1. The intending bidder must read the terms and conditions of CPWD-6 carefully. He should only
submit his bid if he considers himself eligible and he is in possession of all the documents
required.
2. Information and Instructions for bidders posted on website shall form of bid document.
3. The bid document consisting of plans, specifications, the schedule of quantities of various types
of items to be executed and the set of terms and conditions of the contract to be complied with
and other necessary documents can be seen and downloaded from website
https://etender.cpwd.gov.in or www.cpwd.gov.in or www.eprocure.gov.in free of cost.
4. But the bid can only be submitted after deposition of original EMD through online payment
mode and original bank guarantee including e-bank guarantee (for balance amount as
prescribed) either in the office of Executive Engineer inviting bids or division office of any
Executive Engineer, CPWD within the period of bid submission and uploading the mandatory
scanned documents such as Bank Guarantee includes e-Bank Guarantee (for balance amount as
prescribed) from any of the Commercial Bank towards EMD in favour of Executive Engineer,
CSD, CPWD, South Block, New Delhi as mentioned in NlT, receipt for deposition of bank
guarantee to division office of any Executive Engineer (including NIT issuing EE/ AE), CPWD and
other documents as specified.
5. Those contractors not registered on the website mentioned above, are required to get
registered beforehand. If needed they can be imparted training on online bidding process as per
details available on the website.
6. The intending bidder must have valid class-III digital signature to submit the bid.
7. On opening date, the contractor can login and see the bid opening process. After opening of
bids he will receive the competitor bid sheets.
8. Contractor can upload documents in the form of JPG format and PDF format.
9. Contractor must ensure to quote rate in the prescribed column(s) meant for quoting rate in
figures appears in pink colour and the moment rate is entered, it turns sky blue.
In addition to this, while selecting any of the cells a warning appears that if any cell is left blank
the same shall be treated as “0”. Therefore, if any cell is left blank and no rate is quoted by the
bidder, rate of such item shall be treated as “0” (ZERO).
However, If a tenderer quotes nil rates against each item in item rate tender or does not quote
any percentage above/below on the total amount of the tender or any section / sub head in
percentage rate tender, the tender shall be treated as invalid and will not be considered as
lowest tenderer.

10. If it is desired to submit revised financial bid then it shall be mandatory to submit revised
financial bid. If not submitted then the bid submitted earlier shall become invalid.
11. The department reserves the right to reject any prospective application without assigning any
reason and to restrict the list of qualified contractors to any number deemed suitable by it, if
too many bids are received satisfying the laid down criterion.
12. It is mandatory to fill details / upload scanned copies of all the documents as stipulated in the
bid document. If such document is not uploaded his bid will become invalid and processing fee
shall not be refunded.
13. If the Contractor is found ineligible after opening of bids, his bid shall become invalid.
14. If any discrepancy is noticed between the documents as uploaded at the time of submission of
bid and hard copies as submitted physically by the lowest Contractor, the bid shall become
invalid.
15. If relative working in CPWD then the contractor is not allowed to participate in the tendering
process.

The contractor (enlisted or non-enlisted in CPWD) shall not be allowed to participate in the tender
for work(s) in the CPWD Zone / circle /Division /Sub-Division........ excepted from Clause 25 Ref.

LIST OF DOCUMENTS TO BE SCANNED AND UPLOADED WITHIN THE PERIOD OF BID
SUBMISSION:

1. Enlistment Order of the Contractor of the Composite Category in CPWD in appropriate Class.
2. Acknowledgement of depositing earnest money online through e-gateway of SBI, IDBI and Axis
Bank.
3. Scanned copy of original bank guarantee including e-bank guarantee of a Commercial Bank
against EMD, drawn in favour of Executive Engineer, Central Sectretariate Division, CPWD, New
Delhi (The bank guarantee document shall be issued for the same state in which the office of
receiving division office is situated). (In case of Part EMD)
4. Copy of receipt for deposition of original EMD (In case of Part EMD) In enclosed Form-‘A’.

(Note:- EMD is required to deposit in the office of Executive Engineer, Central


Secretariat Division, CPWD, South Block, New Delhi who is inviting bid or Division
office of any Executive Engineer, CPWD within the period of bid submission. If the
EMD is deposited in Sub Division office then it shall not be considered and tender shall
be rejected).

5. GST Registration certificate if already obtained by the bidder.


If the bidder has not obtained GST registration as applicable, then he shall scan and upload
following undertaking along with bid documents.

“lf work is awarded to me, I/we shall obtain GST registration Certificate, as applicable, within
one month from the date of receipt of award letter or before release of any payment by CPWD,
whichever is earlier, failing which I/We shall be responsible for any delay in payments which will
be due towards me/us on account of the work executed and/or for any action taken by CPWD or
GST department in this regard”.

CHECK LIST FOR BIDDERS FOR SUBMISSION OF BID

1. The bidder should read all the instructions, terms & conditions, contract clauses, nomenclature
of items, specifications etc., contained in the bid document very carefully, before quoting the
rates.

2. The bidder should also read the General Conditions of Contract Maintenance Works 2023,
CPWD Form 7 as modified & corrected upto previous day of the last date of submission of the
tender published by D.G., CPWD, Nirman Bhawan, New Delhi-110011 which will be a part of the
Agreement.

3. The bidder shall quote his rates keeping in mind the, site condition, specifications, terms &
conditions, additional and special conditions etc. and nothing shall be payable extra whatsoever
unless otherwise specified.

4. The bidder shall have to make his own arrangement for housing facilities for staff and labour
away from site and shall have to transport the labour to and fro between site and labour camp
at his own cost. No labour huts will be allowed to be constructed at the site except a few
temporary sheds for chowkidars and storekeepers. The decision about how many huts can be
allowed for chowkidars and storekeepers at site shall rest with the Engineer-in-charge and the
bidder shall have no claim on this account.

