Moot Proposition
1. Aryavarta, the world’s largest democracy and a rapidly developing economy, with a
population exceeding 1.4 billion, has experienced unprecedented urbanization and
industrial growth in recent decades. This rapid progress has brought mounting
challenges in managing municipal and industrial waste, combating pollution, and
advancing towards sustainable development. The Government of Aryavarta has
advanced environmental conservation through laws, public - private partnerships, and
support for indigenous green technologies. The Constitution further ensures every
citizen’s right to a clean and healthy environment. Government-led initiatives such as the
Swatantra Swachhta Mission and Plastic Waste Management Rules compliance
programmes have played a vital role in this effort, supported by a diverse client base that
includes municipal corporations, industrial parks, multinational consumer goods
companies, and non-governmental organisations working in environmental protection.
2. A recent study published in a leading International Scientific Journal has revealed that
Aryavarta has emerged as the single largest contributor to global plastic pollution,
generating nearly 20% of the world’s total plastic waste, amounting to approximately 9.3
million tonnes annually. This contribution, surpassing that of several entire regions
combined, underscores the scale of Aryavarta’s environmental challenge. The findings
have drawn significant international criticism, with multiple stakeholders alleging that
Aryavarta’s policies and practices constitute a breach of its obligations under various
International Environmental Covenants. It is further contended that Aryavarta’s failure
to effectively regulate and mitigate plastic waste generation undermines the global
commitment to sustainable development and violates the principle of intergenerational
equity.
3. The recycling machinery sector in Aryavarta has grown rapidly, driven by regulatory
mandates for Extended Producer Responsibility, public pressure to reduce single use
plastics, and the economics of converting waste into marketable raw materials. One
persistent challenge has been the processing of mixed-grade plastic waste comprising
various polymer types, thicknesses, and chemical compositions. Conventional recycling
machines require such waste to be segregated, which is labor-intensive, costly, and
22
inefficient. Mixed-grade plastic is particularly problematic because it contains varying
melting points and chemical properties.
6. On January 18, 2019, Planet Works Tech filed Patent Application with the Aryavartan
Patent Office, containing 15 claims in total - five independent claims focusing on the
BioShredder’s machine, core process, and apparatus, and ten dependent claims detailing
enhancements, including emission control features. The application overcame prior art
objections from Japan and Germany through affidavits from Dr. Arjun Nair and experts,
proving the invention’s novelty, inventive step, and industrial applicability. On May 15,
23
2020, Patent was granted. Following the grant, PlanetWorks Tech expanded BioShredder
production at its Hosira facility and launched it at the Aryavartan Green Tech Expo 2020.
Within six months, PlanetWorks Tech secured a ₹50 crore tender for 15 units from the
Chalukyadesh State Municipal Corporation, a partnership with a multinational for food-
grade PET recycling, and a contract with Suraj industrial parks, reinforcing its value of its
patent protection.
8. In September 2020, PlanetWorks Tech’s Research and Department head, Dr. Karan,
acquired a TrashMaster unit through a dealer in Nizamabad, made comparative analysis
and concluded that three of the four core claims in PlanetWorks Tech’s patent were
replicated without substantive deviation. GreenRotor CEO Mr. Rajesh Kapil denied
infringement, stating that the TrashMaster was independently developed, with input
from German consultants, and that similarities were due to “standard engineering
norms.” By pricing the TrashMaster roughly 18% lower than the BioShredder,
GreenRotor secured contracts with five major municipal corporations, including several
former clients of PlanetWorks Tech. In October 2021, PlanetWorks Tech issued a cease-
and-desist notice alleging infringement. GreenRotor replied in November 2021 denying
infringement, citing prior art and alleging that PlanetWorks Tech’s patent lacked novelty.
9. On January 5, 2022, PlanetWorks Tech filed suit in the Nandinapura Court. The suit
sought a permanent injunction to restrain GreenRotor from continuing the alleged
infringement. PlanetWorks Tech submitted technical affidavits, a comparative analysis
report, and market data showing reduced market share. The court admitted the suit,
issued a summons to GreenRotor, which filed a written statement denying infringement
and counterclaiming for patent revocation. The case gained significant media attention
due to its commercial stakes. On December 15, 2023, the Court issued judgment, finding
24
that the TrashMaster infringed PlanetWorks Tech, and awarded PlanetWorks Tech ₹12
crores in damages for lost profits and a reasonable royalty, rejecting the full ₹50 crores
claimed. It granted a partial permanent injunction, barring GreenRotor, from
manufacturing new units. In January 2024, GreenRotor, appealed to the Chalukyadesh
High Court. The High Court granted a stay, allowing GreenRotor, to continue sales.
Dissatisfied with the High Court’s decision, PlanetWorks Tech approached the Supreme
Court of Aryavarta challenging the stay and seeking a complete injunction.
Issues Raised
25
4. Whether the intervention of an NGO in a Patent infringement is
maintainable.
Note :
2. Without prejudice to the issues framed above, Participants may frame further
sub-issues and the discretion to hear arguments on them shall always remain
