Article 309 of the Constitution of India
provides rules for recruitment and
conditions of service of persons appointed
to Govt.Service. Parliament/Legislative
enacted law for recruitment and conditions
of service under this article.
Article 311(1)
This article assures security to Govt. Servants against
arbitrary dismissal or removal from service. He shall not be
removed or dismissed by an authority subordinate to that which
appointed him.
Article 311(2)
No Govt.Servant shall be dismissed or removed or reduced
in rank except after an enquiry, informed of the charges,
reasonable opportunity given.
Hear both sides
Aware of charges and allegations – relevant
evidence - cross examination of witnesses – produce
defence witness – all evidence to be recorded in his
presence – giving opportunity to explain.
No one can be a judge in his own cause
Judge personal interest in the case
Exception to 311 (2) when a person is convicted by a
court for a criminal charges.
Impracticability
Conducting enquiry not practical when a person is
absconded, not able to communicate.
Reasons for Security
In the interest of security of state with the satisfaction of
President/ Governor
1. This rule come to effect w.e.f. 01.01.1955
2. This rule apply to all members of State and Subordinate Services, holders of all posts
whether temporary or permanent except members by contract/agreement.
8. Penalties
Penalties imposed on Govt.servant for Good and sufficient reason.
(i) Censure
(ii) Fine (in case of persons for whom such penalty is permissible under these
rules)
(iii) with holding of increment or promotion
(iv) Reduction to lower rank in the seniority list or to a lower post or to a lower
time scale.
(v) Recovery from pay on the whole or part of any pecuniary loss to the Gov. by
negligence or breach or orders.
(vi) Compulsory retirement
(vii) Removal from civil service of the state Govt.
(viii) Dismissal from civil service of state Govt.
(ix) Suspension
Minor penalties – items (i) to (iii), (v) and (ix)
Major penalties – items (iv) and (vi) to (viii)
10. The penalty of fine shall be imposed only on a person who is the member of
Tamilnadu Basic service.
17(a) Proposed to impose minor penalties item (i), (ii), (iii), (v) and (ix) in rule 8,
giving chance of representation , taking representation into consideration before
imposing penalty.
Sub rule not apply – conviction by a court – individual absconding – impracticable
to communicate.
Representation for, with held increment affect amount of pension, with hold
increment without cumulative effect exceeding 3 years, with hold increment with
cumulative effect for any period, the procedure in sub rule (b) ie 17(b) shall be
followed before penalty.
Disciplinary authority inform by a memorandum with statement of imputations
of misconduct or misbehavior giving chance of making representation within
prescribed period. Representation should be considered before concluding.
As a result of examination of the case Authority is satisfied allegations not
proved, may exoncrete individual. If proved impose minor penalties in rule
8.
17(b) Form of charge communicated with statement of allegation, on which each
charge is based, and of any other circumstances. Request defence statement,
in writing within reasonable time and to state oral inquiry/ heard in person /
both oral inquiry may be conducted even if waived by charged person, to
prove evidence of witness. Oral inquiry – witness cross examination by
person charged examination of witnesses – examination of person charged
person charged can call his side (Defence) witness. Authority may refuse
defence witness in writing for special and sufficient reason.
If desired person charged heard in person before passing final orders.
Report of inquiry/ personal hearing, contain record of evidence, statement
of findings and grounds thereof.
Succeeding authority may act on the evidence recorded by predecessor.
Succeeding authority may recall examine, cross examine and re examine
witnesses.
For sexual harassment complaint under rule 20B TNGS Conduct rules,
complaint committee in each office is authority and in accordance with
procedure in these rules.
Assistance of any retired Govt.servant for person charged.
Furnishing copy of report of inqury/ personal hearing / both, call upon any
representation within fifteen days. This representation considered before imposing
penalty.
17(c) Based on the fact lead to conviction of criminal court (sentenced or not) procedure
in 17(b) not necessary. Opportunity for representation and considered.
Procedure in 17(b) not apply conviction of court / absconded / impracticable
communicate
17(d) In exceptional cases, for special and sufficient reasons in writing, provision in
subrule (a) and (b) waived without injustic to person where difficulty in observing
the requirements of rule.