1.0 The Executive Engineer, Central Secretariat Division, CPWD, Gate No.11, South Block, New
Delhi(Tel. No. 011-21410221/ Fax No. 23015600 / e-mail id : [email protected] on
behalf of the president of India invites online percentage rate bid from approved and eligible
contractors of CPWD of appropriate class for the following work(s):

“A/R & M/O to North Block New Delhi during 2025-26. (SH: Performing the Job for
Data Entry Operator, Clerk, MTS under the Jurisdiction of CSD & Various Offices of
CPWD in Nirman Bhawan, New Delhi).”
*The enlistment of the contractors should be valid on the last date of submission of bids. In
case the last date of submission of bid is extended, the enlistment of contractor shouldbe valid
the original date of submission of bids.
1.1 The work is estimated to cost Rs. 44,52,426/-. This estimate, however, is given merely as a
rough guide.
2. Agreement shall be drawn with the successful bidders on prescribed Form No. CPWD-7
amended up to date which is available as a Govt. of India Publication and also available on
website www.cpwd.gov.in. Bidder shall quote his rates as per various terms and conditions of
the said form which will form part of the agreement.
3. The time allowed for carrying out the work will be 06 Months from the date of start as
defined in schedule ‘F’ or from the first date of handing over of the site, whichever is later, in
accordance with the phasing, if any, indicated in the bid documents.
4. The site for the work is available in parts.
5. The bid document consisting of plans, specifications, the schedule of quantities of various
types of items to be executed and the set of terms and conditions of the contract to be
complied with and other necessary documents can be seen on website
http://etender.cpwd.gov.in free of cost.
6. After submission of the bid the contractor can re-submit revised bid any number of times but
before last time and date of submission of bid as notified.
7. While submitting the revised bid, contractor can revise the rate of one or more item(s) any
number of times (He need not re-enter rate of all the items) but before last time and date of
submission of bid as notified.
8. Earnest money (100%) shall be paid online through e-gateway of SBI, IDBI and Axis Bank
available on e-tendering platform within the period of bid submission.
OR
Earnest will be paid online through CPWD e-tendering platform within the period of bid
submission. This receipt shall also be uploaded to the e-tendering website by the intending
bidder upto the specified bid submission date and time.
A part of earnest money is acceptable in the form of Bank Guarantee includes e-bank
guarantee also. In such cases 50% of earnest money or Rs. 20 lakh whichever is less, will have
to be deposited through online payment mode above and balance can be accepted in form of
Bank Guarantee includes e-Bank Guarantee issued by a Commercial Bank.
The Bank Guarantee includes e-Bank Guarantee submitted as a part of Earnest
Money is valid for a period of 90 days for single bid works from the date of
submission of the tender.

The earnest money given by all the tenderers except the lowest tenderer is refunded
immediately after the expiry of stipulated bid validity period or immediately after
acceptance of the successful bidder, whichever is earlier.
Copy of Enlistment Order and other documents as specified in the press notice/bid documents
shall be scanned and uploaded to the e-tendering website within the period of bid submission.
However, certified copy of all the scanned and uploaded documents as specified in press
notice/bid documents shall have to be submitted by the lowest bidder only within a week
physically in the office of tender opening authority.
Online bid documents submitted by intending bidders shall be opened only of those bidders,
who has deposited EMD online through CPWD e-tendering portal and bank guarantee including
e-bank guarantee (for balance amount as prescribed) from a commercial bank on CPWD e-
tendering platform and other documents scanned and uploaded are found in order.

9. The contractor registered prior to 01.04.2015 on e-tendering portal of CPWD shall have to
deposit tender processing fee at existing rates, or they have option to switch over to the new
registration fee any time.
The bid submitted shall be opened at 03.30 PM on 27.06.2025
10. The bid submitted shall become invalid if:
i. The bidder is found ineligible.
ii. The contractor does not submit the EMD in required form as provided in para 8 above.
iii. If any discrepancy is noticed between the documents as uploaded at the time of submission
of bid and hard copies as submitted physically by the lowest bidder in the office of bid
opening authority.
iv. If bidder does not quote any percentage above or below or at par on the total amount of the
tender or any section / sub head in percentage rate tender, the tender shall be treated as
invalid and will not be considered as lowest bid.
v. If bidder failed to submit the mandatory documents as mentioned in the list of mandatory
documents to be scanned and uploaded within in the period of bid submission.
11. The contractor whose bid is accepted will be required to furnish performance
guarantee of at specified percentage of the tendered amount as mentioned in
Schedule E and within the period specified in Schedule F. This guarantee shall be in
the form of Insurance Surety Bonds, Account Payee Demand Draft, Fixed Deposit
Receipt or Bank Guarantee includes e-Bank Guarantee from any of the Commercial
Banks in accordance with the prescribed form. In case the contractor fails to deposit the
said performance guarantee within the period as indicated in Schedule ‘F’ including the
extended period if any, the Earnest Money deposited by the contractor shall be forfeited
automatically without any notice to the contractor. Theearnest money deposited along with bid
shall be returned after receiving the aforesaid performance guarantee.The contractor whose
bid is accepted will also be required to furnish either copy of applicable licenses / registrations
or proof of applying for obtaining labour licenses, registration with EPFO, ESIC and BOCW
Welfare Board including Provident Fund Code No. if applicable and also ensure the compliance
of aforesaid provisions by the sub-contractors, if any engaged by the contractor for the said
work and Programme Chart (Time and Progress) within the period specified in Schedule F.
12. The description of the work is as follows:
“A/R & M/O to North Block New Delhi during 2025-26. (SH: Performing the Job for
Data Entry Operator, Clerk, MTS under the Jurisdiction of CSD & Various Offices of
CPWD in Nirman Bhawan, New Delhi).”
Intending Bidders are advised to inspect and examine the site and its surroundings and satisfy
themselves before submitting their bids as to the nature of the ground and sub-soil (so far as
is practicable), the form and nature of the site, the means of access to the site, the
accommodation they may require and in general shall themselves obtain all necessary
information as to risks, contingencies and other circumstances which may influence or affect
their bid. A bidder shall be deemed to have full knowledge of the site whether he inspects it or
not and no extra charge consequent on any misunderstanding or otherwise shall be allowed.
The bidder shall be responsible for arranging and maintaining at his own cost all materials,
tools & plants, water, electricity access, facilities for workers and all other services required for
executing the work unless otherwise specifically provided for in the contract documents.
Submission of a bid by a bidder implies that he has read this notice and all other contract
documents and has made himself aware of the scope and specifications of the work to be done
and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the
Government and local conditions and other factors having a bearing on the execution of the
work.

