AFFIDAVIT OF PETITIONER

I, A.Manikandan, S/o. Arunachalam, Indian aged 49 years,


residing at No.7/16, Melapillaiyar Koil Street, Keela Ambur,
Tenkasi District, temporarily come down to Madurai do hereby
solemnly affirm and sincerely state as follows:

1. I am the petitioner herein and as such I am well acquainted
with the facts and circumstances of the case, competent to
swear this affidavit. I declare that no other writ petition is
pending before this Hon'ble Court or any other court for the
same cause of action seeking for same relief.

2. I humbly submit that I am filing this writ petition praying


for issuance of a Writ or order or direction and in more
particular in the nature of WRIT OF MANDAMUS to direct the
respondents 1 and 2 to conduct an proper enquiry and take
necessary and appropriate action on the 3rd respondent, based
on my Complaint dated 31.12.2024 in accordance with law and
for other reliefs.

3. I humbly submit that for my daughter carrier opportunities


I have approached Respondent No.3 for the job and he is well
known to me and he offered about the Job as Office Assistant in
Education Department. For the same he have demanded Rs.5
Lakhs from myself. On 29.08.2024 I have given Rs.1 Lakh of
cash in the presence of my wife and my friend Bhagawathi
Kumar which have been received by respondent No.3 at my
home and he further assured that within 3 months he will
arrange for the Job and asked me to pay remaining amount of
Rs.4 Lakh.

4. I further submit that as per the verbal confirmation


provided by the Respondent No.3 the event does not took place.
On 20.11.2024 I have requested respondent No.3 to return the

amount of Rs.1 Lakh (Rupees One Lakh) which has been
borrowed from me for arranging the job. Due to this he got angry
and used filthy language and threatened me for demanding the
money.

5. I further submit that regarding the issue I gave a complaint


to the 2nd respondent by explaining the brief facts dated
03.12.2024 and complaint has been sent through Registered
Post to Respondent No.1 also. On the receipt of the same a CSR
No.1016/2024 has been registered by Respondent No.2. Till now
the FIR has not been registered against the Respondent No.3.
Hence me and my family members are under severe mental
agony and also still paying interest for the borrowed amount
given to the 3rd respondent.

6. I further submit that I have lost all my hopes that I would


get justice at the hands of the respondents and as a last resort I
am compelled and constrained to knock the doors of this
Hon'ble Court.

7. I further submit that under these circumstances, I have no


other option except to approach this Hon'ble Court for speedy,
effective and efficacious alternative remedy, I am compelled and
constrained to file this writ petition invoking the Special original
jurisdiction of this Hon'ble Court under Article 226 of
Constitution of India.

It is therefore humbly prayed that this Hon'ble Court may
be pleased to issue a Writ or order or direction and in more
particular in the nature of WRIT OF MANDAMUS to direct the
respondents 1 and 2 to conduct an proper enquiry and take
necessary and appropriate action on the 3rd respondent, based
on my Complaint dated 31.12.2024 in accordance with law and
to pass such further or other orders as this Hon'ble Court may
deem fit and proper in the circumstances of the case and thus
render justice.

SYNOPSIS

1. For the petitioners daughter carrier opportunities the
