1. This batch of writ petitions pertains to direct recruitment on

the post of Informatics Assistant, 2023.

2. Under the advertisement dated 16.01.2023, 2730 posts were

advertised, which were increased vide amended advertisement

dated 27.06.2024 and total 3415 posts of Informatics Assistant

through advertisement dated 16.01.2023 and amended

advertisement dated 27.06.2024 were notified by the Rajasthan

Subordinate and Ministerial Service Selection Board (RSMSSB)

(hereinafter referred to as “the Board”).

3. The written examination was conducted by the Board on

21.01.2024. The written examination is of 100 marks comprising

one question paper containing 150 objective type questions.

4. Preliminary answer key was published by the Board on

02.02.2024, then Board invited objections from the candidates

during the period 05.02.2024 to 07.02.2024 vide Public Notice

dated 02.02.2024.

5. On behalf of respondent-Board, reply to the writ petition has

been filed in S.B. Civil Writ Petition No. 16144/2024 and with the

consent of counsel for respondents, same reply is treated as a

standard reply to all writ petitions.

As per reply to the writ petition, filed by the Board, as many

as against 89 questions, objections were submitted by the

candidates. Objections were sent to the Subject Experts, who

thoroughly examined the objections and considered with the help

of authorized and standard text books and other material available

on various websites. In furtherance to the report of Expert

Committee, out of 89 questions, answers of 80 questions, as

indicated in the preliminary answer key, were affirmed; answer of

two questions including (Question No. 125) were changed and

seven questions were deleted. Thereafter, final answer key was

published on 01.07.2024 and on the same day, final result was

also declared.

6. It is noteworthy that although initially in the writ petitions,

answers of various questions were disputed, however, during

course of arguments, counsel for petitioners have confined to the

answers of only five questions, referred hereinbelow bearing

Questions No.12, 50, 89, 125 & 127 and a joint prayer has been

made from the side of petitioners that a fresh Committee of

Subject Experts be constituted in order to revisit the correctness

of the answers of such five questions under consideration and as

per the report of Expert Committee, the final result of present

competitive examination be revised accordingly.

7. Since counsel for both parties admit that answers in respect

of only five questions bearing No. 12, 50, 89, 125 and 127 is

under challenge, hence, with the consent of counsel for both

parties, all the writ petitions have been heard together and would

stand decided by this common order.

8. Heard counsel for both parties and perused the pleadings so

also the other material placed on record.

9. It is noteworthy that out of five questions, answer of one

question No.125 in the final answer key has been changed

whereas the answers of question Nos. 12, 50, 89 and 127 are

same, as was indicated in the preliminary answer key. The

11. Counsel for petitioners have relied upon the relevant pages

from the book of Board of Secondary Education and NCERT, book

of Fundamentals of Computers written by E Balagurusamy

Member of UPSC, material from Google research, text book of

Class IX under subject Information and Communication

Technology as also few of the replies to the disputed questions

sent by IITs, NITs and other institutions, in order to suggest that

answers in respect of above five questions, which have been

finalized by the Board in the final answer key, are incorrect and do

not match with the standard text books and other material, hence,

such questions be referred to a fresh Committee of expert to re-

consider the final answer and as per the Report of Expert

Committee, the final result may be revisited/revised. The main

thrust of argument is in respect of change of answer of Question

No. 125 from (C) to (B) in the final answer key.

12. Reliance has been placed by counsel for petitioners to the

judgment of Hon’ble Supreme Court in case of Vanshika Yadav

Vs. Union of India [(2024) 10 SCC 641] decided on

23.07.2024 and the judgment passed by the Rajasthan High Court

at Jaipur in case of Ramdhan Kumawat Vs. The State of

Rajasthan S.B. Civil Writ Petition No. 10622/2014 decided

on 18.11.2014.

13. Learned Advocate General assisted by Advocate Mr. Yuvraj

Samant has vehemently repelled the submissions made by

counsel for petitioners and it has been argued that the answer of

Question No.125 has been changed, following the Report of

Subject Experts. The answers of remaining four questions as

indicated in the final answer key are also outcome of the Report of

Subject Experts. It has been pointed out that Subject Experts

have considered the authentic material and after analyzing the

objections thoroughly, have framed their opinion to sustain the

answers of questions No.12, 50, 89 and 127 while suggested

answer No. (B) as correct answer to the question No. 125. Further,

it has been argued that there is no allegation of arbitrariness,

biasness or malafides against the Subject Experts or against

Board, hence, the prayer to form a new Committee of Subject

Experts is hypothetical and without any basis as much as

unwarranted in the facts of the present cases.