13. The competent authority on behalf of the President of India does not bind itself to accept the
lowest or any other bid and reserves to itself the authority to reject any or all the bids
received without the assignment of any reason. All bids in which any of the prescribed
condition is not fulfilled or any condition including that of conditional rebate is put forth by the
bidders shall be summarily rejected.
14. Canvassing whether directly or indirectly, in connection with bidders is strictly prohibited and
the bids submitted by the contractors who resort to canvassing will be liable to rejection.
15. The competent authority on behalf of President of India reserves to himself the right of
accepting the whole or any part of the bid and the bidders shall be bound to perform the same
at the rate quoted.

16. The contractor shall not be permitted to bid for works in the CPWD Circle (Division in case of
contractors of Horticulture / Nursery category) responsible for award and execution of
contracts, in which his near relative is posted as Divisional Accountant or as an officer in any
capacity between the grades of Superintending Engineer and Junior Engineer (both inclusive).
He shall also intimate the names of persons who are working with him in any capacity or are
subsequently employed by him and who are near relatives to any gazette officer in the Central
Public Works Department or in the Ministry of Urban Development. Any breach of this
condition by the contractor would render him liable to be removed from the approved list of
contractors of this Department.
17. No Engineer of gazette rank or other Gazetted Officer employed in Engineering or
Administrative duties in an Engineering Department of the Government of India is allowed to
work as a contractor for a period of one year after his retirement from Government service,
without the previous permission of the Government of India in writing. This contract is liable to
be cancelled if either the contractor or any of his employees is found any time to be such a
person who had not obtained the permission of the Government of India as aforesaid before
submission of the bid or engagement in the contractor’s service.

18. The bid for the works shall remain open for acceptance for a period of 30 days from the date of
opening of bid. Further
(i) If any tenderer withdraws his tender or makes any modification in the terms & conditions of the
tender which is not acceptable to the department within 7 days after last date and time (24
hours basis) of submission of bids, then the Government shall without prejudice to any other
right or remedy, be at liberty to forfeit 50% of the earnest money absolutely irrespective of
letter of acceptance for the work is issued or not.
(ii) If any tenderer withdraws his tender or makes any modification in the terms & conditions of the
tender which is not acceptable to the department after expiry of 7 days after last date and time
(24 hours basis) of submission of bids, then the Government shall without prejudice to any other
right or remedy, be at liberty to forfeit 100% of the earnest money absolutely irrespective of
letter of acceptance for the work is issued or not.
(iii) In case of forfeature of earnest money as prescribed in para (i) and (ii) above, the bidders shall
not be allowed to participate in the rebidding process of the same work.
(iv) Withdrawal of the tender, by the tenderer, shall only be made through e-tender portal. Any
other method i.e. through letter / e-mail etc. shall not be considered. The tender inviting
authority gets intimation through SMS and email in this regard.
19. This Notice Inviting bid shall form a part of the contract document. The successful bidders /
contractor, on acceptance of his bid by the Accepting Authority, shall, within 15 days from the
stipulated date of start of the work, sign the contract consisting of: -
(a) The Notice Inviting bid, all the documents including additional conditions, specifications and
drawings, if any, forming the bid as issued at the time of invitation of bid and acceptance
thereof together with any correspondence leading thereto.
(b) Standard CPWD Form-7, GCC 2023 (Maintence Works) as corrected / modified upto date.

20 In case of extension of agreement due to delay and / or reduction in scope of work


due to foreclosure, no claim on account of reduction in value of work, loss of
business , loss of profit, consequently overheads, any type of interest etc. shall be
entertained.

21 If the exigencies of the work so demand, the engineer-in-charge may allow payment to a third
party, who is creditor to the contractor, after fulfilling the conditions under clause 7B.

I/We hereby tender for the execution of the work specified for on behalf of the President of
India within the time specified in Schedule ‘F’, viz., schedule of quantities and in accordance in all
respects with the specifications, designs, drawings and instructions in writing referred to in Rule-1 of
General Rules and Directions and in clause 11 of the Conditions of contract and with such materials as
are provided for, by, and in respects in accordance with, such conditions so far as applicable.
We agree to keep the tender open for 30 days from the due date of its opening and not to
make any modifications in its terms & conditions.

as per the bid document.

In respect of portion of EMD prescribed in the shape of BG, the scanned copy of

Further, I/We agree that in case of forfeiture of Earnest Money or both Earnest Money and
performance guarantee as aforesaid, I / we shall be debarred for participation in the re-tendering
process of the work.
I / We undertake and confirm that eligible similar works(s) has/have not been got executed
through another contractor on back to back basis. Further that, if such a violation comes to the notice
of Department, then I/we shall be debarred for bidding in CPWD in future forever. Also, if such a

