Duties of Office Peon/Outsourcing Contingents

 He will be on duty half an hour before the working hours of the office in which
he works and leave half an hour after the office hours.
 He will attend to dusting of the tables, chairs, doors, computers, Printers and other
electronic equipments, almirahs, windows and walls of the office area allotted to him.
 He will see that the sweeper cleans floors, toilets, and etc. daily before office hours.
 He will announce the arrival of visitors to the officer concerned and help them to
meet the officer in an orderly manner.
 He will carry the files from one seat to another or to and from the officer as required.
 He will run errands as official business within the office and outside if necessary.
 He will bring tea and other refreshments to the concerned officer/officials when
required and do other odd jobs at headquarters.
 He will expeditiously deliver the outgoing tapals to the post office and other offices at
headquarters.
 He will assist in packing parcels, closing and stamping of letters.

 He should aid any office function as might be expected of him.


 He should top off the water bottles for use by the officer or officials.
 Prior to leaving the workplace, he should check every one of the frameworks are
turned off, lights and fans are turned off, entryways and windows of the bureau are
shut.
 Coordinating the maintenance and repair of office equipment.
 Behave obediently to the superiors, Speak in a polite and friendly, to the Officers &
visitors.
 Be a Honest, hardworking, polite.
 He will do such other duties as may be allotted to him by the officer/officials.
Terms and Conditions

1. The contract under consideration is towards performance of duties of Office Peon /


Outsourcing Contingents listed above.

2. The Contractor shall undertake to provide all the duties as per above list.

3. The personnel shall attend to work punctually at the prefixed / determined timings
and shall be well behaved.

4. The personnel shall perform all the duties assigned to the contractor as specified by
the Department from time to time.

5. In terms of the Contract Labour (R & A) Act. 1970 the contractor shall pay to their
personnel at the prevailing rate as fixed under the Minimum Wages Act 1948, and any
breach of this condition shall be liable for termination of the contract and the same
would be dealt with accordingly. Besides ESI and PF per head at the current rate shall
be paid by the contractor every month as per the existing rules.

6. The contractor is responsible for payment of monthly salary including leave salary,
bonus, gratuity etc. to the personnel as applicable to them.

7. The Contractor shall produce proof/ receipts for the statutory payments such as ESI,
EPF, GST etc. Paid to the authorities concerned along with the bills for succeeding
English calendar month without fail.

8. The Contractor shall submit the bills for the current month by the first day of the
following month so as to enable the Department to process the same and pay the
Contractor.

9. Tax shall be deducted at source as per the Income-tax Rules prevailing from the
monthly bills.

10. The Contractor shall ensure that the work undertaken by its personnel is carried out
efficiently and to the satisfaction of the Department.

11. The Contractor and the personnel engaged by the Contractor shall be subject to the
entry and exit procedures of the Department as may be determined by the Department
from time to time.
12. If, in the opinion of the Department, the Contractor does not engage adequate
number of employees or does not execute the work in a satisfactory manner or in
accordance with the terms and conditions of the contract, the Department may get
the work done through a third party contractor without any written notice to the
contractor the cost of which shall be recovered from the contractor.

13. The Contractor shall provide at its cost, a Manager who shall be responsible for
all acts of the personnel of the Contractor on the premises of the Department on all
days, and who shall be responsible for the supervision and conduct of the personnel
working under the Contractor.

14. Close liaison shall be maintained with the Department's Officers-in-charge


concerned for smooth and efficient performance of duties of the personnel.

15. It shall be the responsibility of the Contractor to comply with the service
conditions of its personnel, including fixation and payment of their wages. However
in order to keep the Department informed for the purposes of the Department's
statutory responsibilities and liabilities, if any, as may be applicable from time to
time, the Contractor shall intimate the Department, the details of wages paid to the
personnel and, if the need arises, to depute its representative to be present at the
time and place of disbursement of wages by the Contractor and inspect relevant
records if any. The Department shall verify such payments made in the wages
register maintained by the Contractor.

16. The Contractor shall ensure that its personnel present themselves clean and tidy
and in proper attire whenever they carry out the work covered by this agreement.

17. The Contractor shall indemnify and shall keep the Department indemnified
against acts or omission or negligence, dishonesty or misconduct of the personnel
engaged for the work, and the Department shall not be liable to pay for any
damages or compensation to such person or to third party.

18. The Contractor shall at all times, indemnify the Department against any claim
which could arise under the workmen's Compensation Act. 1953. And/ or under
any statutory notification thereof or otherwise in respect of any damages or
compensation in consequence of any accident, injury sustained to any of the
personnel engaged by the accident, injury sustained to any of the personnel
engaged by the Contractor or other men whose entry into the Department premises
has been authorized by the Contractor. The Contractor shall insure all the
personnel engaged for this job and such policy shall be produced to the Department
on demand.
19. The Department has not fixed any parameters in respect of the number of
personnel to be employed at the areas of operation. However, in the event of any
exigencies that may arise from time to time, it shall be open to the Department in
the exercise of its discretion to call upon the contractor to provide such additional
personnel as may be necessary in its opinion for the purpose of effectively carrying
out the services contemplated in this Agreement.

