OFFER OF EMPLOYMENT
Ozland Mining Services (Ozland) is pleased to offer you the position of HD Fitter based at Crown Prince.
This offer is made subject to the satisfactory completion of medical, drug & alcohol tests, police and site clearances.
Your appointment to the above position will be on a full-time basis and this contract will take effect from the first day
that you are mobilised to site. Your roster will be two weeks on, one week off, flying in and out of Perth, as such your
point of hire is Perth. A typical shift worked will be made up of 12 hours and shall generally be made up of an equal
amount of day/night shifts worked. Rosters and flight arrangements may be varied with prior consultation.
Your salary package and the full terms and conditions of your employment are set out in this document titled “Offer of
Employment – Floyd Mwelwa Kazenene”.
This employment offer is subject to the terms and conditions outlined in the Mining Industry Award 2020 and the
attached Offer of Employment terms and conditions. You acknowledge and agree that you have been engaged in the
job classification of Mining industry maintenance trades employees, Level 3 – competent.
You will be required to carry out all duties required to fulfil the requirements of your position, including those that are
incidental or peripheral to your main tasks or functions provided that they are within your skill, competence and
training. Your duties are outlined in the Job Description.
You should read all of the enclosed documents carefully before accepting this offer of employment. Please understand
that acceptance of this offer means you will be bound by all our policies and procedures, current, future and any
amendments thereof.

1. GENERAL PROVISIONS
This contract sets out all of the terms of your employment with Ozland and supersedes all prior
representations and agreements, whether oral or in writing, concerning your employment with
Ozland.
If there are any other matters that you have relied on in your discussions or other communications
to date or there are any other matters you wish to discuss, please let Ozland know before you sign a
copy of this contract. Once you sign this letter you are confirming the contract is complete and no
agreed terms are missing from the letter.
If you agree, this letter sets out the complete contract between you and Ozland, please signify your
acceptance of these terms and conditions by signing to acknowledge that you accept Ozland’s offer
of employment on the terms and conditions set out in this contract.
Please keep a copy for your records.
2. REMUNERATION
Total Built Up Rate (Per Hour) $60 + Superannuation
Breakdown of your rate includes
Base Hourly Rate $50
Site allowance $10
Superannuation 11.5%
Unless more generous provisions are provided in this letter or in the attached Schedule, the terms
and conditions of your employment will be those set out in the Mining Industry Award 2020 and
applicable legislation. This includes, but is not limited to, the National Employment Standards in the
Fair Work Act 2009. Neither the Mining Industry Award 2020 nor any applicable legislation are
incorporated into your contract of employment.
Your remuneration is based on a base flat hourly rate, the rate will be paid for all hours worked up
to a maximum of 12 hours per shift unless otherwise agreed.
Your wages will be paid fortnightly into your nominated bank account.
3. OZLAND SPECIAL ALLOWANCES
3.1 Retention Allowance
In times of high demand for labour, Ozland proposes to pay an additional incentive payment
based on skills, work ethic and knowledge base. The allowance will only be paid on hours
worked on the project. If in the opinion of Ozland, the demand decreases, or you have
substantial breaches in either skills or work ethics the allowance will be removed in
consultation with yourself under the Ozland Disciplinary process. For further information on
allowances refer to the Employee Handbook.

4. PROBATION
The first six months will be classified as the employee’s probationary period. Ozland will endeavour
to continually communicate with the employee regarding development and performance and
encourage any feedback at all times. A formal review will be held at the end of the six months to
decide whether to offer the employee permanent employment.
During this probationary employment, 1 week’s formal Notice (or payment in lieu of that notice) is
required to terminate the employment by either party.
5. HOURS OF WORK / ROSTER
Your roster will conform to each projects fatigue management policy.
From the commencement of your employment, your wage will be based on a nominal 38-hour week.
While you will follow a set roster, you will be required to work the hours specified by the site, which
will be communicated to you before mobilisation.
In relation to shift commencement and shift finishing times you will:
• Be at the designated shift starting point ready to commence work at the designated shift
commencement time. Note: Travel to and from accommodation and the work site is not
considered time worked.
• Remain on the job until the designated shift finishing time.
• Your work pattern may be varied to meet operational requirements. Any such change will
involve prior consultation with you. You agree that any such change is reasonable taking into
account your role, industry practice and the needs of the business, subject to any terms and
conditions in the Agreement.
You may be required to perform additional hours outside of rostered hours to meet operational

