AN ORDINANCE PENALIZING ALL PRIVATE AND PUBLIC VEHICLES WITHIN


ANGELES CITY FOR USING MODIFIED MUFFLERS WHICH CREATES
IRRITATING , EXCESSIVE SOUND WHICH RESULTS TO NOISE POLLUTION.

Whereas, the noise level in our city is rapidly increasing due to heavier traffic and more
powerful engines;
Whereas, there are growing numbers of vehicles which produce or emit louder and
irritating noise due to the fact that their owners install or modify mufflers which can be heard
from a kilometer away;
Whereas, the noise produced by these vehicles not only lowers the quality of life and
work of the majority of people but also can result in permanent hearing loss for vehicle operators
and people nearby and this includes unborn children, since noise penetrates the womb;
Whereas, at high level, this noise can result even in tissue damage to body parts and
organs, leading to serious health problems;
Whereas, vehicles with modified mufflers highly distracting traffic and can cause
accidents since they make sounds and agitate drivers because loud sounds can affect hearing,
vision, reaction time and judgment of drivers and nearby people thereby increasing dangers
significantly for everyone involved;
Whereas, it is indispensable to regulate the modification of mufflers to lessen noise
emitted from vehicles exhaust system in order to prevent excessive or unusual noise and
annoying smoke.

Now therefore, be it ordained, as it is hereby ordained, by the Sangguniang Panlungsod,


of Angeles, in session assembled, that:

Section 1. Short Title. This ordinance shall be known as the “Anti-Muffler


Modification Ordinance.”

Section 2. Declaration of Policy. It is the policy of this city to see to it that all existing
laws, rules, regulations, decrees, ordinances and resolutions promulgated by authorities be
observed and respected.

Section 3. Muffler Conditions. Every motor vehicle shall, at all times, be equipped
with a muffler in good working conditions in its constant operation to prevent excessive or
unusual noise and annoying smoke. The engine and power mechanism of every motor vehicle
must be so equipped and adjusted accordingly so as to prevent the escape of excessive fumes or
smoke.

Section 4. Prohibitions. A person may not operate a motor vehicle with an exhaust
system that emits a noise in excess of 95 decibels, or modify the exhaust system of a motor
vehicle in a manner that will amplify or increase the noise emitted by the engine of the motor
vehicle in excess of the noise emitted by the muffler installed on the motor vehicle in the
manufacturer’s original design.

Section. 5. Implementing Authorities. The following agencies shall implement and enforce
this ordinance:

a. Angeles City Traffic Management and Enforcement Unit (ACTMEU);


b. Public Transportation Regulatory Office (PTRO);
c. Angeles City Traffic Enforcement Traffic Management Office (ACTETMO);
d. City Environment and Natural Resources Office (CENRO)

Section 6. Fines and Penalties. The following penalties shall be imposed for violation of
this ordinance.

a. 1st Offense – Php500.00


b. 2nd Offense – Php 1,000.00
c. 3rd Offense – Php5,000.00 wherein the motor vehicle shall be impounded for (3) days
at the Angeles City Police Office – Traffic Management and Enforcement Unit.

a. The operation of public motor vehicles such as tricycles, jeeps or other mode of
public transportation within the city shall be automatically suspended, pending the
restoration of its original and or compliant muffler or exhaust system.

Section 7. Separability Clause. If for any reason or reasons, any part or provision of
this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which
are not affected thereby, shall continue to be in full force and effect.

Section 8. Repealing Clause. All ordinances, rules and regulations, or parts thereof,
whose provisions are in conflict with or contrary to the provisions of this ordinance, are hereby
repealed, amended and modified accordingly particularly Section 12u of Ordinance No. 307,
Series of 2012 (Traffic Code).

Section 9. Effectivity Clause. This ordinance shall take effect immediately upon
publication in a newspaper of general circulation in the City of Angeles.
