OWN SURVEYORS FOR WHICH OWNERS TO ARRANGE FOR SURVEYORS INSPECTION TO
BOARD THE VESSEL A ND INSPECT THE VESSELS HOLDS/HATCHES, SHOULD THE VESSEL'S
HOLDS NOT BE APPROVED BY SURVEYORS THE VESSEL LAYTIME NOT TO COUNT FROM THE
TIME OF REJECTION OF VESSELS HOLDS UNTIL THE VESSEL HOLDS ARE INSPECTED AND
PASSED BY THE SURVEYOR. INCASE OWNERS WANT TO HAVE A JOINT INSPECTION FOR
FIRST OR SUBSEQUENT INSPECTION, THEN SURVEYS COSTS TO BE FOR EACH PARTYS

CHARTERERS THROUGH BROKERING CHANNEL AND THROUGH AGENTS TO SHIPPERS AND
RECEIVERS.
23. TIME FOR FIRST OPENING AND LAST CLOSING OF HATCHES AND RIGGING ON THE
DERRICKS/CRANES BEFORE COMMENCEMENT OF THE LOADING/ DISCHARGING NOT TO
COUNT AS WELL AS PREPARING SHIPS GEARS FOR LOADING AND DISCHARGING OPERATIONS
AT EACH PORT TO BE DONE BY VESSEL'S CREW AND TIME USED FOR SUCH OPERATIONS NOT
TO COUNT AS LAYTIME AND NO DETENTION WI LL BE CHARGED. TIME WILL CEASE UPON
COMPLETION OF LOADING AND DISCHARGING COMPLETION.
24. INCASE OF BREAKDOWN OF VESSELS CRANES, LAY TIME TO COUNT PRO-RATA TO THE
NUMBER OF WORKABLE HOOKS EFFECTED UNTIL RESUME OF LOADING/ DISCHARGING
UNLESS OWNERS PROVIDE IN THEIR OPTION SHORE CRANE/S IN LIEU THEREOF WHICH CASE
TIME TO CONTINUE COUNTING. INCASE VESSELS CRANES NOT REPAIRABLE OR
UNDERPERFORMING, OWNERS TO ARRANGE SHORE CRANES COSTS FOR OW NERS ACCOUNT.
25. OVERTIME AT BOTH LOADING AND DISCHARGING PORTS TO B
E FOR ACCOUNT OF PARTY ORDERING THE SAME. OVERTIME IF REQUIRED BY PORT
AUTHORITIES COST/TIME FOR SAME ON CHARTERERS TIME & ACCOUNT. BUT OVERTIME OF
OFFICERS AND CREW ALWAYS TO REMAIN FOR OWNERS ACCOUNT
26. ANY AWRIP / ANTI - PIRACY INSURANCE ON OWNERS ACCOUNT.
27. STEVEDORES DAMAGES TO BE SETTLED DIRECTLY BETWEEN STEVEDORES AND OWNERS
, BUT CHARTERERS TO ASSIST OWNERS.
28. FORCE MAJEURE
NEITHER SHALL BEAR RESPONSIBILITY FOR THE COMPLETE OR PARTIAL NON-
PERFORMANCE OF ANY OF ITS OBLIGATIONS IF THE NON-PERFORMANCE RESULTS FROM
SUCH CIRCUMSTANCES AS FLOOD, FIRE, EARTHQUAKE , BAN AND OTHER ACTS OF GOD AS
WELL AS WAR OR MILITARY OPERATIONS OR POLITICAL SITUATIONS , BAN OR RE
STRICTIONS ON THE CARGO TO BE LOADED UNDER THE GOVERNING CHARTER PARTY THAT
HAVE ARISEN AFTER THE CONCLUSION OF THE CONTRACT.
