never seen any council come to a good end, nor turn out to be a solution
of evils. On the contrary, it usually increases them.

Constantine the Great allowed, indeed caused, the Church to become what
had previously been unimaginable. After securing his position as sole em-
peror, Constantine expanded and developed his earlier gestures in support of
greater religious freedom, offering the Church a new and privileged position in
the empire. With the encouragement of the imperial machine, the Church was
enabled to grow in status, power, and wealth to become what could properly
be called an institution. More than this, Constantine’s patronage made the
Church an integral part of the institution—of his one unified Roman Empire.
By the time of Constantine’s death in ad 337, the Church had become the
guardian of what could increasingly be called the imperial religion and also an
agent of imperial power within society. This rapid change in status afforded
the Church sufficient liberty and sufficient security to pour new energy into its
own organizational development. The results would come to influence the
Church and its activities throughout Christian history.
The interest and attention of theologians who study the Church of the
fourth century are rightly directed towards the conciliar actions of the Church
in the period following Constantine’s unification of the empire and the divided
years that followed his death. They are also, quite rightly, focused on the famed
products of those councils: theological creeds. An imperial Church began to
act in an imperial way and its leaders took to the task of governing the beliefs
of a newly expanded body of the faithful. In the fourth century the place for
making decisions on what was or was not orthodox became the ecclesiastical
council. As the Church expanded, the quest for a basic level of uniformity
among its adherents became important and fourth-century bishops embarked
on the task of developing, expounding, or upholding theological tenets,

documents, and creeds, establishing what was and was not acceptable as the
faith of the new imperial Church. These creeds were accepted or resisted
elsewhere, by individuals or by further councils and, over the following
centuries, debate led to the identification or definition of heresy and ortho-
doxy. The pattern is well known and the accepted view, shaped most famously
in modern thinking by Walter Bauer’s work, is that the gradual formation
of unifying orthodox theological standpoints, which still define the Church
Universal, developed out of the gradual identification of heresies and heretics.2
Thus emerges the standard picture of the early imperial Church’s main
activity: ‘The story of the fourth century is of one council after another
drawing up statements of belief in credal form.’3
This captures for many the essence of the fourth-century Church. It is this
process of creed-making and refining, after all, that gave us the Nicene Creed,
and what else from the fourth century defined the Church and indeed the
Christian faith as it would be—and as it is—if not this? Doctrinal debate
through the formation of creeds and the theological writings of the Fathers,
responding directly and indirectly to one another, must unquestionably hold a
primary position in the study of the history of the Church, the history of a
community based around a shared confession.
The student of ecclesiastical history, however, demands a broader focus.
Ecclesiastical history, even doctrinal history, requires attention to a wider
range of factors than creeds and the theological works of Fathers and heretics
around which and from which orthodoxy developed. Many of these factors
relate to the developing nature of the Church as an institution and as part of the
imperial machine. As the Church advanced its institutional progress, its prod-
uctivity in doctrinal creed-making was matched, perhaps overwhelmed, by
efforts to increase and refine its own organizational development, its structures,
rules, hierarchies, and powers. Understanding the Church and its work there-
fore requires detailed study of its own institutional nature and evolution, an
examination of the Church itself, not just its products.
An inevitable result is that our focus must be still broader. As important as
understanding the Church’s credal, doctrinal evolution and also its structural,
institutional development is understanding the functions and attitudes of
those who pioneered these changes. The Church, like any other institution,
was driven by the energies of particular groups and types of people. People,
whether acting alone or with others, have at no point in history remained
above or apart from practical concern, and in their institutional roles have
rarely escaped the influences of ambition, politics, and personal agenda. These,
of course, can be defined in positive, life-giving, and deeply theological ways

and may be formed out of concern for the common good, just as much as
they can emerge from more self-serving purposes. They are, however, univer-
sally present in human nature (the New Testament being first witness to this in
the Christian community) and people who have led the Church must be
understood as no different in this respect if we are to come closer to knowing
the early imperial Church. It is, however, this aspect of the institution’s history
that is often the most difficult to approach from a proper critical perspective.
The study of Church Fathers can often steer towards the hagiographic. Even
asking questions about personal motives can at times prove difficult. However,
attempts to provide proper scholarly critique of the character, nature, and
intentions of key figures in the developing Church have provided helpful
demonstrations of the value of this exercise. For the scholarly task to be a
truly honest exercise, one must take into account less attractive aspects of the
behaviour and motives of the most influential Church Fathers (often a chal-
lenge for the ecclesiastical historian, whose subjects constitute the calendar of
Saints).
To understand the Church, the study of doctrine, of institution, and of
people must each be given proper attention. To comprehend the Church fully,
these strands of study must not remain distinct, but be brought alongside one
another and treated as component parts of one whole. The broad intention of
this book is to demonstrate the value of scholarly enquiry that ensures each
of these parts of what made up the Church during and after the reign of
Constantine is explored and used fully and intentionally as one ‘ecclesiastical
history’, and that the contributing parts of that history are not treated as
distinct disciplines. The story of the early councils of the Church is not just one
of their creeds, their doctrinal progress, their theological development, and a
march towards accepted orthodoxy. It is the story of how and why this
happened, of what processes and structures developed to make it happen, of
who caused them to develop, and of why they did so. The story of the fourth-
century Church is undoubtedly one of council after council, synod after synod
drawing up statements of belief, but it is also a story of this taking place
alongside a range of other things and in contexts defined by manifold prac-
tical, personal, and institutional concerns. Our knowledge of the Church in the
period following the death of Constantine, including its doctrinal advance-
ments, is dangerously selective if we take into account only a limited view of
the institutional and personal factors at play. We only understand the creeds
and the theological wrangling that surrounded them when we also understand
the structures within which they were written and the people who took to
writing those creeds while developing those structures.
In order to achieve the fullest understanding, we are compelled to look
widely for the available evidence of each of these factors influencing the
development of the Church. Texts contemporary to the early life of the
Church do not now newly emerge, except in the most extraordinary of