GENERAL TERMS AND CONDITIONS

1. The contractors are advised to get acquainted with the proposed work and its site and also
study the Architectural Drawings, specifications and special conditions carefully before
tendering. No claim of any sort shall be entertained on account of any site conditions and
ignorance of specifications and special conditions
2. For the discipline of Civil works CPWD specifications 2019 (Vol. I & II) with up to date
correction slips. All Electrical works shall be carried out as per CPWD specification Part-I
(Internal) – 2023, CPWD specification Part-II (External) – 2023, Indian Electricity Rules –
1995 as amended till date of receipt of tenders. For items which are not covered under
CPWD specifications, the special conditions / BIS specifications shall apply. In this regard the
decision of Engineer-in-Charge shall be final.
3. All materials, T & P, consumable and contingent articles required for the work shall be
arranged by the contractor. Materials used shall be in preference as per the nomenclature of
the item / as per approved list / CPWD Specifications and as per directions of Engineer-in-
Charge. Replaced materials used shall have same or richer specifications to the original
materials and compatible to the work. If any of the accessories available in the market is not
ISI marked then decision of engineer in charge is final and will be binding to the contractor.
4. All the malba /rubbish /silt /waste / garden waste etc. generated due to any operation /
execution of the work shall be brought down through the stair case and shall not be thrown
to the ground directly from the upper floors etc. Malba rubbish generated due to any
operation from Bungalows/ quarters / premises and its open spaces whatsoever shall be
disposed offby the Contractor to the specified dumping point on daily basis else a recovery
of Rs. 100/- perBungalows/ quarters / premises per day shall be made from contractor. The
dumping point should be properly barricaded at all the time and should not give ugly look.
This malba / rubbish shall further be disposed to the authorized municipal dhalao / dumping
groundas and when the quantity becomes 4.5 cum or one truck and as per direction of
Engineer-in-charge. The Malba/rubbish kept inside the dumping point should be covered
with sheet or any other suitable material to avoid dust pollution. In case of malba / rubbish
does not got removed from dumping point, a recovery of Rs. 1000/- (rupees One thousand)
per day shall be made from the contractor after issuing notice in writing by the Engineer in
charge of work. If the malba is not removed within three days of notice, the same shall be
got removed by the department at the risk and cost of the Contractor and the amount shall
be recovered from the bill of Contractor. This is in addition to the recovery of Rs. 1000/- per
day for delay in removal of malba
5. The contractor or his representative shall be available at site on every visit of officer-in-
charge as well as visit of senior officers.
6. Chases, holes & drilling works etc. shall be done by using power operated tools.
7. The site for the collection and stacking of the material shall be got approved from the
Engineer-in-charge.
8. The sample of all the items shall have to be got approved by the contractor from the
Engineer-in-charge before the supply commences and shall be without prejudiced to the
right of the Engineer-in-Charge to get random samples tested out of the actual lot received.
9. The Engineer-in-Charge will be at liberty to take respective sample(s) of each item of
Schedule of Quantity in any approved laboratory as decided by him. The sample for testing
will be provided by the contractor. All expenditure required to be incurred for taking sample,
conveyance, packing and testing charges etc. will be borne by the contractor himself. In
case any sample particular lot fails in testing, the contractor will be bound to replace the
entire lot with fresh material of prescribed specification and the rejected lot will be returned
to the contractor only after fresh lot is supplied.
10. Rejected materials will have to be removed by the contractor at his own cost immediately of
the instructions of doing so.
11. In case of any dispute regarding rejection of quality of materials, the decision of the
Engineer-in-Charge will be final and binding upon the contractor.
12. Other agencies may also be simultaneously executing some other work entrusted to them by
the Engineer-in-charge and the Contractor shall offer necessary co-operation wherever
required to these agencies so as not to interfere with or hinder the progress or completion of
the work being performed by other Contractor (s). He shall as far as possibly arrange his
work and shall place and dispose off the materials being used or removed, so as not to
interfere with the operations of other Contractors, or he shall arrange his work with that of
the others in an acceptable and coordinated manner and shall perform it in proper sequence
to the complete satisfaction of Engineer-in-charge.

13. Contractor shall ensure the cleanness and watch & ward of the premises / vacant bungalows
/ quarter / garages etc. till further occupation of the same.
14. All taxes applicable at prevalent rates shall have to be paid by the contractor himself and the
rates quoted by him shall include these taxes and nothing extra on this account shall be
payable.
15. The rates for different items of work shall apply for all heights and depths, leads and lifts
unless otherwise specified in the agreement or specifications applicable to the agreement.
16. Any damage done by the contractor to any existing work during the course of execution of
the work shall be made good by him at his own cost.
17. Articles manufactured by the reputed firms and approved by Engineer-in-Charge shall only
be used. Only articles classified, as ‘first quality’ by the manufacturer shall be used unless
otherwise specified. In case articles bearing ISI certification are not available in the market,
quality of samples brought by the contractor shall be judged by standards laid down in the
relevant CPWD specifications. For the items not covered by CPWD specifications relevant BIS
standards shall apply. The sample of materials to be brought to site for use in work shall be
got approved from the Engineer-in-Charge before actual execution of work.
18. The contractor shall submit a detailed program of work within 15 days of the date of award
of work. The Engineer-in-Charge can modify the program and the contractor shall have to
work accordingly.
19. The quantities of any item shall not be exceeded beyond the agreement quantities without
prior permission of Engineer-in-Charge.
20. Statutory recoveries such as on account of GST, Income tax, Surcharge, Construction
Worker’s Welfare Cess etc. as applicable from time to time shall be made from the gross
amount of Running A/c Bill and Final Bill of the contractor.
21. The contractor shall make his own arrangements for obtaining electric connection, if required
and make necessary payments directly to the department concerned. In the absence of
electric connection or failure of power supply, the Contractor shall make his own
arrangement of silent type generators as per NGT Guidelines.
22. The contractor shall make his own arrangement for getting the permission for entry of trucks
carrying materials for the site from the traffic police.
23. No payment shall be made to the contractor for any damage caused by rain, snow fall,
floods or any other natural causes whatsoever during the execution of work. The damage
caused to work shall have to be made good by the contractor at his own cost and no claim
on this account shall be entertained.
24. The contractor shall take all precautions to avoid accidents by exhibiting necessary caution
boards / signages, warning boards, red flags, red lights and providing necessary barriers /
barricading of the construction area and all other measures required from time to time,
nothing extra shall be paid to agency on this account. He shall be responsible for all
damages and accidents caused due to negligence on his part. No hindrance shall be caused
to traffic during the execution of the work by storing materials on the road.
25. The contractor shall be fully responsible for the safe custody of the material issued or
brought by him to site for doing the work.
26. If due to exigency of work, the work is required to be carried out in more than one shift or
during night then Contractor will be bound to execute the work accordingly and arrange the
T & P and labour etc. No extra claim on this account shall be entertained.
27. The rate for all items of work shall, unless otherwise clearly specified, include cost of all
labour, material and other inputs involved in the execution of the items.
28. In case of any discrepancy found in NIT / tender documents, the order of preference may be
read as the following.
a) Description of Schedule of quantities
b) Particular Specifications, Additional Conditions and Special Conditions, if any.
c) Architectural Drawings
d) CPWD Specifications with up to date correction slips.
e) Indian Standard Specifications / BIS
f) Sound engineering practice.
29. Any reference made to any Indian Standard Specifications in these documents, shall imply
to the latest version of that standard, including such revisions / amendments as issued by
the Bureau of Indian Standards up to last date of receipt of tenders. The contractor shall

