Re: REPLY TO RESPONSE TO MOTION FOR RECONSIDERATION

Dear Dr. Laureta:

We acknowledge receipt of the HonorableBAC’s response to our Motion for Reconsideration to


the Notice of Post-Disqualification dated 07 April 2025 for the Procurement of Oxygen Refill
Tank (50 lbs) through Framewrok Agreement with IB No. PB-25-GOODS-02-003.

This is to inform you that Oro Oxygen Corporation (“OOC”) still expresses its continuing
objection to the Committee’s response.

In the Notice, it was stated that the reason for OOC’s disqualification was the non-compliance
with the requirement to submit a complete Statement of All Ongoing Contracts, as a mandatory
technical document required at bid opening.

As stated in our Motion for Reconsideration, OOC adheres to the principles of transparency,
competitiveness, simplicity and accountability, and further believes that these alleged
discrepancies in the disclosed projects maybe given leeway by the Honorable BAC to be
allowed to be supplemented by the bidder during the reglementary period of post-qualification.
Accordingly, OOC being the Lowest Calculated bidder, respecfully expresses its continuing
appeal to this Honorable BAC that it be allowed to supplement the said requirement and that it
be allowed to further submit its ongoing contracts during this period of post-qualification. In the
same vein, OOC respecfully prays that the provisions of the implementing rules and regulation
as in the case of Sec 23.1 (a) (iv) Revised IRR of RA 9184, to be construed liberally against of
the Lowest Calculated bidder without compromising the procuring entity’s interests. After all, the
best interest of the government and in all accord to the time honored legal principle that the
health of the populace should be the paramount consideration.

Most importantly, OOC has offered the lowest calculated bid with the bid amount of EIGHT
MILLION EIGHT HUNDRED FIFTY-TWO THOUSAND PESOS (Php 8, 352,000.00), against
the ABC of (PHP 31, 200,000.00), significantly lower than the bid submitted by our competitors.
The principle of procurement as mandated under RA 9184, emphasizes the importance of
ensuring the most economical and advantageous option for the government.

OOC’s bid not only met the technical and legal requirements but also provided Conrado F.
Estrella Regional Medical and Trauma Center with the best financial value. Disqualifying OOC
despite our demonstrated compliance undermines the fundamental purpose of public bidding
and risks depriving the government and the hospital of substantial cost savings that could
benefit the institution and its stakeholders. The total potential savings of TWENTY-TWO
MILLION EIGHT HUNDRED FORTY-EIGHT THOUSAND PESOS (PHP 22,848,000.00) is a
substantial amount that could be allocated to other lawful and impactful initiatives of the
government and the procuring entity.

Nonetheless, OOC will remain steadfast to its commitment to participate in future bidding
activities with the view of providing you the best quality option, with our taxpayers optimizing
their money’s worth.
