stigmatic and the same was issued without holding any enquiry regarding the

alieged misconduct and as such bad in law. The applicant, therefore, prayed

that the order o I termination be set aside.

6. in this application, Shri A.V. Bandiwadekar. learned Advocate

for the appiicant strenuously argued before us that in the order of a

termination dared28.2.2006 the respondent has specifically mentioned that

the applicant was caught red-handed while accepting bribe ofRs.50l and for

tha_t the ACB l.ras filed the case against trim and in that he was arrested. It is

further mentioned that considering the said misconduct of the applicant the

temporary service of the applicant has been terminated- So, according to

leamed advocate the order in question is clearly punitive and stigmatic- He

further submitted that the order in question is patently itlegal and the same is a
issued in violation of the provisions of Article 311 (1) and (2) of the

Constitution of India inasmuch as the applicant was not given any

opportunitv to put forward his case nor any enquiry as per the disciplinary

of the termination order clearly shows that it is not the termination

simplicitor. The order clearly mentioned that the applicant was found

accepting bribe of Rs.50l and that is why he was arrested. So, the
termination order is certainly punitive and stigmatic. The Apex Court has

cieariy laid down that even a temporary employee cannot be terminated .

without holding an enquiry and by passing punitive and stigmatic order' So.

we are of the considered view that the applicant is certainly entitled to get

benefit ofthe above cited ruling and as such it has to be held that the order

of terrninaJicn passed against the applicant is bad in law. Even, Shri M.B

Kadam, learned Presenting Officer could not give any satisfactory reply to

the arguments advanced by the leamed advocate for the applicant and the

authority of the' Supreme Court cited by the leamed advocate for the

applicant. in this view of the matter, it is necessary to set aside the

impugned order.

8 The appiicatiol. is partly allowed. The order of termination of

the applicant dated 28.2.2006 is set aside. The Respondent to take steps