14. In addition to above, it has been argued that the

respondents have completed the recruitment process including the

written examination and typing test in a transparent and fair

manner and due procedure was followed by inviting the objections

against the preliminary answer key. Thereafter, the objections

submitted by the candidates have been considered by the

Committee of Subject Experts and subsequently, only the final

answer key and the final result of the present recruitment have

been declared.

15. It has been argued that the scope of judicial review, in

matters relating to challenge to the answers of academic

questions asked in the public examination, is extremely limited

and very very narrow, which ordinarily may not be exercised by

the High Court while exercising jurisdiction under Article 226 of

the Constitution of India, unless and until a clear case of apparent

error on the face value of the final answer of a questionable

question is made out, that too without applying any inferential

process of reasoning or by applying the process of rationalization.

In support of submission, oft-quoted and landmark judgments of

the Hon’ble Supreme Court have been relied upon and referred:-

(i) Ran Vijay Singh and Ors. Vs. State of Uttar


Pradesh and Ors. [(2018) 2 SCC 357]
(ii) Vikesh Kumar Gupta and Ors. Vs. State of Rajasthan
and Ors. [(2021) 2 SCC 309]
(iii) Judgment dated 25.08.2023 delivered in Surjan Lal
Dhawan and Ors. Vs. The State of Rajasthan and
Ors. : S.B. Civil Writ Petition No.4777/2021, which
has been affirmed by the Division Bench in Sanjay
Kumar Bhaskar Vs. The State of Rajasthan : D.B.
Special Appeal Writ No. 636/2024 vie order dated
17.03.2025.

16. Heard. Considered.

17. Having considered the rival submissions and obtaining

guidance from the case laws referred by respective counsels, this

Court finds that it is not in dispute that after declaration of

preliminary answer key by the respondent-Board on 02.02.2024,

as per prescribed procedure, objections against the answers

suggested in the preliminary answer key to 150 questions, were

invited by the Board vide Press Note dated 02.02.2024. The

window period to submit objections by the candidates from

05.02.2024 to 07.02.2024 was provided. Thereafter, the

objections, which were received by the Board, were sent to the

Subject Experts for consideration and as per the report of the

Subject Experts, the answer of question No. 125 was changed

from (C) to (B) whereas the answers of other questions No.12, 50,

89 & 127 were kept unchanged in the final answer key dated

01.07.2024.

18. This Court finds that the counsel for petitioners have referred

and relied upon few of the text books and replies by institutions,

referred in Para No.8, before this Court to depict that the correct

answer of question No. 125 is (C), which has wrongly been

changed to (B) due to which the merits of petitioners in this

competitive examination, have adversely suffered. In respect of

answers to other questions as a whole, counsel for petitioners

have also relied upon few text books of another authors and

material, but from the side of petitioners, no allegations of any

arbitrariness, biasness or malafides have been levelled against the

Board or against the Subject Experts to whom Board sent the

objections to give final opinion. It is evident that the final answer

key published by the Board on 01.07.2024 was finalized as per the

report of opinion of the Subject Experts. A copy of report by the

Subject Experts has been shown by the Advocate General to the

Court during course of arguments, which goes to show that

Subject Experts relied upon the authentic material. The relevant

Before finalizing the answers of five questions under

consideration in this batch of writ petitions, the Subject Experts

have applied their mind and have taken into consideration the

authentic material and text books, to change the answer of

question No. 125 and to keep the answers of other questions No.

12, 50, 89 and 127 unchanged, from the answers suggested in the

preliminary answer key.

19. In the opinion of this Court, no clear cut case to show the

answers of five questions referred hereinabove as apparently

wrong, has been made out by the petitioners. This Court is not an

Expert nor can act like an Expert to substitute the opinion of the

Subject Experts and there is a jurisdictional constrain under Article

226 of the Constitution of India, to examine the correctness of the

answers by analyzing the material, relied upon by the counsel for

petitioners in respect of five questions, which are under

consideration in this batch of writ petitions. The material which

has been taken into consideration by the Subject Experts, to

finalize the answers of five questions under consideration, has not

been stated to be unauthentic or unreliable. No prima facie case,

to constitute a fresh Committee of Experts to revisit answers of

five questions, is make out by petitioners.