20. In the event of increase in Service Tax by Central Government in future, the
same is applicable under this contract; the Department shall bear the same.

21. The Contractor shall arrange for the maintenance of all such registers and forms
as are statutorily required and / or considered necessary for the efficient
performance of this contract.

22. That it is clearly agreed and understood that all the persons provided / engaged
by the Contractor shall be the employees of the Contractor, and all the disputes
between the Contractor and his personnel shall have no bearing on the Department.
The Department shall not be responsible for any claims made by such persons and
shall not be liable to pay any amount to any employee/ex-employee of the
Contractor. The Contractor is fully responsible for disciplined behaviour of its
workmen.

23. All damages caused by the Contractor or that of the Contractor's employees or
by any other personnel arising out of its employees instructions shall be charged to
the Contractor and recovered from its dues/bills or by other moderns of direct
recovery.

24. Failure by the contractor to comply with any statutory requirements and/or the
terms of the agreement during the period of contract shall result in deductions
from the bill at the rate fixed by the Department for each lapse and or termination
of the contract and subsequent disqualification from participation in any future
order of the department.

25. In case the contractor withdraws or the department terminates the Contract for
violation of terms and conditions and/ or deficiency in services during the period of
Contract, the additional expenses in hiring a new Contractor on temporary
arrangement till the time of appointing a regular Contractor through a similar
tender process, shall be recovered from the Contractor.

26. Besides the above an undertaking in the following shall also be furnished.
OTHER TERMS AND CONDITIONS PERTAINING TO PEON SERVICE:-

1. The Physical and mental fitness level of the peon employee should be up to the
required standards as demanded by the nature of duty.

2. They should not be alcoholic, drug addicted etc.

3. The peons engaged should not indulge in any other activity with any
workers/employees in the premises.

4. It is the responsibility of the Service provider for the replacement of the peon
who goes on leave or whose performance is not satisfactory.

5. The Peon employees will report directly to the Additional Director of Income Tax
(Investigation), Madurai.

6. The Income-Tax Department reserves the right to cancel the contract at any
point of time without giving prior notice and without assigning any reason

7. Any dispute shall be subject to Civil Court having Jurisdiction over Madurai.

8. The payment will be disbursed after deducting Income Tax TDS & GST TDS at the
applicable rates.

9. Bill for every month should be submitted on 1st working day of the following
month without fail Proof for having remitted ESI, PF and GST should also be
submitted every month.

"The Contractor hereby agrees to undertake he shall abide and confirm various
provisions in so far as they relate to him specified in Contract labour (R&A)
Act.1970"

I- OBLIGATIONS OF THE ADDITIONAL DIRECTOR OF INCOME TAX


(INVESTIGATION), MADURAI

1. That IN CONSIDERATION OF THE SERVICES RENDERED BY THE Contractor as


stated above he shall be paid a sum of Rs.437 (Basic) +Rs.179 (VDA) +EPF (13% of
Basic+VDA) + ESI (3.25% of Basic+VDA) thereon and service charges per month
per person, monthly wages will be calculated as per the number of days worked
during the month and the GST at the prevailing rate of 18%, per month per person
provided by the Contractor. Such payment shall be made on the basis of the bills
raised by the Contractor and duly certified by the Additional Director of Income Tax
(Investigation), Madurai, subject to deduction, if any, and shall be paid before the
15th of the succeeding month. Whenever the rate of wages is changed by the
Ministry of Labour and Employment (order copy to be produced) and the EPF, ESI
and GST will change accordingly. Service charges will be the same.

That the aforesaid lump-sum amount has been agreed to be paid by the Additional
Director of Income Tax (Investigation), Madurai to the Contractor by Electronic
Payment Mode through PFMS. The Contractor shall not increase the service charges
on any ground whatsoever during the period of this agreement.

2. The monthly payment shall be made after deduction of tax or other legal
deductions or any deduction towards insufficient service or other charges to be
determined by the Department.

II- COMMENCEMENT AND TERMINATION:

1. That this agreement will come into force with effect from 01.11.2023 to
31.10.2024 at the same rate and terms and conditions. If the performance under
the contract is found satisfactory, the agreement may further be extended on such
terms and conditions as are mutually agreed upon.

2. That this agreement may be terminated on any of the following contingency

(i) On the expiry of the Contract period as stated above.

(ii) For committing breach by the Contractor of any of the terms and conditions of this
agreement.

(iii) On assigning the contract or any part thereof or any benefit or interest therein
or there under by the Contractor to any third person or subletting whole or part of
the contract to any third person.
It shall be the duty of the Contractor to remove all the personnel deployed by
him on termination of the contract on any ground whatsoever and ensure that no
person creates any disruption / hindrance / problem of any nature to the office of
the Additional Director of Income Tax (Investigation), Madurai.

III- ARBITRATION:

1. In the event of any question, dispute / difference arising under this agreement or
in connection herewith (except as to the matters, the decision of which is
specifically provided under this agreement) the same shall be referred to a Court of
Law.

2. The venue of Arbitration shall be at Madurai.
