is no facility for giving stop
payment instruction in respect of remittances through NEFT.
