vessel or liability to any other vessel arising from such loading or
discharging operations including whilst approaching lying alongside and
leaving (with clause 1.1.2. covered)

It is hereby noted and agreed that the Insurer have the liberty to appoint
one of the following independent surveyors in respect of any claim on the
policy
- PT. Asuka Bahari Nusantara
- Matthew Daniels (Jakarta Representative Office)
- BMT Marine & Offshore Survey Ltd
- PT. Dharma Nilaitama
And other listed Surveyor in PT. Asuransi Tugu Pratama Indonesia, Tbk
 All Claims shall be adjusted by reputable adjuster that listed in PT. Asuransi
Tugu Pratama Indonesia, Tbk at the option of Insurer and the report
should be given to the relevant insurance brokers
 Full premium if Lost Clause, in respect of the vessel suffering the total loss
and constructive total loss
 Small General Average :
- General average expenditure (including sacrifice of interest other than the
vessel) up to USD. 100,000 to be paid in full without resource to other
contribution interest. Adjusters fee deemed not to be part of USD 100,000
referred to above
- General average to be adjusted in accordance with York Antwerp Rules
1974 or as amended 1990 or 1994 or any subsequent amendments/
revision thereto at assured’s option

 It is noted and agreed that any claim under this policy shall be settled at no
longer than 30 (thirty) days after the date of final adjustment report has
been agreed by both the Lead Underwriter and the Assured. This clause is
in place in compliance with Article 40 of Regulation of the Financial Services
Authority Number 69/POJK.05/2016
 Ranging damage sustained during cargo operations at each
loading/discharging points shall be deemed as damage caused by a single
accident or occurrence
 Bankers Clause in favour of PT. BANK MANDIRI (PERSERO), Tbk
 Warranted Vessel is Classed and Class Maintained
 Warranted availability of valid ship throughout during the whole period of
insurance

regulations of the Port Authority and/or Harbour Masters and/or the
Directorate General of Sea Communication must be complied with
throughout the currency of this Insurance

 It is warranted that the vessel must be in seaworthy condition throughout
during the whole period of insurance and that the Assured must ensure the
sufficiency of vessel's construction, equipment, outfit and crew for the
trade or service in which the vessel is employed. Any shortage of repair or
maintenance in the vessel by which the vessel or cargo may suffer or any
bad stowage or over loading of cargo, are breaches of the warranty of
seaworthiness
 Warranted that the Insured should be give prompt notice to the
Underwriter in the event of any occurrence which may give rise to a claim
under this insurance
 Warranted that the insured ship shall be towed under single tow operation
only
 Warranted that the tug tow the barge that such tug not covered by the
Insurer, such tug must be classed and class maintained and under
seaworthy condition
 Warranted for towing operation, the tug boat should not be under power
condition/the power of tug boat should be adequate

 Deferred Premium Clause 5 (Five) installments quarterly with 60 days grace
period of every installment

 Warranted crane’s boom to be lowered and securely fastened whilst in
operation

exceeded at all times

 Warranted the crane properly lashed during sea transit
 Warranted the crane to be maintained according to manufacturer’s
requirement
 Warranted crane to operate by a qualified and trained crane operator

be exceeded at all times
