BE PLEASED TO TAKE NOTICE THAT the defendant intends to amend its plea in
the following respects:

BY ADDING A SPECIAL PLEA: LIS PENDENS.

DEFENDANT’S SPECIAL PLEA: LIS PENDENS.

1.1. WHEREAS the Defendant records that there are two summonses running in

respect of the same matter: Plaintiff issued summons on the 17 December

2014 under case number 169931/14.


1.2. The plaintiff is duly represented by CAJEE SETSUBI CHETTY in Kwazulu

Natal, Pietermaritzburg.

1.3. Plaintiff issued summons again on the 24 October 2016, under case number

74663/16 represented, by BOVE ATTORNEYS, North Gauteng High Court.

1.4. In the premises, the Defendant prays that the Plaintiff’s Claim be dismissed

with costs.

KINDLY TAKE FURTHER NOTICE that unless a written objection to the proposed

amendment is delivered within 10 (ten) days of the delivery of this notice, the

Defendant will effect the amendment accordingly.