keep at his own cost all such publications of relevant Indian Standards applicable to the
work at site.
30. The contractor will not have any claim in case of any delay by the Engineer-in-Charge in
removal of trees or shifting, removing of telegraph, telephone or electric lines (overhead or
underground), water and sewer lines and other structure etc., if any which may come in the
way of the work. However, suitable extension of time can be granted to cover such delay.
31. The contractor shall clean the site thoroughly of scaffolding materials, rubbish, equipments
left out of his work and dress the site around the building to the complete satisfaction of the
Engineer-in-charge before the work is treated as completed.
32. No residential accommodation shall be provided to any of the staff engaged by the
contractor. The contractor shall also not be allowed to erect any permanent / temporary set
up for his staff in the premises.
33. Contractor has to provide drinking water facility in each enquiry office by providing
necessary filter (RO) with water cooler for CPWD staff and his staff. Watch & Ward of
Enquiry office shall be the responsibility of the contractor.
34. The contractor shall comply with proper and legal orders and directions of the local or public
authority or Municipality and abide by their rules and regulations and pay all fees and
charges which he may be liable.
35. The Contractor shall give due notices to Municipality, Police and/ or other authorities that
may be required under the law/ rules under force and obtain all requisite licenses for
temporary obstructions/ enclosures and pay all charges which may be leviable on account of
his execution of the work under the agreement. Nothing extra shall be payable on this
account.
36. The work shall be carried out in a manner complying in all respects with the requirements of
relevant bye laws of the local bodies, labour laws, minimum wages act, workmen
compensation act and other statutory laws enacted by Central Govt. as well as State Govt.
37. The Contractor shall depute required Technical Staff each for civil and electrical works as per
Clause 32 of Schedule F who shall remain present at CPWD Service Center during the time
and days as provided in Schedule of Quantity. The agency shall submit the credential of
proposed staff & shall be taken on roll only after approval of Engineer-in-charge. The
attendance shall be accepted through Biometric Attendance System only.
38. The contractor shall provide necessary barriers, warning signals and other safety measures
while executing the work or wherever necessary so as to avoid accidents. He shall also
indemnify CPWD against claims for compensation arising out of negligence in this respect.
Contractor shall be liable, in accordance with the Indian law and Regulations for any
accidents occurring due to any cause. The contractor shall also provide all insurance
including third party insurance as may be necessary to cover the risk. No extra payment
would be made to the contractor due to the above provisions thereof.
39. Site is located in sensitive and high security & VVIP area, where movement and routes are
restricted. The Contractor shall have to apply for passes well in advance for carrying out the
work. No claim whatsoever shall be entertained for any loss on this account. Some
restrictions may be imposed by the Security staff/ Delhi police on the working and for
movement of labour, materials etc.
40. The movement of trucks and vehicles shall be regulated in accordance with rules and
regulations as approved by competent authority.
41. The Contractor shall be bound to follow all such restrictions / instructions and nothing extra
shall be payable on this account.
42. The Contractor shall not stack building material / malba on NDMC land or road or on the land
owned by any other authority and in case of failure to do so, he shall face penal action as
per the rules, regulation and bye-laws of the said body or authority. The Engineer-in-Charge
shall be at liberty to recover the amount due but not paid to the concerned authorities on
account of the above from any amount due to the Contractor including amount of the
security deposit or retention money in respect of this Contractor or any other Contract.
43. In order to adhere to the Committed Program and requirement of allottes, the work shall be
carried out in more than one shift and Contractor will deploy the resources accordingly. No
extra claim on this account shall be entertained. Contractor should give advance notice in
writing to Engineer-in-charge for doing any work in odd hours and arrange permission
accordingly. Contractor shall arrange for transportation of CPWD site staff to their
residences, in case the site staff is required to stay beyond office hours or during odd hours.
44. The contractor or his representative is bound to sign the site order book as and when
required by the Engineer-in-Charge and to comply with the remarks therein.

45. The contractor shall take all necessary precautions to prevent any nuisance or inconvenience
to the owners, tenants of adjacent properties and to the public in general and to prevent any
damage to such properties and any pollution of smoke, streams and waterways. He shall
make good at his cost and to the satisfaction of the Engineer-in-Charge, any damage to
roads, paths, cross drainage works or public or private property whatsoever caused by the
execution of the work or by traffic brought thereon by the contractor. Utmost care shall be
taken to keep the noise level to the barest minimum so that no disturbance as far as
possible is caused to the occupants / users of adjoining buildings.
46. The agency has to ensure the safety and protection of all the existing fittings, floorings,
fixtures and all other building parts during execution of work, nothing extra shall be paid to
agency on this account.
47. No special repairs and addition/ alteration work shall be carried out in any quarters/flats
without the approval of the representative of the Engineer-incharge. Any work carried out
without approval of the representative of the Engineer-in-charge at the site, the work shall be
rejected and shall not be measured and paid for.
48. Agency shall provide composite supervision which will monitor all civil and electrical
complaints and ensure that they are attended timely to the entire satisfaction of respective
Engineer-in-charge. Nothing extra on this account will be paid.
49. Pollution Control Guidelines
The guidelines regarding preventive measures for Air Pollution from demolition & construction
activities issued by Delhi Pollution Control Committee vide no. DPCC/EIA/Res-001 to 172/NGT-
21/2015/225-408 dated 17.04.2015 and any other guide lines issued till date or during the
execution of work, in compliance of Hon’ble National Green Tribunal directions, are applicable
to the contractor. All appropriate protective measures as per NGT & DPCC guidelines /
directions shall be taken by the contractor and nothing extra shall be payable on this account.
50. The contractor shall have to work in pandemic / epidemic conditions such as COVID 19 for
which he has to make safety arrangement / measures for the workers / staff and for the
premises meant for them, as per guidelines issued by Government and directions issued by
Engineer-in-charge from time to time and nothing extra shall be paid on this account.
51. The dismantled material received from the work shall be the property of contractor
for which the credit shall be paid on following rates –

