- The First Party is bound to register this agreement with ﻳﻠﺘﺰﻡ ﺍﻟﻤﺆﺟﺮ ﺑﺘﺴﺠﻴﻞ ﻋﻘﺪ ﺍﻹﻳﺠﺎﺭ ﻟﺪﻯ ﺑﻠﺪﻳﺔ ﻣﺴﻘﻂ ﻭﺳﺪﺍﺩ ﺭﺳﻮﻡ ﺍﻟﺘﺴﺠﻴﻞ-
Muscat Municipality and pay the fixed tax 3%. .( ﻣﻦ ﺍﻟﻘﻴﻤﺔ ﺍﻹﺟﻤﺎﻟﻴﺔ ﻟﻠﻌﻘﺪ%3) ﺍﻟﻤﻘﺮﺭﺓ ﻭﺍﻟﺒﺎﻟﻐﺔ
- The second party abides himself to pay electricity and ﻭﻋﻮﺍﺋﺪ ﺍﻟﺒﻠﺪﻳﺔ، ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺴﺪﺍﺩ ﻗﻴﻤﺔ ﺇﺳﺘﻬﻼﻙ ﺍﻟﻜﻬﺮﺑﺎﺀ ﻭﺍﻟﻤﻴﺎﻩ-
water bills, Municipality rates, sewerage service charges, ﺇﻋﺘﺒﺎﺭﺍً ﻣﻦ ﺗﺎﺭﻳﺦ،ًﻭﺧﺪﻣﺎﺕ ﺍﻟﻤﺠﺎﺭﻱ ﻭأﻳﺔ ﺭﺳﻮﻡ أﺧﺮﻯ ﻳﻠﺘﺰﻡ ﺑﺪﻓﻌﻬﺎ ﻗﺎﻧﻮﻧﺎ
and any other fees/charges that should be borne by the ﺇﺳﺘﻼﻡ ﺍﻟﻌﻘﺎﺭ ﺣﺘﻰ ﺗﺎﺭﻳﺦ ﺇﻋﺎﺩﺓ ﺗﺴﻠﻴﻤﻪ ﺇﻟﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﻭﺫﻟﻚ ﻛﻠﻪ ﻣﺎ ﻟﻢ ﻳﺘﻢ
tenant. The provisions of this Clause should be adhered .ﺍﻹﺗﻔﺎﻕ ﻛﺘﺎﺑﺔً ﻋﻠﻰ ﻏﻴﺮ ﺫﻟﻚ
to with effect from the date of handling over of the leased
property to the tenant up to the date of taking over the
leased property back by the landlord, unless otherwise is
mutually agreed in writing.
- The non-registration or renewal of this agreement ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﻋﺪﻡ ﺗﺴﺠﻴﻞ ﺍﻟﻌﻘﺪ ﻭﺳﺪﺍﺩ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻘﺮﺭﺓ ﻋﻠﻴﻪ ﺧﻼﻝ ﺷﻬﺮ-
and/or the failure of payment of the fixed tax within one ﻭﺍﺣﺪ ﻣﻦ ﺗﺎﺭﻳﺦ ﺳﺮﻳﺎﻧﻪ ﻋﺪﻡ ﺍﻹﻋﺘﺪﺍﺩ ﺑﻪ أﻣﺎﻡ أﻱ ﺟﻬﺔ ﺭﺳﻤﻴﺔ ﺑﺎﻟﺴﻠﻄﻨﺔ
month from date on which it has been signed or expired .ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﺩﻓﻊ ﻏﺮﺍﻣﺔ ﻣﺎﻟﻴﺔ ﺗﻌﺎﺩﻝ ﺛﻼﺛﺔ أﺿﻌﺎﻑ ﺍﻟﺮﺳﻢ ﺍﻟﻤﻘﺮﺭ
concluded and entered into shall result in this agreement
being considered as legally null and void before any
government authority in the Sultanate, in addition to
imposing a fine equal to three times the fixed tax.
- The Municipality tax that has been mentioned in the ﺟﻤﻴﻊ ﺍﻟﻤﺒﺎﻟﻎ ﺍﻟﺘﻲ ﺗﺴﺘﺤﻖ ﻟﻠﺒﻠﺪﻳﺔ ﻃﺒﻘﺎً ﻟﻨﺼﻮﺹ ﺍﻟﻤﺮﺳﻮﻡ ﺍﻟﺴﻠﻄﺎﻧﻲ ﺭﻗﻢ-
provisions of the Royal Decree No. (6/98) and its ( ﻭﺗﻌﺪﻳﻼﺗﻪ ﺗﻜﻮﻥ ﺩﻳﻨﺎً ﻋﻠﻰ ﺍﻟﻤﺆﺟﺮ ﻭﺍﻟﻤﺴﺘﺄﺟﺮ ﺣﺴﺐ ﻣﺎ ﺗﻢ ﺍﻹﺗﻔﺎﻕ89/6)
amendments, are a governmental debt that to be paid by .ﻋﻠﻴﻪ ﻭﺗﺤﺼﻞ ﺑﻄﺮﻳﻘﺔ ﺍﻟﺤﺠﺰ ﺍﻹﺩﺍﺭﻱ
Landlords or Tenants as per the agreement and can be
collected by the administrative confiscation.