cases. We must therefore look to what is already available, already known, and
seek to extract from it information which may have been overlooked or simply
not applied previously to the chosen task. As such, the material examined in
this book is neither new nor extraordinary, but it is surprisingly rarely used to
provide information about the developing institutional shape of the Church,
and even more rarely to inform the study of early doctrine. That material is
canon law. The early Church councils produced many documents that were
not explicitly theological. None should be ignored, yet few provide such
interesting subject matter as canon law, which would, alongside and in the
same contexts as theological creeds, expand and develop enormously and
rapidly throughout the fourth century.
Law is, in many forms and in many ways, central to Christianity, yet canon
law has not attracted the attention that other products of the early councils of
the Church have received. It has rarely been recognized as an important and
critical aspect of the development of the imperial Church. With few notable
exceptions, the interest of scholars of the early Church in discussions around
canon law diminished significantly during the twentieth century4 and, while a
place for it is occasionally found in new volumes providing overviews of the
Church in Late Antiquity,5 canon law still rarely receives more than a passing
mention in the studies of ecclesiastical historians of this period. Works of
patristic theology and early doctrinal development are exceptional if they
mention canon law at all. This is particularly true of studies in English. We
must buck this trend and establish canon law as an essential resource for
examining Church councils and their participants.
It has always been a habit of the Church to borrow and adopt the structures
and the relational patterns of the communities and societies out of which it
emerged and of which it forms a part. Ways of meeting, of interacting, of
building communities, and of making decisions were marked in the earliest
Christian communities by their use of established Jewish and pagan forms.
The use of traditional Roman practices continued and increased as the Church
grew in its first centuries to a size that required a series of standard structures
and processes in order to function as a large organization. The growth of
canon law, which began its life in the fourth century, was simply a further
stage in this development: the acceptance of the Roman assumption that

regulation through legal pronouncement was a necessary part of governing a
community. With the emperor effectively at their head, leaders of the Church
came quickly to expand and to develop their use of written legal pronounce-
ments, in what should be seen as the clearest new marker of the Church’s
changed position. As the influence of the Church came to be felt increasingly
strongly at all levels of Roman society, so also the influence of the emperor and
the customs and structures that had first emerged in the pagan world would
come to dominate the life of the Church.
It was natural that canon law would come to echo in the Church the
function and the role of secular laws in Roman society. Canon law would
also come to echo its secular parent in its quantity, with laws being written
across the Church in greater frequency as the fourth century unfolded.
A wealth of legal material from the fourth century therefore sits alongside
the famed conciliar creeds. Indeed, the amount of legislative text amongst a
council’s products in this period often outweighs the theological. The letters
written by councils, as we shall come to see, frequently emphasize the legal
work of the meeting over the theological. Canon law therefore provides a mine
of information concerning the developing imperial Church. The influence it
can have on our understanding of the Church in the period when such laws
were beginning to emerge in an official capacity, and to be recognized as such,
is significant. Canon law and the mechanisms that developed for making and
using it expose a great deal about its early authors. This goes much further
than enlightening us as to those people’s hopes for the Church as an institu-
tion, and for themselves as leaders of the institution, though it does that in rich
detail. It can also lead us to see conciliar creeds in a new light, as products of
their wider context, and particularly as part of a broad body of materials
written to support the institutional and personal purposes of their authors.
The chapters that follow demonstrate the value of the broader scholarly task
set out in this introduction by focusing in detail on the most important legal
material from a limited number of years following the death of Constantine
the Great. This was an age marred by bitter and violent disputes between
opposing factions in the Church over the positions of bishops exiled during
Constantine’s reign. The legal material in question will be primarily the canon
law written by the two ecclesiastical councils in this period that set out most
clearly the positions of those factions. Divided between bishops of East and
West, the members of the Dedication Council of Antioch and the Western
Council of Serdica included many of the most important figures in shaping
these disputes. We will trace the role and significance of their laws within the
context of contemporary conciliar activities, which included letter-writing,
creed-making, theological deliberation, excommunication, and anathematiza-
tion. We will also examine the ways in which these can influence our under-
standing of events in Christian history, and even of doctrinal development,
during a short but crucial period in the life of the Church.