20. It is neither the case of petitioners that the written

examination was not conducted in fair and transparent manner

nor it is the case that the process of recruitment suffers from any

leaks of paper or other kinds of infirmities. The basis of filing

these writ petitions is only that petitioners are not happy and do

not have consensus with the final answers, indicated in the final

answer key in respect of five questions under consideration.

Merely, for the reason that few of the aspirants do not have

consensus with the final answer key in respect of few questions,

the opinion and report of Subject Experts extended on the basis of

thorough research and subjective material concerned, may not be

assumed to be incorrect or doubtful. The scope of judicial review,

in this respect cannot be allowed to be expanded, merely on the

prayer of few of the aspirants because they rely on some other

material, more so, when stack of thousands of aspirants is

involved in respect of a public employment competitive

examination and the material taken into consideration by the

Subject Experts, is not proved to be unauthentic/unreliable.

21. The grey area of interference, to re-evaluate or scrutinize the

answer sheet of the public examination, as has been culled out by

the Supreme Court in case of Kanpur University Vs. Samit

Gupta [(1983) 4 SCC 309], which has been followed in case of

West Bengal Central School Service Commission and Ors.

Vs. Abdul Halim [(2019) 18 SCC 39] and by the Coordinate

Bench of this Court in case of Surjan Lal Dhawan (supra) as

also by the Division Bench, is not available before this Court as it

is difficult to discern and hold that the final answers of five

questions, as finalized by the Subject Experts and shown in the

final answer key dated 01.07.2024, are apparently incorrect/

wrong nor the correctness/ incorrectness of answers of such

questions can be finalized on their face value, as per the material

placed on record by the petitioners. The applicability of the

principle of applying the process of reasoning is also

impermissible. For ready reference, the relevant portion of Para

No. 16 of the judgment reads as under:-

“16……..the key answer should be assumed


to be correct unless it is proved to be wrong and
that it should not be held to be wrong by an
inferential process of reasoning or by a process
of rationalization. It must be clearly
demonstrated to be wrong, that is to say, it must
be such as no reasonable body of men well-
versed in the particular subject would regard as
correct. In other words, the onus is on the
candidate to clearly demonstrate that the key
answer is incorrect and that too without any
inferential process or reasoning. The burden on
the candidate is therefore, rather heavy and the
constitutional courts must be extremely cautious
in entertaining a plea challenging the correctness
of key answer………………...”

22. In the celebrated judgment of the Apex Court in case of Ran

Vijay Singh And Ors. Vs. State of Uttar Pradesh and Ors.

[(2018) 2 SCC 357], a two Judge Bench of the Supreme Court

referred to large number of earlier decisions and culled out the

broad principles applicable in such situations, following

observations may be noted:-


30. The law on the subject is therefore, quite
clear and we only propose to highlight a few
significant conclusions. They are:
30.1. If a statute, Rule or Regulation governing
an examination permits the re-evaluation of an
answer sheet or scrutiny of an answer sheet as a
matter of right, then the authority conducting the
examination may permit it;
30.2. If a statute, Rule or Regulation governing
an examination does not permit re-evaluation or
scrutiny of an answer sheet (as distinct from
prohibiting it) then the Court may permit re-
evaluation or scrutiny only if it is demonstrated
very clearly, without any “inferential process of
reasoning or by a process of rationalisation” and
only in rare or exceptional cases that a material
error has been committed;
30.3. The Court should not at all re-evaluate or
scrutinize the answer sheets of a candidate – it
has no expertise in the matter and academic
matters are best left to academics;
30.4. The Court should presume the correctness
of the key answers and proceed on that
assumption; and