You will only be entitled to receive additional payment for overtime where such overtime has
received prior authorisation from the Employer. Your timesheet will be submitted daily by your
Manager and you will be required to sign-on to each shift following a Fitness for Work assessment.
6. LEAVE
Leave is governed by applicable legislation. Below is a summary of what you are entitled to at your
date of commencement. This may be amended from time to time in accordance with changes in
legislation.
6.1 Personal Leave
You will be entitled to 76 hours personal leave annually as per the National Employment
Standards. There is no pro-rata entitlement for personal leave on termination. A medical
certificate should accompany concurrent personal leave equal to 2 or more days.
6.2 Annual Leave
You are entitled to 152 hours of annual leave at your set wages rate as per the National
Employment Standards. You will be expected to take your leave at times that are convenient

to the company and yourself, bearing in mind particularly the absences of other employees
in the area or site where you are employed or located. If you are classified as a shift worker
who works day shift and night shift on rotation you are entitled to an extra 38 hours of leave.
Your annual leave accrues on a weekly basis and your annual leave is accrued on time
worked.
Annual leave does not accrue in the following instances:
• during unpaid annual leave
• during unpaid sick/carer's leave
• during unpaid parental leave
• during leave without pay
6.3 Shut Down
Where Ozland shuts down all or any part of the business you may be required to take
accrued annual leave. If you do not have any annual leave accrued, you will be required to
take leave without pay.
6.4 Long Service Leave
Your entitlement to Long Service Leave will be governed by relevant legislation.
6.5 Public Holidays
Due to the rostering nature of your role, you acknowledge and agree that you may be
required to work public holidays, and that this is reasonable.
You will be paid a public holiday rate for working on a public holiday.
7. SUPERANNUATION
Ozland will contribute the equivalent of 11.5% of your salary into a complying superannuation fund
of your choice. This will be adjusted in accordance with the Superannuation guarantee levy
legislation. You may also contribute additional funds on a voluntary basis should you desire to do so.
If you do not make a choice of your own fund, Ozland will make contributions for you into the
company’s default fund. Be advised that in most instances this will mean that you have automatic
insurance cover and the cost of this cover will be deducted from your superannuation contributions.
If you do not wish to retain this insurance cover then it is your responsibility to cancel or amend this
cover.
8. EXPENSES
Ozland will reimburse the employee for out of pocket expenses that have had prior approval by the
Operations Manager and/or General Manager. The reimbursement of expenses is subject to receipt
of a valid tax invoice. Copies of tax invoices will not be accepted.
9. AUTHORITIES
Your authority levels including all documents, reports and correspondence you prepare and send on
behalf of Ozland will be agreed with you by your Manager/Supervisor.

10. COMPLIANCE
You will be required to conform with Ozland's policies, expectations and standards as to the manner
of carrying out work, courtesy to clients, courtesy to staff, managers and directors, standards of dress
and presentation, the use of office systems and office procedures.
11. PERFORMANCE REVIEW
Your position and salary will be reviewed annually as per Ozland’s performance review process.
These reviews will reflect your advancement, your ability and your contribution to the business of
Ozland. Salaries are not automatically increased every year. Increases are dependent on economic
factors, industry or markets Ozland operate in and overall company financial performance.
12. TERMINATION OF EMPLOYMENT/ NOTICE PERIOD
Ozland adhere to Industry and regulatory requirements.
13. USE OF COMPANY RESOURCES
While you are in the employ of Ozland, you will not be permitted to use the Company's resources
other than in the employment of the Company and all such work undertaken by you must be
undertaken with the permission of the Company.
14. NON-COMPETITION
You shall not, during your employment, be concerned or interested except as required by your
position, nor be personally employed or engaged in any capacity whatever in or in connection with
any business whatever other than the business of Ozland, except with the permission of the
Company. This clause is to ensure that there is no conflict of interest.
All Ozland employees must adhere to the Company’s Conflict of Interest requirements.
15. CONFIDENTIALITY
During the course of your employment you may become privy to confidential information of Ozland,
its related companies and of third parties with whom it does business. This confidential information
may include, but will not be limited to, information concerning business and financial affairs, mining
operations, mining practices, mining contracts, contract rates, new technology and inventions, prices
and marketing details.
By accepting this offer you agree to keep all such confidential information private, never to disclose
to third parties unless instructed to do so and not to divulge such confidential information to fellow
employees unless authorised to do so. You also agree to take care to safeguard such confidential
information at all times when in work situations, such as social occasions.
You acknowledge that deliberate or grossly negligent disclosure of confidential information
belonging to Ozland, its related companies and others, without proper authorisation, is grounds for
suspension or dismissal from employment from the company. Furthermore, you acknowledge that
you are still bound to maintain the confidentiality of Ozland information, even if you cease
employment with Ozland, otherwise legal action can and will be taken against you.

