Legal Framework
The Real Estate (Regulation and Development) Act, 2016 mandates promoters to file
QPRs to ensure transparency and accountability.
Key Legal provisions include:

• Section 11(1) → Quarterly updates on bookings,


progress, approvals , deviations;
Mandates uploading QPR on RERA portal

• Section 4 (2)(l)(D) → For Withdrawal from account

• Penalties → Sections 60,61: penalty up to 5%

▪ Stakeholders get real-time information.
▪ Home-buyers monitor progress, detect delays/deviations early, take recourse
through RERA provisions.

ACCOUNTABILITY:
▪ Promoters must adhere to timelines and sanctioned plans.
▪ Any deviation can be tracked through QPR.

FINANCIAL DISCIPLINE:
▪ RERA A/c fund monitoring/ certification ensures proper fund use.

DISPUTE PREVENTION:
▪ Minimizes disputes by maintaining updated disclosures.

Challenges
& Implementation issues (illustrative)

▪ NON-COMPLIANCE BY PROMOTERS : Promoters often fail to upload timely or


accurate updates, leading to penalties and nondisclosure of important information
to stakeholders.

▪ STATE-LEVEL VARIATIONS : While the Model Rules provide a uniform framework,


some States have not fully implemented RERA or have modified rules, leading to
inconsistencies.
(For instance, as of June 2025, States like Nagaland has not notified RERA rules,
impacting the enforcement of reporting requirements. Authority not in place
Meghalaya, Nagaland & Sikkim.)

▪ LITIGATION AS A DELAYING TACTIC : Some promoters use litigation to delay


compliance with RERA orders, including reporting obligations, to frustrate
homebuyers.
