URGENT SECOND MOTION FOR EXTENSION OF TIME


TO FILE PETITION FOR REVIEW ON CERTIORARI

1. On September 14, 2015, the Honorable Regional Trial Court Branch 79 of


Quezon City, rendered a Decision against Petitioner-Accused herein in
Criminal Case No. Q-10-165971, finding him guilty of violation of Section
11, Article 2, Republic Act 9165 sentencing him for lifetime imprisonment.

2. Petitioner-Accused filed an Appeal before the Honorable Court of Appeals


questioning the decision of the Honorable Regional Trial Court.

3. The Honorable Court of Appeals rendered a Decision affirming the Decision


of the Honorable Regional Trial Court.

4. Petitioner-Accused timely filed a Motion for Reconsideration which was


denied by the Honorable Court of Appeals in its Resolution.

5. The said Resolution was received by the Petitioner-Accused through his


former counsel on June 1, 2017.

6. Pursuant to Rule 45 of the Rules of Court, the Petitioner-Accused has fifteen


(15) days or until June 16, 2017 from receipt of resolution within which to
file a Petition for Review on Certiorari before the Honorable Supreme Court.

7. Petitioner-Accused formally engaged the services of the undersigned


counsel/s on June 13, 2017.

8. Petitioner-Accused moved for thirty (30) days extension or until July 16,
2017 within which to file a petition for review on certiorari so that he can
intelligently prepare and complete his petition within the extended period
sought.

9. However, there is still a need to collate all pertinent documents to be


attached in the Petition, thus, while the Petition has been drafted, it cannot
be finalized.
10.Petitioner is humbly asking for the indulgence of this Honorable Court that
he be granted an additional ten (10) days or until July 27, 2017, within
which to file the Petition.

11.The Motion is being filed not to delay the early resolution of the instant case
but for sole reason above stated.

WHEREFORE, it is most respectfully prayed of this Honorable Court that


Petitioner-Accused be given an extension of ten (10) days from June 17, 2017 to
July 27, 2017, to file petition for review on certiorari.

Other reliefs that are just and equitable are likewise prayed for.