THE PARTY THAT IS NOT ABLE TO FULFILL ITS OBLIGATION UNDER THE PRESENT
CONTRACT AS A RESULT OF THE ABOVEMENTIONED CIRCUMSTANCES, OF THIS CONTRACT,
SHALL NOTIFY THE OTHER PARTY IN WRITTEN FROM AB OUT COMMENCEMENT AND
DISCONTINUANCE OF THE ABOVE CIRCUMSTANCES, THEIR POSSIBLE CONSEQUENCE AND
CONFIRM THESE CIRCUMSTANCES BY THE OFFICIAL DOCUMENTS ISSUED BY THE
APPROPRIATE BODY (CHAMBER OF INDUSTRY AND COMMERCE) OF THE COUNTRY WHERE
FORCE MAJEURE CIRCUMSTANCES ARISE AND TAKE PLACE.
ON ARISING OF THE ABOVE CIRCUMSTANCES THE TERM OF OBLIGATIONS FULFILMENT OF
THE CHARTER PARTY TERMS SHALL BE PROLONGED FOR THE PERIOD DURING WHICH SUCH
CIRCUMSTANCES OR THEIR CONSEQUENCES ARE IN FORCE, BUT NO LONGER THAN 30
CALENDAR DAYS. IF THE ABOVEMENTIONED CIRCUMSTANCES AND ITS CONSEQUENCE LAST
MORE THAN 30 CALENDAR DAYS, THE PARTIES SHALL MAKE DECISION ON THE FUTURE OF
THE PRESENT CONTRACT BY MEANS OF MUTUAL NEGOTIATIONS. IN CASE OF FULL OR
PARTIAL CANCELATION OF THE PRESENT CONTRACT NONE OF THE PARTIES HAS THE RIGHT
TO DEMAND FOR COMPENSATION.
29. ENCUMBRANCE CLAUSE:
OWNERS GUARANTEE THE VESSEL IS FREE FROM ANY OBLIGATION, ENCUMBRANCE, CLAIM
OR LIEN, OF A FINANCIAL NATURE OR OTHERWISE AND VESSEL HAS NO CALLED ANY
SANCTIONED COUNTRY OR PORT THAT WOULD INTERFERE IN ANY WAY WITH THE VESSEL’S
PERFORMANCE OF THIS VOYAGE AND/OR THE DELIVERY OF THE CARGO WITH CONVENIENT
DESPATCH. IN THE EVENT THE VESSEL/CARGO IS LIENED OR ARRESTED DURING THE
CURRENCY OF THIS CHARTER PARTY (UNLESS SUCH AN ARREST OR LIEN IS A MATTER OF
CHARTERERS’ RESPONSIBILITY) THE OWNERS ARE TO TAKE IMMEDIATE ACTION
TO RELEASE VESSEL/CARGO FROM ANY SUCH LIE N OR ARREST AND TO REMAIN FULLY
RESPONSIBLE FOR THE REASONABLE COMMERCIAL COST OR DAMAGES CAUSED AS A
RESULT OF ANY LIEN OR ARREST OR INTERRUPTION OF THE VESSEL’S PERFORMANCE
UNDER THIS CHARTER PARTY.
30.FUMIGATION OF CARGO ON BOARD AT LOADING PORT TO BE ALLOWED IN WHICH CASE
FUMIGATION COSTS TO BE FOR CHARTERERS ACCOUNT. OWNERS TO GIVE MAX 60 HRS FREE TIME F
OR FUMIGATION AT LOAD/DISPORT. ANY TIME OVER & ABOVE TO 60 HOURS FOR FUMIGATION &
DEGASSING AT LOAD/DISCH PORT WILL BE COUNTED AS LAYTIME. IT IS MASTERS / OWNERS
RESPONSIBILITY TO COMPLY WITH THE WRITTEN DIRECTIONS GIVEN BY FUMIGATION
AGENCIES FOR DEGASSING ETC.
31. ALL ABOVE RECAP MAIN TERMS TO BE TREATED AND INCORPORATED AS FIXTURE NOTE
TO BE DATED AUGUST, 2024.