16. CODE OF CONDUCT
Ozland is committed to providing a safe, supportive and productive work environment. This is only
possible when everyone cooperates and agrees to suitable standards of conduct. When you wear an
Ozland shirt you are representing the company, regardless of where you are. Therefore, you should
always be dressed appropriately when representing the company. Your conduct under this clause
includes when you are waiting for a flight in an airport, on a plane to and from site or any time you
are in a company vehicle.
17. PAPERWORK AND TIMESHEETS
Ozland is dependent on certain information such as timesheets and drill plods in order to effectively
run its operations. It is therefore imperative that this information is completed accurately and on
time and this is an important part of all employees’ duties. Employees who consistently fail in their
obligations in this area may be subject to counselling and the disciplinary procedure. Any falsifying
timesheets for financial gain will be considered gross misconduct and those employees will have
their employment terminated.
18. TRANSFER/ SECONDMENT/ ALTERNATE DUTIES
Due to operational requirements it may be necessary to transfer/ second you to other projects/
locations or to perform alternate duties. Transfer/ secondment and alternate duties will be discussed
prior and it is a condition of employment that you comply with such requests for transfer/
secondment and alternate duties including changes to rosters and working hours.
19. TRAINING
Ozland will provide training in accordance to industry and regulatory requirements, and pay for all
reasonable training costs. Refer to “Training” in the Employee Handbook for further information.
20. HEALTH AND SAFETY
You are required to abide by Ozland’s health and safety guidelines and other regulations or
requirements of sites where you are required to work on behalf of the Company.
All employees are required to strictly comply with safety requirements including all relevant
legislation, codes of practice, site, and Company safety policies and procedures (as amended from
time to time) including, without limitation, the requirement to wear safety equipment whilst in areas
requiring such equipment.
Any work area that you may be based will be subject to stringent safety rules and procedures and
you will be required to work and act in a manner that does not constitute a hazard to yourself or any
other person. Further information on safety will be provided during your induction and throughout
the course of your employment. To eliminate unsafe work practices, all unsafe acts or hazardous
conditions, accidents, injuries, or near misses must be reported to your supervisor and Safety
Adviser. Any non-reporting of accidents, injuries (including injuries that are not sustained at work),
near misses, or other disregard for safety rules or directions given by your supervisor or Company
management will be considered a serious breach of conduct and will most likely result in the
termination of your employment.

21. DEDUCTIONS
During the course of your employment and on the termination of your employment with Ozland for
any reason, you authorise and permit Ozland to deduct from your remuneration, the value of any
debts (including but not limited to leave taken in advance and unreturned goods) you have incurred
to Ozland. Any flight that is missed without an adequate explanation will be charged to you if back
charged to Ozland by the client.
22. LICENCES, CERTIFICATES AND QUALIFICATIONS
Where your position requires you to hold relevant licences, certificates, and qualifications to enable
you to carry out your duties, they must be kept current (renewals and costs associated, are the
responsibility of the employee) and copies must be provided to Ozland as requested. It is a condition
of your employment that all the necessary licences, certificates and qualifications required by you to
carry out your duties are current and suspension of licences or qualifications necessary to carry out
your duties may result in termination of employment. Copies of all licences, certificates and
qualifications obtained from training provided by the company must be submitted to Ozland or you
will be charged for the cost of these courses. By signing this agreement, you are giving permission
for the company to deduct your wages for the cost of these courses should you fail to submit a copy.
23. DRUG AND ALCOHOL TESTING
Your acceptance of employment with Ozland shall be deemed to confirm your consent and
commitment to Ozland’s Alcohol & Other Drugs Procedure, which includes workplace drug and
alcohol testing. The elements and frequency of the testing will be explained in more detail on your
commencement at site.
If as part of regular workplace drug and alcohol testing you produce a positive result for illicit drugs,
this will result in the termination of your employment. If you either refuse to participate in a drug or
alcohol test or are discovered tampering with, substituting or interfering with in any way a test
sample you will be in breach of this contract. This will be classified as gross misconduct and will result
in termination of your employment.
24. STAND DOWN
If you cannot undertake any useful work because of industrial action, machinery breakdown or
failure, inclement weather, pandemic lockdown or any other cause for which Ozland cannot be held
responsible, then Ozland may stand you down without pay.
25. SUSPENSION
If for whatever reason you are involved in an investigation or review of an incident, breach or
grievance, Ozland may at its full discretion suspend your employment pending the outcome of the
investigation or review.
26. NON-DISPARAGEMENT
You agree not to disparage or otherwise bring Ozland or any of its related corporate bodies, or any
employee or officer of Ozland into disrepute as a result of your employment with Ozland.

27. SOCIAL MEDIA
Ozland acknowledges that the use of social media has become part of society. By accepting this offer
you acknowledge that you are bound by the Social Media Procedure. Ozland urges caution when
referring to Ozland, its operations, staff, clients and suppliers in any form of social media. This can
include posting photographs of people, plant and equipment or anything else relating to Ozland, its
operations, employee’s, clients and suppliers. This can also include commenting on previously
posted photographs and comments in general about Ozland, its operations, employee’s or clients
and suppliers.
The consequences of any of the above negative or derogatory actions or any other action that can
be construed as bringing Ozland, its operations, employee’s, clients and suppliers into disrepute, will
result in disciplinary action up to and including termination of employment.
28. ADVICE
You acknowledge that you have obtained independent legal and financial advice or have had the
opportunity to obtain such advice before signing this offer.
29. ACCEPTANCE
By signing the below, you confirm that you have read and understood the Offer of Employment
Terms and Conditions, and associated Employee Handbooks.
