Lundy: ‘This letter serves as notice that your employment with the City of East Cleveland as Acting Chief of Police is terminated effective immediately. ‘You were appointed toa classified police position in June 2016 and subsequently promoted to sergeant, lieutenant, and captain, and on January 2, 2024 you were appointed Acting Chief of Police —all without completion of the required competitive civil service examinations and from an eligibility list. Under East Cleveland Codified Ordinances 123.06(b) and 129.11, an employee appointed to an ‘acting position may serve in any such appointment no more than 180 days ina calendar year. You were appointed Acting Chief of Police on January 2, 2024 pursuant to Ord, No, 123.06(6). “Positions inthe classified civil service may be temporarily filled without competition when, in the Judgment ofthe Mayor, there are urgent reasons for filling a vacancy in any promotional position inthe ‘classified civil service, but in no case shall such temporary appointment continue longer than 180 consecutive days in a calendar year” ‘The appointinent automatically expired on July 1,2024. Your continuous service as acing chief of police beyond 180 days, without a valid civil service appointment, violates municipal ordinances and state laws and voids your acting chiefs appointment. The same with your appointment to captain, ‘You may claim union protection through Fraternal Order of Police Lodge 39. However, Ohio Revised Code Chapter 4117.01(N) defines bargaining member police as those who have taken a civil setviee test and were appointed through an eligibility list.