If question arises for practicability of the procedure in sub rule (b), the
decision of competent authority is final.
17(e) (1) May be placed under suspension where
(i) disciplinary proceedings against him is contemplated or pending
(ii) Criminal offence case is under investigation inquiry, or trial
(2) Detained in custody on criminal / otherwise longer than 48 hours may
be suspended.
(3) When penalty imposed upon Govt.servant under suspension is set aside
in appeal or review and case is for further inquiry, the order of suspension
continued in force from the original order date of penalty until further
orders.
4. When penalty set aside by court competent authority decides to hold further
enquiry the order of suspension continues until further order.
Further enquiry can be order only when court passed orders purely
technical grounds without going into the merits of the case.
5. Where suspension is necessary under clause (1), competent authority for
reasons in writing continue suspension till termination of all proceedings.
6. Order of suspension may be revoked at any time by the authority made the
suspension.
f) Does not/ submit defence statement before due date/ appear in person for
inquiry / fails/ refuses to comply with this rule, authority may hold ex-parte
inquiry.
g) Discipline authority is of the opinion, there are grounds for inquiring into the truth of
misconduct/ mishaviour, itself inquire or appoint an authority to inquire into the truth.
Disciplinary authority is inquiring authority when it itself hold inquiry.
19. Appeal
a) Entitled to appeal for any penalties in rule 8.
20. A petition for review within a period two months from the date of the order on the
grounds
a) order was not passed by competent authority
b) reasonable opportunity of defending not given
c) Punishment is excessive or unjust
d) discovery of new matter or evidence

1. They apply to all persons appointed to Civil Services
and posts in connection with affairs of the State of
Tamilnadu, whether on duty, leave or on foreign
service.
Exempted are members of All India Service,
subordinate Police Officers, not full time officers,
persons paid from contingencies.

Rs.57700- Rs.182400
Group C Government servants in posts having pay levels from to
12 drawing the pay of Rs.15,900– Rs.50400 to
Rs.35600- Rs.112800
Group D Government servants in posts having pay level 1
drawing the pay of Rs.15700 – Rs.50000

who is directly subordinate to the Government.

2(6) Close Relations.
Father, Stepfather, mother, stepmother, wife,

wife/husband father, wife/husband mother, brother’s
wife, sister’s husband, daughter’s husband and son’s
wife.
3. Gifts
Gifts not exceeding Rs.25000/- by self, wife/husband,
family members.
6 months gross emoluments or 10 lakhs whichever is less-
value of gift with permission of Govt.
Wedding anniversaries, funerals, religions function – 6
months gross emoluments or 10 lakhs which ever is less –
report within on month.
Travel, living, other related expenses from personal friends/
close relations as gift during foreign trip of B, C, D (with
permission by Govt) is allowed.
Free transport, boarding, lodging or other service, other
pecuniary advantages from other person having no official
dealing is gift.
Casual meal, lift or other social hospitality – Not a gift.
Avoid lavish hospitality, frequent hospitality from person
official dealing.
Any clarification for Gift, referred to Govt, Govt decision
final
Second hand goods (Vehicle, Furniture, electrical domestic
appliances) favourable price from firm/person is termed as
gift, form of corruption, Gift from Foreign firm, any firm
contract with Govt is corruption not allowed.
Purchase second hand article at normal/market rate is
allowed.
3A. Dowry
Giving, taking, demand, directly or indirectly prohibited – Dowry
Prohibition Act 1961.
Govt Servant marriage or Children marriage declaration to HOD
4. Public Demonstration in honor of Govt.Servants
Attend any meeting or entertainment held in his honor/honor of
any other Govt.Servant with the permission of Govt.
Farewell/Retirement/ transfer simple inexpensive entertainment
is allowed.
5. Subscriptions
Raising any fund, accepting, asking subscriptions / contributions, collections in cash
or kind needs Govt.permission.
Exemption: Service associations – Flag day collections
6. Investments, lending borrowing
shall not speculate in any stock, share or other investments
Habitual purchase, sale of shares, securities or other investments are taken as
speculation
Investments which embrass or influence Govt.servant in the discharge of his
duties should not be allowed.