This book is formed of three parts. Part I, Chapters 1 and 2, takes up the
historically significant issue of when, why, and by whom the twenty-five
canons of Antioch traditionally associated with the Dedication Council of
341 were composed. In these chapters, I look at many of the arguments which
have led to the accepted conclusion that the canons were written during the
lifetime of Constantine the Great. This includes examinations of the early
collections and translations of canon law, the appearance of the canons in
early historical narratives, their use at key points in the history of the Church,
and the particular evidence of episcopal subscription lists attached to the
canons. Chapter 2 focuses on the content of the canons and the information
they provide about the context in which they were written. Across both
chapters, I argue that the canons of Antioch were in fact written after the
death of the emperor, that they should be considered a product of bishops
meeting in Antioch during a period of considerable turbulence in the Eastern
Church, and particularly that they acted as a response to the return of bishops
exiled by Constantine, who were granted pardons after his death in 337. This
positioning of the canons of Antioch is important for more than the sake of
historical accuracy. It provides a necessary precursor for the discussions of
Parts II and III of this book, which examine what those canons can tell us
about the debates in the Church that took place after the death of Constantine
and how these should shape our understanding of episcopal authority and
power at that time.
The placing of the canons of Antioch in the late 330s, in the midst of the
conciliar products of the decade following the division of the empire, allows us
to look at the post-Constantinian Church with new insight. Most importantly,
it allows us to shine a critical light on standard assumptions about the causes
of bitter, harmful disputes that occurred after Constantine’s death, which
would dominate the Church and its progress for a generation. The traditional
understanding of those disputes is as a critical moment in a so-called Arian
Crisis, itself a dominating feature of the Church’s developing search for the
Christian doctrine of God. The story follows those groups of bishops in the
Church who fought to defend opposing Christologies. Some were influenced
by or sympathetic to the views of the fourth-century’s most famous heretic,
Arius, and were therefore determined to follow his lead and undermine belief
in the divinity of Christ. Others were equally determined to defend Nicene
orthodoxy in the face of this growing heresy. Councils of bishops were caught
up in theological wrangling—the heretics (and occasionally semi-heretics)
developing creed after creed with the purpose of undermining the Nicene
standard of orthodoxy, while ‘Nicenes’ boldly defied these deviant
acts, defending and protecting Nicaea and its creed.6 In this period divisions

over the legitimacy of particular bishops who returned from exile in 337—
Athanasius of Alexandria, most famously—are rightly regarded as the expression
in the post-Constantinian years of a broader underlying division. For scholars
holding the standard view, it was those bishops’ association with Nicene
orthodoxy that sealed their fates and brought them turbulent years navigating
the opposition of those dissatisfied with the decisions of the first ecumenical
council.
This traditional view of the period and the assumptions it can cause when
shaping ideas about the fourth-century Church have been challenged by some
recent scholarship. The complexities and diversity of the theological positions
held by leading influential bishops of the post-Constantinian Church trad-
itionally labelled Arian or Nicene have been noted; the false constructions of
the most influential sources in forming the idea of Nicene and Arian parties in
the Church of those decades have been exposed.7 Certainly the traditional
view is no longer the sole interpretation of the post-Constantinian years, yet
the influence it holds over writers justifies our continuing to label it a standard
position. The canons of Antioch provide us with an opportunity to decon-
struct another piece of this inaccurate depiction. As we shall come to see later
in this book, the canons of Antioch and the materials relating to them
demonstrate with clarity that divisions in the Church in the years following
337 were not the result of conflict between pro-Nicenes and anti-Nicenes.
Indeed, they demonstrate instead that associations with the Nicene Council
made in the later 330s and 340s were largely non-theological, and that the
causes of division were wrapped up in divergent ideas about the nature and
location of power and the authority for decision-making in the Church.
Doctrinal differences did not play an important role at all.
These conclusions emerge only after the necessary work of Chapters 1 and 2.
Dating the canons of Antioch correctly allows us to understand them as a
reflection of the most pressing concerns of Eastern bishops after the death of
Constantine. In particular they come to demonstrate why different groups in the
Church fought so fiercely over the status of individual bishops who returned
from exile in 337. A revised chronological position for the canons of Antioch
also influences more than a reading of that particular set of laws. It allows us to
understand more fully the conciliar products of the years following the council
that produced them as a reaction to the Eastern laws, their use, and their
treatment by both Eastern and Western bishops. Most notably, this provides a
new perspective on the canons of the Western Council of Serdica, allows us to
understand more completely the content of the letters of both the Eastern and
Western Serdican Councils, and helps us speculate more meaningfully on the
role of the theological materials produced there. Understanding these sources as
