Employment Agreement for the position of Overseas Player
This document serves as the employment agreement between
Middleton Cricket Club, Sussex as employer (herein referred to as “The Club”)
And
Abhishek Kumar Dubey as Employee (herein referred to as “the Player”).

The following clauses bear witness the agreements reached in conversations in all forms
(verbal, telephonic and electronically):
Remuneration & Benefits Package:
1) The Club shall employ the Player as an Overseas Player / Coach for the Sussex
Cricket League Season April to September inclusive (herein referred
to as “the Season”). The Start date of which will be communicated in writing as
soon as it becomes available.
2) The Club shall pay the Player the sum of £250.00 Per Week for playing and
3) coaching services for the agreed period. You will be able to undertake private (one
on one) coaching with members of
the Club in your own time using the Clubs facilities. The rate which is charged
will be agreed with the Chairman and any payments between yourself and the
club member shall be treated as a private arrangement. The above agreed
4) amounts will be subject to English (United Kingdom) Tax and National Insurance
5) regulations.
You will automatically be enrolled in the Club’s Pension scheme as required
under UK Law. Should you wish to opt out of the Pension scheme then you must
notify the club in writing.
6) The Club will pay for One (1) Return Economy Class Airline ticket for the Player,
this would cover a flight to the UK and the players return to the India upon
completion of the contract.

Should you be required to quarantine upon arrival in the UK at a UK Quarantine
Hotel, the Club will reimburse 100% of the cost of this requirement. Any
quarantine requirement must be factored into your travel itinerary to ensure
you are available for the first game of the season.

10) The Club will provide shared accommodation for the Player for the duration of
the employment. The Player will provide his own food and upkeep and be liable
for any damage caused to the property or its contents. However, you will be
required to ensure that the property is kept in a clean and tidy condition or your
right to occupy may be reviewed and costs of repair or cleaning deducted from
your wage. Any concerns should be raised immediately to the Chairman.
11) The Club will provide transport to and from matches for the Player.
12) You will be provided with full team clothing including Club Shirt and Cap.
13) The club shall arrange and pay for a gym membership for your exclusive use for
the duration of the agreement.
14) The Club will waive your match fees and season subscription.
15) The Club will pay your fees for ECB Level 2 Coaching Course.
Conditions of Employment:
1) This contract shall be conditional upon the following:
a) The Player attaining a Disclosure and Barring Service (DBS good conduct' or
'police clearance certificate') from your country of residence prior to the
commencement date of this Agreement.
b) A certificate of sponsorship being issued to the Club by the ECB endorsing
the Player.
c) The Player attaining a Tier 5 Sportspersons Visa clearance for entry into the
United Kingdom.
d) The Club being granted a Certificate of Sponsorship by the Home Office.
e) The Club being a member of the Sussex Cricket League Premier Division or
equivalent.
f) The Player being fully fit and physically able to undertake this agreement to
the best of their physical ability.
2.) The Player will be required to attend a formal Sussex County Cricket Board Level 2
Coaching Course which will be paid for by the Club. The date and time of which
will be communicated to the player prior to the commencement of the Season.
Arrangements will be made closer to the time. You are also required to have
completed the associated annexures of the ECB Level Two, namely a safeguarding
and protecting children certificate and ECB Health & Safety modules.
3.) The Player shall be required to attend all Club practices and cricket coaching
sessions as requested. This will include the Club Junior Section practices.
4.) The Player make himself available for all 1st X1 Cricket matches during the Season
as well as any functions which may be designated by the Club Committee.
5.) Whilst performing your duties you will conduct yourself in a manner appropriate
to your position, which will include, but is not limited to:
a) Playing in accordance with the "Spirit of Cricket" and the Anti-discrimination
Code 2022 as set out in the Laws of Cricket published by the ECB;
b) Playing in accordance with the Laws of Cricket Published by the ECB;
c) Adhering to the rules and constitution of the Club, except as they are
excluded by this Agreement.
General
1) Your Normal Place of employment / the Club’s home ground is located at CLUB
ADDRESS.
2)
Should you fail to complete the agreement in full, the club reserve the right to
make a pro-rata adjustment to the amount reimbursed towards the costs of
your air travel and a prorated adjustment will be made to any monies owing.
3) The club shall arrange and pay for a gym membership for your exclusive use for
the duration of the agreement.
4) In the event of injury preventing the Player from playing a medical certificate
will be required to confirm the Player’s situation and a fall-back rate of £100 per
week will apply. This will also apply if play should be halted due to unforeseen
governmental, league or club intervention in compliance with Health and Safety
requirements.
5) The club reserve the right to terminate this agreement with immediate effect
and without liability should the Player fail to disclose any injury or physical
impairment prior to the commencement of this agreement
6) Should the Player sustain an injury whilst performing your duties for the Club,
the Club will arrange initial consultation from a local physiotherapist/medical
professional at the Club’s expense, should the Player require further medical
treatment, the Player will be responsible for any additional expense.
7) The player is responsible for ensuring they have adequate medical cover for the
term of the agreement.
8) Should there be any misdemeanour which causes a club or league suspension
the player will not be entitled to payment for the periods of suspension.
9) During the term of this engagement with the Club, you will not make, cause to
be made, or allow to be made on your behalf, any public comment about the
Club, its members, officers, employees, agents, suppliers, contractors and/or
representatives without the express permission of the Chairman.
10) You shall not play in any match other than those determined by the XYZ Cricket
Club without the express written or email consent from the Cricket Chairman
prior to doing so.
11) England and Wales law shall apply to this agreement and to any dispute arising
in connection therewith.
12) The contract contains an escape clause for the Player by mutual agreement
including being selected to international or first-class cricket tournaments
during the period of contract on condition of formal notification being received
in this regard. In such an instance a prorated adjustment will be made to any
monies owing. The Player will not be paid for matches/duties you are not
available for and any associated travel expenses including but not limited to
airfare change fees & transfers, will be the responsibility the Player.
During the period of this Agreement, you shall be subject to the rules and

constitution of XYZ Cricket Club and the Competitions/County Boards it
subscribes to, including the ICC Code of Conduct, as if you are a member of
these organisations and shall be subject to the disciplinary procedures laid down
within their rules. Disciplinary matters will be covered by the XYZ Disciplinary
policy (a copy will be made available upon request). If the Player is dissatisfied
with the decision and/or action of the Chairman, on the grievance, you may
appeal to the Cricket Committee of the Club excluding the Chairman. The
decision of the Cricket Committee on appeal shall be final. In each case you shall
be notified of any decision and/or intended action.
Personal information Declaration: Please be advised that The Player’s Personal Data, as
referred in the General Data Protection Regulations, will be shared only with the necessary
parties such as the League, the ECB, and other government parties as necessary to execute
the requirements of this contract. This information and other information deemed personal
will be safeguarded and stored securely and is gathered and stored in accordance with
statutory Employment regulations.
Information related to your performance, statistics and results will be published to and
publicly available on the ECB Play-Cricket website