No Govt.servant / Family members / duly authorised to conduct following
banking business.
Lend / borrow money
Lend money with interest / return in money or kind charged.
May accept/give, relative/personal friend temporary loan credit account with
trademan for purchase of things advance of pay to his private employee (His home
servants) not exceeding one month total emoluments free of interest
Exceeding one month total emoluments lending/borrowing to or from any private
individual permission needed ( family members)
May borrow money from a Co-operative society of which he is the member
following the personal surety procedure in the society.
Govt servant of Joint Hindu family, ancestral money lending profession exempted
from prohibition but not active part in business not employed in that business carried
on district.
As per rule 7 sub rule (5), Govt. officials of B,C,D
group with the permission of competent authority and
A group officer with permission of Govt can get
temporary loan without interest from relative and
personal friend an amount not exceeding Rs.5lakhs
for flats, ready build house and house plot.
7. Movable, Immovable and Valuable Property
1. a. Govt.servant to give notice to prescribed authority for acquire/dispose of
immovable property by lease, mortage, purchase, sale, gift, exchange in his
name or in family members name
Previous sanction needed if transaction with person having official dealing
with Govt.servant
Exemption: Acquisition of house site assigned by the Govt.
Acquisition/ Disposal of immovable property by family members resources.
b. (i) For construction or extension acquisition of house by loan, GPF,
previous sanction in prescribed form.
(ii) After completion report in prescribed form
c. Member of Hindu undivided family share for repair of undivided property
exceeds 1 lakh fact to be reported.
1A. Govt land not to be encroached by Govt.servant.
2. Purchase/Sale of movable property exceeding one month total emoluments
report within one month.
Permission needed if the transaction is with official dealing person.
Movable property – Jewellery, Insurance policies, Motor cars, Motor
cycles, Refrigerators, Colour Television, other costly domestic appliances,
Computer, Laptop.
2A. Within 6 month sanction/permission to be given failing which deemed
accorded sanction.
3. Return of asserts and liabilities (Property Statement) as on Dec. before 31st
March in prescribed form.
As on entry into service, return of assets and liabilities within three
month of appointment.
Then every five years.
Value of movable property worth less than Rs.50,000/- may be added and
totaled up as one.
Daily use articles such as clothes, utensils, crockery, books need not be
included.
Movable, Immovable property of family members acquired by their
resources need not be included.
4. At any time, by order competent authorities may call Govt.servant to
submit complete statement of properties.
6. By inheritance possession of immovable property in the district where
employed, report the fact.
8. If transferred to the district where he possessed movable property, fact
to be reported.
10. Mislead, failure to give full and correct information leads to severe
disciplinary action.
12. The restrictions apply in the acquisition and possession of property in
the name of other person (Binami)
13. Govt.land, sold or leased, permanently or temporary to Govt.servant by orders
of Board of Revenue.
14. (a) Acquisition of land other than house site or ready built house in revenue
district where he is serving is not allowed.
(b) Permitted to acquire immovable property outside, serving revenue
district on transfer to revenue district where he owned immovable property,
fact to be reported.
On transfer from one revenue district to another revenue district,
acquiring land other than house site or ready built house in revenue district
from which transferred, is not allowed for two years from the date of
transfer.
(e) Exemption for acquisition of land including house site through TN Housing
Board or similar Co-op Housing unit society.
(f) Clause (b) shall not apply if the property concerned is house constructed or
inherited by Govt.servant
8. Private trade or employment
1(a) Except with sanction of Govt. engage himself, directly or indirectly.
No Govt.servant shall undertake any part-time employment.
With sanction Govt. deliver lectures Govt-Quasi-Govt, Govt-aided
academic or Technical institutions, Universities for a period not exceeding
one year at a time.
(b) If any family members, engaged in trade or business and owns
insurance /commission agency, the fact to be reported. If this trade
embrass Govt or Govt servant, Govt.servant shall not permit the
family member to continue the business.
Canvassing by Govt.servant breach of the rule.