GENERAL CONDITIONS

1 1% (One percent) Water charges shall be recovered from the gross amount of the work done,
if water is used from CPWD / client’s source.
2 Full quantity or quantity as decided by Engineer-in- Charge of the materials such as paint,
Acrylic emulsion paint, Acrylic distemper etc. shall be deposited in sealed containers in
advance before use. Packing size shall be decided by Engineer-in-charge.
3. The contractor shall have to get approved the brands / shades of Acrylic Distemper, Synthetic
Enamel Paint, Acrylic Emulsion Paint, Exterior Paint etc. from the Engineer-in-Charge and also
shall be got checked by the Engineer-in-charge or his authorized representative on receipt of
it at site before execution of same.
4. The materials required for day’s work shall be issued to contractor or his authorized
representative daily by the JE / AE -in-charge of the work. Any balance of the material left at
end of the days of work and the empty containers shall be returned to JE / AE. The day to day
issue account of the materials shall be maintained by the Junior Engineer-in-Charge and shall
be signed daily by the Contractor or his authorized agent in token of receipt of the materials
failing which no payment of bill shall be made to the Contractor. The empty containers shall
not be removed from the site of work without written orders of the Engineer-in-charge.
5. Before the commencement of work, the contractor shall prepare one sample as instructed by
the Engineer-in-charge. After the sample is approved by the Engineer-in-Charge, the
Contractor shall be allowed to commence the work and the quality of work shall confirm to the
approved sample.
6. In case the Bungalows / quarters are not made available to the Contractor according to the
programme, the Contractor shall not be entitled for any claim for idle labour or any other
claim on any account what-so-ever.
7. No payment will be made to the Contractor for damage caused by rains during the execution
of the works and no claim on this account will be entertained.
8. Scrapping shall be shown to the Assistant Engineer and got approved and test checked by him
prior to painting or other finishing work.
9. To avoid disputes later on, contractor is advised to get the measurement recorded within a
week’s time and shall submit his bills as per relevant clauses of contract. Any dispute
regarding measurement including work done shall be judged within a week’s time failing
which measurement, certified and recorded, shall be entertained.
10. All doors, windows, floors, furniture, electrical fittings and other articles shall be protected
from dust, splashes & damage Splashes & droppings from white washing, colour washing,
distempering painting etc. on walls, floors, doors and window, down take pipes / furniture
shall be removed by the Contractor at his own cost and the surface cleaned simultaneously
after the completion of the day’s work is done, without waiting for the actual completion of
the other items of work of the contract.
11. The Contractor shall comply with the provisions of ‘Construction and Demolition Waste
Management Rules, 2016’ as notified by the Ministry of Environment and Forest vide
notification dated 29.03.2016 (available at web address www.moef.gov.in).
12. During execution of work, water supply, installations / fittings & sanitary, installation / fittings,
will be dismantlled / demolished for which nothing extra shall be paid except the items already
exist in the schedule of quantities (civil) attached.
13. Any cement slurry added over base surface (or) for continuation of concreting for better bond
is deemed to have been included in the items and nothing extra shall be paid on this account.
14. If in the description / nomenclature of item the thickness of board / ply is
mentioned 18mm thick and manufacturer does not provide / manufacture 18mm
thick board / ply then 19mm thick board / ply can be used there, for that nothing
extra shall be paid on this account, vice versa.
15. Agency should take extra precaution for protection of existing wall, fittings, fixtures
etc. Nothing extra shall be paid on this account.

SPECIAL CONDITION

1. The work shall be executed as per schedule of quantity attached herewith.

2. The work is required to be executed in highly secured area. The agency is required to submit
Police Clearance Certificate (PCC) of all the labour to be employed within 10 Days of award of
work to Assistant Engineer in charge.

3. The contractor shall have to arrange security passes at his own for his men, for workers by
submitting all required details of workers viz Name, Father’s name, Residential address,
photo, ID proof etc. to the office of concerned Assistant Engineer for forwarding the same to
security office. Delay in getting passes from security office due to late submission of
application or non submission of all required documents will be sole responsibility of the
contractor. The agency should submit details of workers alongwith police verification of them.

4. Due to high security restricted area and VVIP’s movements, there will be various restrictions
in the working. The intending tenderers are required to see the site condition before quoting
their rates and it is presume that contractor has seen the site before quoting the rates. The
claim of contractor that they have not seen the site condition before quoting the rates shall
not be entertained and nothing extra shall be paid on account of any claim in this regard.

5. The agency is requested to acquaint himself about site conditions, labour restrictions, traffic,
restriction, working hours and occupied house/premises before quoting their rates. He should
take into consideration all such factors and contingencies, while quoting his rates. Nothing
extra shall be considered beyond the quoted and accepted rates.

6. The work is required to be executed in restricted site, odd hours and the agency shall plan
the work to be carried our accordingly.

7. There may be some restrictions on free movement of labourers at site and restriction of
working hours and agency shall consider this fact while quoting the rates and executing the
work.

8. The contractor through his Engineer shall ensure quality construction in a planned and time
bound manner. Any sub standard material/work beyond set out tolerance limits shall be
summarily rejected by the Engineer in charge.

9. The contractor or his authorized representative shall always be available at the site of work to
take instruction from department officers and ensure proper execution of work. Any
instruction by Engineer-in-charge during execution of work shall be strictly adhered to.

10. The agency shall maintain a proper dress code with deptt. Logo (front side) and agency name
(back side) of a single suit of orange colour along with designated yellow helmet for labour
(skilled & unskilled) & blue for electrician and green for safety environment in-charge along
with leather safety shoes and other relatively safety equipments etc. complete for each and
every workers during their work hours. The agency is liable to pay a penalty charge of
Rs.1000/- per day per person in case non-implementation of this dress code, failure of such
dress code more than a twice on basis of proper record entries i.e. Site order book /
Inspection register by any concerned official of CPWD then department have right to dismiss
foreclosure of this agreement before time. A selective list of dress code is also attached with
agmt. documents for ready reference. (Image enclosed).

