Note:

 Prices are Exclusive of GST AS APPLICABLE which is proposed @18% on Generating Sets. Any
statutory variation in duty & taxes at the time of actual despatch shall be to customer’s account.
Octroi / Entry tax if applicable shall be to customer’s account.
 Freight & Insurance Exclusive.
 If any items mentioned in the exclusions have been quoted, then the item is excluded from the
exclusions list.

COMMERCIAL TERMS & CONDITIONS

Prices : Prices are Ex-works Basis

GST : Prices are Exclusive of GST@18% & same shall be charged extra as
applicable.

Freight : Prices are Exclusive of freight charges

Terms of Payment : 30% advance along with order & balance against Proforma Invoice
before dispatch

Insurance : Prices are Exclusive of Insurance charges

Approvals : Approvals from concern authorities shall be to your account.

Installation : The installation done, If any, should be through Authorized and

Approved Vendor failing which there will not be any liability against
the company under any circumstances.

Delivery : Within 3 to 4 WEEKS from the date of receipt of your purchase

order along with advance and approved drawings (if applicable).
The delivery period is quoted in good faith and is subject to force
majeure conditions and unforeseen delay which is beyond our /our
manufacturers’ control.

Warrantee : The offered Engine & Alternator is warranted for a period of 2 years
(For DG Sets) from the date of dispatch OR 5000 Hrs. of operation from the date of
commissioning, whichever is earlier against any manufacturing
defect / defective materials only. However, electrical and other
proprietary items would be covered as per their respective
manufacturer’s standard warranty clause. The warranty will not
cover the normal wear and tear or damages caused by accident,
wrong handling and improper maintenance.
5 Critical Parts of Engine (Cylinder Head, Cylinder Block,
Camshaft, Crankshaft, Connecting rod) are warranted for 5
Years or 5000 Hrs. of operation whichever is earlier from the
date of dispatch against manufacturing defect subject to DG set
is maintained as per Cummins operations & maintenance
guidelines and only Cummins recommended Valvoline oil is
Warrantee used.
(For other
Equipments) The offered Equipments are warranted for 12 months from the date
of commissioning or 15 months from the date of supply, whichever
is earlier. The warranty is against manufacturing defects or
faulty workmanship

Validity Our offer shall remain valid for a period of 30 DAYS from the date of
our offer and subject to our confirmation thereafter.

Scope of Supply Our offer is confined to whatever is specifically included or

stipulated both in technical and commercial clauses and is subject to
change as may be agreed upon during subsequent discussions.

Exclusions from our - CIVIL WORKS - Any major or minor civil works, including
scope of Supply (For excavation for foundation, earth pits and exhaust pipes. We
DG Sets) will provide recommendations for the foundation.
 - CABLES & PIPINGS - Power & Control Cables, Cable
terminations are not included in our scope of supply. Water
piping and Fuel piping is also not included in our scope of
supply.

- STORAGE - DG Set shall be shipped with first fill of lub oil

and batteries in uncharged condition. Charging of batteries
shall be done by the customer.

- SAFETY EQUIPMENTS - All safety equipments like rubber

mats, safety boards, fire extinguishers, fire buckets with
stand etc.

- APPROVALS - SEB, CEIG (Including drawing approval and

testing of meters) PCB, explosive etc.

- ERRECTION OF THE GENSET - All necessary works related

with Erection of the Genset to your account.

- OTHERS - Any other works not specifically mentioned in our

quote.
Exclusions from our
scope of Supply (For - Unloading and shifting at site.
Other equipments)
- Erection and commissioning.
- Earthing and cabling.
- Government clearance / certificates.

Order Cancellation In case of cancellation of any order, all direct / indirect expenses
incurred by the company in organizing the ordered equipment shall
be recovered from the customer. These cancellation charges will be
as above or minimum 10% of the order value, whichever is higher.

Arbitration In the event of any disputes or differences arising between the

parties out of or relating to the validity, construction, meaning,
operation or effect of this offer, or any amendments or other
documents relating to this offer, or the breach of the terms of any
document agreed to between the parties, the same shall be referred
to Arbitration, as per the provisions of the Arbitration and
Conciliation Act 1996 and the arbitration proceedings shall be held
at Delhi / New Delhi.