4(a) With permission of Govt publish any book or engage himself
habitually in literary or artistic work of any kind.
5. Without permission of Govt, touring officers engage peon to drive
his car, private engagement between them, interfere in official duty
of peon.
6. Engaging Govt.servant or member of LGS by an officer for
private matters involving receipt/ expenditure of money
involved is strictly prohibited. But during travelling on
duty it is allowed with constant vigilance.
8. Shall not accept paid employment in any company, mutual
benefit society, co-operative society or act as an agent
whether paid by salary or commission.
13. Shall not engage himself in the activities of “tout”
9. Insolvency and habitual indebtedness
avoid habitual indebtedness or insolvency.
If a sum he cannot repay within two years or part of his salary is
attached for debt for two years or attached a sum he cannot repay
within two years he may be declared.
If he proves this situation arises due to unexpected under normal
condition, out of control situation and not unwanted expenditure, he
doesn’t comes under preview of this rule.
If he becomes the subject of a legal proceedings for insolvency,
full fact to be reported.
10. Communication of official information.
In performance of his duties in good faith,
communicate information to a person in accordance with
RTI 2005.
No Govt.servant communicate, directly or indirectly,
any official document either in hard copy or in electronic
format to any Govt.servant or any person to whom he is
not authorized to communicate.
11. Communication with press, Television or Radio
1. Owning or conducting or editing or managing newspaper/ periodical publication needs sanctions of
Government.
2. Only with sanction of Govt, writing article, writing letter in his name, or unanimously or in the name
of other person to any newspaper/ magazine is allowed.
3. Participation in television, radio programme banned.
4. Full text and material to be sent to Govt for approval for participation in TV/Radio programme.
6. Head of Dept in the permission authority.
Exemptions:
No such sanction required if writing to newspaper and TV/Radio programme is of purely literary,
artistic, or scientific character or Govt.servant has responsibility at the policy making level.
12. Criticism of Government
No Govt servant shall in radio broadcast or document published
anonymously or in his own or in others name or in communication to press
or in public utterance make statement of fact or opinion,
which has the effect of an adverse criticism of any current or recent
policy or action of Central/State Govt.
Which is capable of embarassing the relations between State Govt and
any other Govt.
This rule won’t apply for views expressed by a Govt.Servant in his
official capacity and office bearer of recognized association for safeguarding
the conditions of service of Govt.servant.
Shall not take part in any Non-official meeting where
likely criticism of Govt.
District board, Municipal councils, similar bodies
created by law, Govt, recoginsed associations and its
branches are not non-official meeting.
Any doubt regarding application of this rule, a copy of
draft of the document sent to Govt and act according to
the orders passed by Govt.
13. Evidence before committee or any other authority
With permission of Govt can give evidence any enquiry
conducted by any person/committee/ authority.
No Govt.servant giving evidence shall criticize policy,
action of Central/State Govt.
Nothing in this rule apply to evidence given in judicial
enquiry, departmental inquiry, at an enquiry before an
authority appointed by Govt/ State Legislative.
14. Taking part in polities and Elections and position of Govt.servants in
relation to elections.
Should maintain political neutrality – avoiding suspicion favouring any
political party or any candidate. Not a member, associated with any political
party / organisation has political aspect, subscribe in aid of, assist in any
other manner.
Duty of Govt.servant to prevent political activities of family members
leading to toppling of Govt unable to prevent report the fact.
Decision of Govt is final for question arises for the scope of this rule
regarding political party / organisation / movement / activity.
Canvassing / using his influence / take part in election prohibited.
But he can vote in election maintaining the secrecy of voting.
He can assist conduct of election as a performance of duty.
Wife/ family members living with / dependent can contest
election/ canvass for other candidates
Display of any political symbol on the vehicle, residence of
Govt.servant is not allowed.
6. Proposing, seconding the nomination acting as an agent are
breach of this rule.
5. Seditious propaganda or the expressing of disloyal sentiments by
a Govt.servant shall be regarded as sufficient ground for
dispensing with his services.