11. The work shall be executed in most professional manner with least possible inconveniences to
the allottees /surroundings. The contractor shall take all necessary precautions to prevent

and waterways. He shall make good at his cost and to the satisfaction of the Engineer in
charge, any damage to roads paths, cross drainage works or public or private property
whatsoever caused by the execution of the work or by traffic brought thereon by the
contractor. Utmost care shall be taken to keep the noise level to the barest minimum so that
no disturbance as far as possible is caused to the occupants/users of same or adjoining
buildings.
12. The agency shall make arrangement for stay of labourers outside the work site at the own
cost. No labourer will be allowed to stay at work site.

13. The rates quoted by the agency shall include all levies, taxes, cess etc. Nothing extra will be
payable beyond the quoted & accepted rates.
14. The contractor shall be responsible to arrange at his own cost all necessary tools and plants
required for execution of this work, Tools, plants and machinery required shall be brought to
the site as and when required by the Engineer in charge & same shall not be removed
without the consent of the Engineer-in-charge.

15. Existing drains, pipes, cables, overheads, wires, sewer lines and water lines and similar
service encountered in the course of the execution of the work shall be protected against the
damage by the contractor at his expenses. The contractor shall not store materials or
otherwise occupy any part of the site in a manner likely to hinder the operation of such
services.
16. The recovery as per applicable Acts like Income Tax Act and Workers Welfare Cess Act etc.
shall be made from running bill/final bill of the contractor.
17. The cement to be used in the work shall be OPC / PPC 43 Grade cement of reputed
manufactures and as per approval of Engineer-in-charge.

18. The Architectural, Structural and other services drawings if any for the work shall at all time
properly correlated before executing any work and no claim whatsoever shall be entertained
in this respect.

19. The contractor shall provide details viz, name, father’s name, residential address and any
other details required i/c photo as may be required by the security agency for issue of photo
pass to the labour engaged on work at his own cost. However, the department will provide
assistance for obtaining entry passes as required.

20. The contractor shall issue identity card & badges to his workers and ensure that the workers
wear it all the time while working.

21. All the serviceable materials obtained from dismantling will be property of the departments
and will be deposited to enquiry office stores as directed by the Engineer in charge for which
no extra payment shall be made.

22. Nothing extra shall be paid to the contractor for excess consumption of material in case of
material arranged by him & recovery shall be made if it is issued by the department.

23. The item of water proofing treatment shall be got executed by the authorized applicator, the
firm shall be got approved by the Engineer-in-charge before the start of work and an
additional security in shape of Bank Guarantee/ Fixed Deposit equal to 10% of the
amount of Waterproofing works for its satisfactory performance shall be submitted by the
agency for a period of 10 years in the prescribed performa. The Bank Guarantee/ Fixed
Deposit shall be in favour of Executive Engineer, Central Secretariat Division, CPWD, New
Delhi.

24. The other items of specialized nature shall be got executed by the authorized firm, the firm
shall be got approved by the Engineer-in-charge before the start of work and an additional
security in shape of Bank Guarantee/ Fixed Deposit equal to 10% of the amount of
specialized works for its satisfactory performance shall be submitted by the agency for a
period of 02 years in the prescribed performa. The Bank Guarantee/ Fixed Deposit shall be in
favour of Executive Engineer, Central Secretariat, CPWD, New Delhi.

25. EPF and ESI contribution paid to the contract workers shall be reimbursed on actual basis. To
be eligible to claim the reimbursement of any of the payments made by the agency towards
the statutory provisions at end of contract, the contractor/agency shall have to produce the
duly attested photocopies of the passbook entries in respect of all the workers individually
which shall be treated as the only proof for such claims and all originals shall have to
produced if Engineer-in-Charge so desire.

26. Minimum Current Labour Wages as notified by the Govt. shall be paid to the workers engaged
on the work.

27. The payment to the workers by the contractor through Bank (RTGS / NEFT / By Cheque /
ECS or online transfer).

28. If, it is found that workers is absent, then the a recovery @ rate of 1.5 times the minimum
rate of wages per day specified by the Govt. on the date of absence for respective category of
workers shall be made from the contractor bill.

29. Material supplied by the contractor like paint / OBD etc. shall be of approved brand
manufacturer as per list enclosed in the NIT.

CONDITION RELATED TO PREVENTION OF POLLUTION AS PER PRINCIPAL BENCH OF NATIONAL GREEN TRIBUNAL
(MODIFIED)

1. The contractor shall not store/dump construction material or debris on metalled road.
2. The contractor shall get prior approval from Engineer-in-Charge for the area where the
construction material or debris can be stored beyond the metalled road. This area shall not
cause any obstruction to the free flow of traffic/inconvenience to the pedestrians. It should
be ensured by the contractor that no accidents occur on account of such permissible storage.
3. The contractor shall take appropriate measures for protection are to be taken by raising of
wind breakers of the appropriate height on all side of plot/ area using plastic and / or other
similar material, to ensure that no construction material dust fly outside the plot area.
4. The contractor shall ensure that all the trucks or vehicles of any kind which are used for
construction purposes/or are carrying construction material like cement, sand and other
allied material are fully covered. The contractor shall take every necessary precautions that
the vehicles are properly cleaned and dust free to ensure that enroute their destination, the
dust, sand or any other particles are not released in air/contaminate air.
5. The contractor shall provide mask to every worker working on the construction site and
involved in loading, unloading and carriage of construction material and construction debris
to prevent inhalation of dust particles.
6. The contractor shall provide all medical help, investigation and treatment to the workers
involved in the construction of building and carry of construction material and debris
relatable to dust emission.
7. The contractor shall ensure that C&D waste is transported to the C & D Waste site only and
due record shall be maintained by the contractor.
8. The contractor shall compulsory use of wet jet in grinding and stone cutting.
9. The contractor shall comply all the preventive and protective environmental steps as stated
in the MoEF guidelines, 2010.
10. The contractor shall carry out on-road-Inspection for black smoke generating machinery.
The contractor shall use cleaner fuel.
11. The contractor shall ensure that all DG sets comply emission norms notified by MoEF.
12. The contractor shall use vehicles having pollution under control certificate. The emissions
can be reduced by a large extent by reducing the speed of a vehicle to 20 kmph. Speed
bumps shall be used to ensure speed reduction. In cases where speed reduction cannot
effectively reduce fugitive dust, the contractor shall divert traffic to nearby paved areas.
13. The contractor shall ensure that the construction material is covered by tarpaulin. The
contractor shall take all other precaution to ensure that no dust particles are permitted to
pollute air quality as a result of such storage. All other precautions should be taken to
ensure that no dust particles are permitted to pollute the air quality.
14. The Agency would be personally responsible for effective compliance of these directions as
per court orders.
15. Material storages/ warehouses- Care should be taken to keep all material storages
adequately covered and contained so that they are not exposed to situations where winds on
site could lead to dust/particulate emissions. Fabrics and plastics for covering piles of soils
and debris is an effective means to reduce fugitive dust.”