- The second party is bound to hand over the leased ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺘﺴﻠﻴﻢ ﺍﻟﻌﻘﺎﺭ ﺇﻟﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﻋﻨﺪ ﺇﻧﺘﻬﺎﺀ ﺍﻟﻌﻘﺪ-
property to the first party on the date expiry of this ﻛﻤﺎ ﻳﻠﺘﺰﻡ.ﻭﻳﻠﺘﺰﻡ ﺑﺈﺻﻼﺡ أﻱ ﺗﻠﻒ ﻓﻲ ﺍﻟﻌﻘﺎﺭ ﻧﺘﻴﺠﺔ ﺳﻮﺀ ﺍﻹﺳﺘﻌﻤﺎﻝ
agreement. He is bound to repair and damages that may ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺈﺟﺮﺍﺀ ﺍﻟﺘﺮﻣﻴﻤﺎﺕ ﻭأﻋﻤﺎﻝ ﺍﻟﺼﻴﺎﻧﺔ ﺍﻟﻼﺯﻣﺔ ﻟﺒﻘﺎﺀ ﺍﻟﻌﻘﺎﺭ
result from the misuse in the property. The first party is .ﺻﺎﻟﺤﺎً ﻟﺘﺤﻘﻴﻖ ﺍﻟﻐﺮﺽ ﺍﻟﻤﺆﺟﺮ ﻣﻦ أﺟﻠﻪ
bound to undertake any maintenance / overhauling /
restoration works required for maintaining the leased
property in a condition consistent with the purpose it is
rented for.
- Other terms and conditions may be added to this ﻳﺠﻮﺯ ﻷﻱ ﻣﻦ ﺍﻟﻄﺮﻓﻴﻦ ﺇﺿﺎﻓﺔ ﺑﻨﻮﺩ أﺧﺮﻯ ﺑﻤﺎ ﻳﺘﻢ ﺍﻹﺗﻔﺎﻕ ﻋﻠﻴﻪ ﺑﻴﻦ-
agreement as mutually agreed by both parties provided .89/6 ﺍﻟﻄﺮﻓﻴﻦ ﺑﺸﺮﻁ أﻥ ﻻ ﺗﺘﻌﺎﺭﺽ ﻣﻊ أﺣﻜﺎﻡ ﺍﻟﻤﺮﺳﻮﻡ ﺍﻟﺴﻠﻄﺎﻧﻲ ﺭﻗﻢ
not to contradict with the Royal Decree No. (6/89).
- In the event that other party fails to comply to his ﻳﺠﻮﺯ ﻟﻜﻞٍ ﻣﻦ ﺍﻟﻄﺮﻓﻴﻦ ﻃﻠﺐ ﻓﺴﺦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺇﺫ أﺧﻞ ﺍﻟﻄﺮﻑ ﺍﻵﺧﺮ-
commitments hereto prescribed, the other party shall have .ﺑﺈﻟﺘﺰﺍﻣﺎﺗﻪ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻴﻪ
the right to rescind this provisions.
- This agreement can be renewed for a further period or ﻳﺘﺠﺪﺩ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺇﻟﻰ ﻣﺪﺓ أﻭ ﻣﺪﺩ أﺧﺮﻯ ﻣﻤﺎﺛﻠﺔ ﻣﺎ ﻟﻢ ﻳﻌﻠﻦ أﺣﺪ ﺍﻟﻄﺮﻓﻴﻦ-
more unless one of the parties advise the other's of his ﻟﻠﻄﺮﻑ ﺍﻵﺧﺮ ﻋﻦ ﺭﻏﺒﺘﻪ ﻓﻲ ﺇﺧﻼﺀ ﺍﻟﻤﻜﺎﻥ ﺍﻟﻤﺆﺟﺮ ﻗﺒﻞ ﺇﻧﺘﻬﺎﺀ ﺍﻟﻤﺪﺓ ﺍﻟﺴﺎﺭﻳﺔ
wish to evacuate the property before the expiry of the ﺑﺜﻼﺛﺔ أﺷﻬﺮ ﻋﻠﻰ ﺍﻷﻗﻞ أﻭ ﺑﻨﺼﻒ ﻣﺪﺓ ﺍﻟﻌﻘﺪ ﺇﺫﺍ ﻛﺎﻧﺖ أﻗﻞ ﻣﻦ ﺫﻟﻚ ﻭﻻ ﻳﺠﻮﺯ
valid period by at least three months or half of the period ﻟﻠﻤﺆﺟﺮ ﻗﺒﻞ ﺇﻧﺘﻬﺎﺀ ﻣﺪﺓ ﺍﻹﻳﺠﺎﺭ أﻭ ﺍﻟﻤﺪﺩ ﺍﻟﺠﺪﻳﺪﺓ ﺍﻟﺴﺎﺭﻳﺔ ﻃﻠﺐ ﺇﺧﻼﺀ ﺍﻟﻤﻜﺎﻥ
if it is less. The Landlord may not ask evacuation of the ﺍﻟﻤﺆﺟﺮ ﺇﻻ ﻓﻲ ﺣﺎﻻﺕ ﻭﻃﺒﻘﺎً ﻟﻠﺸﺮﻭﻁ ﻭﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻲ ﺍﻟﻤﺮﺳﻮﻡ
property except in the cases and according to the .(89/6) ﺍﻟﺴﻠﻄﺎﻧﻲ ﺭﻗﻢ
provisions and procedures of the Royal Decree No. 6/89.
- The second party may not alienate this agreement or ﻛﻤﺎ، ﻻ ﻳﺠﻮﺯ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ أﻥ ﻳﺤﻮﻝ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺇﻟﻰ أﻳﺔ ﺟﻬﺔ أﺧﺮﻯ-
sublet the leased property to any third party whatsoever ﺇﻻ ﺑﻌﺪ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﻣﻮﺍﻓﻘﺔ ﻛﺘﺎﺑﻴﺔ،ﻳﺤﻈﺮ ﻋﻠﻴﻪ أﻥ ﻳﺆﺟﺮ ﺍﻟﻌﻘﺎﺭ ﻣﻦ ﺍﻟﺒﺎﻃﻦ