30.5. In the event of a doubt, the benefit should


go to the examination authority rather than to
the candidate.
31. On our part we may add that sympathy or
compassion does not play any role in the matter
of directing or not directing re-evaluation of an
answer sheet. If an error is committed by the
examination authority, the complete body of
candidates suffers. The entire examination
process does not deserve to be derailed only
because some candidates are disappointed or
dissatisfied or perceive some injustice having
been caused to them by an erroneous question
or an erroneous answer. All candidates suffer
equally, though some might suffer more but that
cannot be helped since mathematical precision is
not always possible. This Court has shown one
way out of an impasse – exclude the suspect or
offending question.
32. It is rather unfortunate that despite several
decisions of this Court, some of which have been
discussed above, there is interference by the
Courts in the result of examinations. This places
the examination authorities in an unenviable
position where they are under scrutiny and not
the candidates. Additionally, a massive and
sometimes prolonged examination exercise
concludes with an air of uncertainty. While there
is no doubt that candidates put in a tremendous
effort in preparing for an examination, it must
not be forgotten that even the examination
authorities put in equally great efforts to
successfully conduct an examination. The
enormity of the task might reveal some lapse at
a later stage, but the Court must consider the
internal checks and balances put in place by the
examination authorities before interfering with
the efforts put in by the candidates who have
successfully participated in the examination and
the examination authorities. The present appeals
are a classic example of the consequence of such
interference where there is no finality to the
result of the examinations even after a lapse of
eight years. Apart from the examination
authorities even the candidates are left
wondering about the certainty or otherwise of the
result of the examination – whether they have
passed or not; whether their result will be
approved or disapproved by the Court; whether
they will get admission in a college or University
or not; and whether they will get recruited or
not. This unsatisfactory situation does not work
to anybody’s advantage and such a state of

uncertainty results in confusion being worse


confounded. The overall and larger impact of all
this is that public interest suffers.

23. In the case of Vikesh Kumar Gupta and Ors. Vs. State Of

Rajasthan and Ors., [(2021) 2 SCC 309], the Supreme Court

after referring to decision in case of Ran Vijay Singh (supra)

had observed as under:-


“16. In view of the above law laid down by this Court,
it was not open to the Division Bench to have
examined the correctness of the questions and the
answer key to come to a conclusion different from
that of the Expert Committee in its judgment
dated12.03.2019. Reliance was placed by the
Appellants on Richal & Ors. v. Rajasthan Public
Service Commission. In the said judgment, this Court
interfered with the selection process only after
obtaining the opinion of an expert committee but did
not enter into the correctness of the questions and
answers by itself. Therefore, the said judgment is not
relevant for adjudication of the dispute in this case.

17. A perusal of the above judgments would make it


clear that courts should be very slow in interfering
with expert opinion in academic matters. In any
event, assessment of the questions by the courts
itself to arrive at correct answers is not permissible.
The delay in finalization of appointments to public
posts is mainly caused due to pendency of cases
challenging selections pending in courts for a long
period of time. The cascading effect of delay in
appointments is the continuance of those appointed
on temporary basis and their claims for
regularization. The other consequence resulting from
delayed appointments to public posts is the serious
damage caused to administration due to lack of
sufficient personnel.”

24. In the opinion of this Court, it is no more res integra that the

scope of interference by the High Court in exercise of powers of

judicial review, relating to the dispute pertaining to correctness of

answers of questions of a public examination, is extremely narrow,

if not completely shut out. The object behind that is to render

finality to the process of public employment and even an element

of tolerance of minor error or calibrations is acceptable.

25. The same principle of law has been expounded by the

Coordinate Bench of this Court in exercise of Surjan Lal Dhawan

(supra), which has been affirmed by the Division Bench.

26. As far as case of Ram Dhan Kumawat (supra) relied upon

by the counsel for petitioners is concerned, the Court after

evaluation of the facts of that case, arrived at a conclusion that

the model answer key, prepared by the Expert Committee, is not

in consonance with the standard text books and material,

published by the Education Board. In the present case, this Court

does not find so. Thus, the ratio decidendi as expounded by the

Coordinate Bench of this Court in exercise of Ram Dhan

Kumawat (supra) does not render any support to the case of

petitioners in this batch of writ petitions.

27. As far as the case of Vanshika Yadav (supra) is

concerned, in facts of that case, a leak of NEET UGC – 2024 paper

was an undisputed fact, further the investigation report by CBI

indicated that several students got benefit by playing fraud,

hence, the sanctity of examination itself was found to be vitiated.

In that backdrop of factual matrix, which are not present in this

batch of writ petitions, the Hon’ble Supreme Court constituted an

Expert Committee. Due to distinguishable facts, the ratio

decidendi expounded by the Supreme Court in case of Vanshika

Yadav (supra) also does not render any help/support to the case

of petitioner.

28. The upshot of discussion is that the prayer made in the writ

petitions and the prayer made by counsel for petitioners are

devoid of any substance, hence, not liable to be accepted. All writ

petitions are hereby dismissed.

29. Interim stay order(s), staying the appointment of the

selected candidates, is hereby vacated.

30. Stay applications and other pending application(s), if any,

stand disposed of.