14A. Prohibition of membership of any communal organisation etc.
a) Membership of organisation promote religion, race, place of birth, residence,
language, caste or community, feelings of hatred between different religious
race , language or regional groups or castes or communities.
b) Whose activities are prejudicial to maintenance of harmony between
different religions, racial, language, castes, communities and disturbs the
public tranqulity.
c) Which organises exercise/ movement/ drill participants trained to use,
criminal force / violence against any religious, racial, language, religions
group caste, community creating insecurity among them.
Govt decision final regarding any organisation.
15. Vindication of Acts and character of Govt.servants.
Without permission of Govt sought help of press for
vindication of official act which has been subject matter of
adverse criticism or an attack of defamatory character.
Vindicating his private character or any act done in private
capacity is allowed.
With sanction of Govt. accept compensation from anybody for
any defamatory attack or character other than competent court.
16. Membership of service association.
Shall be member/ representative/ officer of any association of Govt.servants
satisfying following conditions.
Open to all Govt.servants of that class – confined to a distinct class.
Not connected with political party and political activity.
Issue of periodical publication with general or special orders of Govt.
Publish representation to press with approval of Govt.
Shall not pay or contributing or by any means or assist in registration or
selection of condition for any election to a legislative body anywhere in
India.
17. Employment under or with near relatives in service and employment
of near relatives in firms enjoying Government patronage.
1. a) Member of state service when employed in a District / Division where near
relationship of himself or his wife residing in that district should report to immediate
superior in the public interest.
b) Member of State services informs immediate superior if a member of state or
subordinate service closely related is posted to work under him.
(ii) Member of state or subordinate service inform immediate superior if he is
posted under a member of All India service/ State service who is closely related to
him.
2. Only with previous sanction of Govt. accepting employment of family members in a
firm having official dealing with Govt.
3. Dealing with matter or give or sanction any contract to any undertaking where close
relation, family member is employed, refer to official superior and act accordingly.
18. Canvassing of non-official or other outside influence.
Shall not bring or attempt to bring political or outside influence to superior
authority to further his interests in his service.
Raising the personal grievance of a Govt.servant in parliament / State legislative
is breach of this rule.
MLA/MP make representation to Ministers, Head of Depts on behalf of
Govt.servant applicable of this rule. Govt servant responsible for bringing political /
outside influence to superior authority unless he proves to the contary.
19. Bigamous marriages
Enter into or contract a marriage with a person having spouse living.
Govt.servant having spouse living enter into or contract, marriage
with a person.
a) Such marriage is permissible under the personal law applicable to
Govt.servant and other party to the marriage.
b) There are other grounds for so doing .
2. No Govt.servant involve in any act involving moral turpitude on his
part including any unlawful act which cause embarrassment/
discredit to Govt.
20. Integrity and Devotion to duty
1. Maintain integrity and devoting to duty by all Govt.servants.
2. Take possible steps to ensure integrity and devotion to duty by all
Govt.servants under his control.
3 (i) In performing his official duty, act in his best judgement except
when he is acting under direction of his superior official.
(ii) Direction of superior officer in writing. Oral instruction
avoided, unavoidable condition official superior confirm in writing
immediately.
(iii) Govt.servant received oral instruction seek confirmation in
writing as early as possible. Duty of the official superior to
confirm in writing
(iv) Evade the responsibility seek instruction / approval of superior
official is not necessary in distribution of powers and
responsibilities scheme.
Habitually fails to complete the work within the stipulated
time and with the expected quality, standard deemed to be
lacking in devotion to duty.
20A. Prohibition of Child Labour
Employment of Child below age of fourteen years to do any work
including domestic work.
20B. Prohibition of sexual Harassment of working women.
1. No Govt.servant shall indulge in sexual harassment of the woman
at the work place.
2. Incharge of work place appropriate steps to prevent sexual
harassment.
Sexual harassment include such unwelcome sexually determined
behaviour whether directly or by implication as.
a. Physical contact and advances or
b. Demand or request for sexual favours or
c. Sexually coloured remarks or
d. Showing any pornography or
e. Any other unwelcome physical, verbal or non-verbal conduct of sexual nature.
