SETTLEMENT DEED
This Agreement executed on this th day of 2025, at New Delhi, by
and between
Nikita W/O Sh. Sukhvinder, D/O Ramesh, Resident Of F-II-217 Madangir Dr
Ambedkar Nagar , South Delhi New Delhi-110062 ( hereinafter referred to as the
“FIRST PARTY”)
AND
Shukhvinder S/O Kuldeep Singh Deswal, R/O VPO Atawala Ataula (57) Panipat
Haryana-132133(Hereinafter Referred As To Second Party)
WHEREAS:
1. The first and second party were lawfully married on 04-12-2022 at JD KING
VALLEY SURAJKUND FARIDABAD HARYANA-121010, according Hindu
rites, custom and ceremonies.
2. After their marriage, the parties resides together as husband and wife but due to
temperamental and irreconcilable differences. They have been separated since
April 2023, and there has been no cohabitation since then.
3. All efforts made by families, friends and well-wisher to resolve the differences
The parties have failed, and both parties have mutually decided to dissolve their
Marriage amicably through a decree of divorce under section 13(B)(1) Of The
Hindu Marriage Act 1955
4. Both the parties have amicably and voluntarily settled all their disputes.
Including financial and matrimonial claims without any coercion, fraud or
undue influence.
NOW THIS SETTLEMENT DEED WITNESSES AS UNDER:
1. Agreement To Divorce
The parties mutually agreed to dissolve their marriage and have already filed joint
petition for divorce by mutual consent under section 13(B)(1) of The Hindu
Marriage Act 1955. Before Hon’ble Family Court New Delhi
2. Settlement Matrimonial Disputes
a) Both parties confirm that they have resolved all matrimonial disputes,
including financial claims, personal belongings and other liabilities arising out of
the marital relationship.
b) The parties agree that there will be no further claims of any kind including
maintenance (interim or permanent), alimony or any other financial relief
against each other in the future.
3. Returns Of Belonging
The second party agrees to return all the jewelry to the first party which was gifted
to her parents and relatives at the time of marriage, the return of these items shall
be completed on or before the date of the second motion for divorce
4. Waiver Of Legal Right
a) The party agrees not to file any further civil or criminal proceedings against
each other or their respective families concerning the marriage.
b) They further agree to withdraw any pending cases if any filed against each other
in any court or tribunal in India or elsewhere.
5. No Contact And Interference Clause
The parties agree to avoid any contact or communication with each other and their
respective families. They further agree not to interfere in each other’s personal life
or create any obstacle to each other’s in future relationship or endeavors.
6. Binding Nature Of Agreement
This settlement deed represents the full and final understanding between the parties
regarding their marital disputes. Both parties agree that this deed is binding and
shall be enforceable in law.
7. voluntary and free consent
The parties confirm that they have signed this deed of their own free will and
consent, without any threat , coercion or undue influence from any person.
8. Jurisdiction
Any disputes arising out of this settlement deed shall fall under the exclusive
jurisdiction of the courts in New Delhi.