By way of these orders/notice you are hereby notified for mandatory strictly adherence to
and compliance of the directions contained in the order of Hon’ble Tribunal as well as MoEF
guidelines, 2010 in relation to precautions required to be taken while carrying on construction
activities.

Guidelines for Multistage Centering – Reg.

Recently, some accidents have been reported in multistage centering / scaffolding work of
different structure, where proper design and drawing of centering / scaffolding work was not found.
Therefore, strong need is felt to issue some guidelines for proper handling the situation of multistage
centering in buildings or where height of casting of concrete is higher than normal height of 3.5 M or
where higher loading are coming during casting of concrete or large span structure and in situations of
casting of some special structures like domes, vaults etc.

In all situations, centering / scaffolding / staging for casting of these structures should be
properly designed by a qualified and experienced person / agency have post experience in design of
false work (centering) for concrete structures and should be proof checked by similar experienced
person / agency and it should be properly approved and issued to contractor by Engineer-in-charge.
The provisions of clause 7 of IS:14687 may be referred for design of false work (centering).

A method statement for erection and dismantling of the centering / scaffolding / staging and
process of concreting shall be prepared by contractor and submitted to Engineer-in-charge for
approval and the work shall be commenced only after approval of method statement by Engineer-in-
charge. The provisions of clause 9 of IS:14687 may be referred for erection of false work (centering),
safety precautions and other site operations, pertaining to false work (centering).

Experienced form watcher shall be engaged during erection, concreting and dismantling for
early detection of any movement or instability in the system. The field engineers shall ensure that
CPWD specifications and provisions of BIS codes are strictly followed.

A detailed programmed of field safety inspection of centering / scaffolding / form work of such
structures during different stages should be chalked out and strictly followed.

Provision of safety net, fall arresting system including other safety gears, for workers, working
over these structures shall be made in contract and should be followed strictly.

This issues with the approval of DG, CPWD.

Minimum Quality Assurance Plan

1. Maintenance of Register of Tests


(i) The details of all Tests carried out at construction/ maintenance site or at outside
Laboratories shall be maintained by the contractorin the Test Registerwhich shall be
issued to the Contractor by Engineer-in-charge in the same manner as being issued to
CPWD field staff.
(ii) All Samples of materials including Cement Concrete Cubes shall be taken jointly with
Contractor by JE /AE and out of this at least 50% samples shall be taken in presence of
AE in charge. If there is no JE, all Samples of materials including Cement Concrete Cubes
shall be taken by AE jointly with Contractor. All the necessary assistance shall be
provided by the Contractor. Cost of sample materials is to be borne by the Contractor
and he shall be responsible for safe custody of samples to be tested at site.
(iii) All the test in field lab setup at Site shall be carried out by the Engineering Staff deployed
by the Contractor which shall be 100% witnessed by JE and 50% of tests shall be
witnessed by AE-in-change. At least 10% of the tests are to be witnessed by the
Executive Engineer.
(iv) All the entries in the registers will be made by the designated Engineer Staff of the
Contractor and same should be regularly reviewed by JE/AE/EE. The registers shall be
produced before senior officers inspecting the work.
(v) Contractor shall be responsible for safe custody of all the test registers.
Submission of copy of all Test Registers, Material at Site (MAS) Register along with each
alternate Running Account Bill and Final Bill shall be mandatory. These registers should
be duly checked by AE in Division Office and receipts of registers should also be
acknowledged by Accounts Officer by signing the copies and register to confirm receipt in
Division office.

2. Maintenance of Material at Site (MAS) Register-

(i) All the MAS Registers including Cement and Steel Registers shall be maintained by
Contractor which shall be issued to the Contractor by Engineer-in-charge.
(ii) Each of the entry of receipt of material at site shall be 100% test checked by JE or by AE
if there is no JE.
(iii) Each of the entry shall be checked by JE at least twice a week and at least once a week
by AE. If there is no JE then MAS registers will be checked by AE at least twice a week.
(iv) Cement Register shall be reviewed by EE atleast once in a month.
(v) MAS register of the key materials including Cement, Steel Bitumen, Paint, Primer,
Distemper, Varnishes, Tile Adhesive, Admixture, Anti termite chemical Water proofing
compound material and other items as required by Engineer-in-Charge, and shall be
maintained as per proforma in Appendix-XX of GCC. All the entries in the MAS registers
are made by the designated staff of the contractor and same is reviewed weekly by the
authorized representative and fortnightly by the Engineer-in-Charge. However, contractor
is responsible for maintenance and safe custody of MAS registers.
(vi) The self-attested copies of tax paid bill of all the materials entered in the MAS register
shall be submitted by the contractor at the time of review by representative of Engineer-
in- Charge. In case of any doubt, genuineness of the tax paid bills; it can be verified by
the representative of the Engineer-in-Charge or the Engineer-in-Charge, however, onus
of genuineness of tax paid bills rest with the contractor.
3. Testing of Material at Site or in lab-
All expenditure to be incurred for testing of samples e.g. packaging, sealing, transportation,
loading, unloading etc. including testing charges shall be borne by the contractor.