21. Government servant not to be found drunk while attending office etc.
a. Shall abide by any law in force relating to consumption of liquor or
intoxicating drugs.
b. Shall not found drunk or under influence of liquor while in office or in
public place.
22. Strikes
No Govt.servants shall engage in strike or in incitements or in similar
activities.
Similar activities include absence from work or neglect of duties without
permission compelling superior officers/ Govt for their demands, or
demonstrative fast called hunger strike for similar purposes.
22A. Procession and Meetings
Govt.servant shall not conduct procession and meeting in open ground
adjoining office/ inside office premises, during office hours on working day,
outside office hours, on holidays without prior permission of concerned
authorities.
23. Anti-secular or Social Harmony activity and demonstration
No Govt.servant shall participate in any activity, anti-
secular, disharmony in society security of the state, friendly,
relations with foreign state, public order, decency, morality
defamation, incitement to an offence, contempt of court.
24. Joining of association by Govt.servants
Join or continue as member of association whose activities
are prejudicial to the interests of sovereignty and integrity of
India or public order or morality.
24A. Obtaining of Identity certificate before applying for passport and No
objection certificate for undertaking foreign trip
After giving prior information or after obtaining identity certificate and
No objection Certificate from the Govt.apply for grant or renewal of
passport. After obtaining No objection certificate from the Govt undertake
trip to foreign country.
While applying for No objection certificate information regarding the
purpose of visit, duration of stay, and the names of countries proposed to be
visited shall be furnished.
He shall not leave India for seeking employment abroad without the
permission of Govt.
For B,C,D Govt.servants, Heads of Dept are Competent to issue No
objection Certificate who apply to undertake trip to foreign countries
as tourists or on pilgrimage or to see friends or relatives or to seek
employment.
Proceeding on Haji Pilgrimage to Saudi Arabia. Through
Tamilnadu Haji Committee and on Jerusalem pilgrimage through
Govt.schemes are exempted from No Objection certificate.
25. Interpretation
Govt.decision is final for any query arises relating to the
interpretation of these rules.
Supplementary Rules:
1. Consulting a medical practioner for the purpose of obtaining leave.
Disclose to the doctor, the fact of consulted any other doctor for
the same purpose and result of such consultation. Omission to do this
or false statement to Doctor entail serious Dept.action.
2. Recommendation
Except by endorsement on application of a candidate officially, shall
not recommend to any selecting, appointing, promoting authority for
any post in the service of Govt.
3. Purchase of Resignation
Pecuniary arrangements for resignation by one for the
benefit for others is prohibited.
Any nomination or appointment as a result of this
resignation cancelled and such parties are in service shall be
suspended pending orders of Govt.
5. Refusal to receive pay
Concerted or organized refusal to receive pay entail serious
disciplinary action.

Deposit of full market value of T&P or full original cost of T&P whichever
is higher collected from private institutions, contractor doing private works –
Machinery handled by dept.crew – making good the loss if any.
Deposit not necessary for Public institution like schools etc.
Agreement drawn between officer incharge of T&P and
person hiring T&P
In addition to rent, packing, handling conveyance, incidental
charges for despatch (to and fro) freight charges, erection and
dismantling, cost of replacing missing or broken parts necessitated
by damage.
Hire charges to PWDivisions, Govt.Depts, Local bodies,
Contractor doing Govt.works should cover interest, depreciation,
repair on return from overhauling and crew charges shall be fixed.
Hire charges for private parties, contractor doing Non-Govt.works –
Double the rent worked out above.

Jeep, Van – Intended for inspection purpose journey only. Private
purpose prohibited. Even long journey office work or conference to
Division- Circle by rail or bus.
Surplus store – serviceable stores, unserviceable stores –
survey report of unserviceable stores – sanction of survey report –
Public auction with the sanction of competent authority. Effective
destruction of articles for special reasons.
Serviceable articles – Transferred to work or division or into
stock account.
Serviceable surplus T&P intimated to other divisions every
half yearly.
Duty of EE/SE to see that surplus articles are used to the best
advantage as early as possible.
If surplus articles are not put into use within one year from
the date they were entered in surplus list, then EE take action
for public auction.

insured as condition of transport by Railway.
