THE CONSTITUTION OF MALUMFASHI STUDENTS’ ASSOCIATION,

NATIONAL BODY (MALSA) 2023 AS AMENDED.


PREAMBLE
We the Indigenes of malumfashi Local Government Area of Katsina State studying at
various higher institutions across the country firmly affirmed to unite under a single entity
baring the flag of our individual schools. We hereby accept this document as our
Constitution and that its provisions shall be regarded supreme.
SUPREMACY OF THIS CONSTITUTION
The Constitution shall come into force with effect from the day of approval/adoption by the
Members of Malumfashi Students’Association National Body (MALSA) Thereafter, this
constitution is supreme and all its provisions shall be enforced and have a binding effect on
all members of the association. The provisions of this Constitution shall supersede all
Documents and other related governing instruments of the Malumfashi Students'
Association National Body (MALSA).
ARTICLE ONE
GENERAL PROVISION
SECTION 1: NAME OF THE ASSOCIATION
This Association shall be known as MALUMFASHI STUDENTS’ ASSOCIATION,
NATIONAL BODY (MALSA)
SECTION 2: MOTTO OF THE ASSOCIATION
The motto of this Association shall be "EDUCATION IS THE KEY TO
DEVELOPMENT AND SUCCESS".
SECTION 3: AFFILIATION
This association shall be affiliated to all local chapters registered to it.
SECTION 4: MEMBERSHIP
Membership to Malumfashi Students Association National Body (MALSA) shall be open to
all of Malumfashi Local Government bearing the flag of the higher institution's chapter they
are studying at, which involves Colleges, polytechnics and Universities nationwide.

SECTION 5: REGISTRATION PROCESSES


There shall be central registration to be made by each local chapter before being recognized
by and incorporated into the national body of the association.
b. The registration may be made firstly, by writing an application for registration to the
national body by the concerned requesting local chapter.
c. Secondly, there shall be, upon critical examination of the purported application, if deem
fit by the national body, the issuance of the certificate of approval and incorporation against
the local chapter in question.
d. Thirdly, as the application for registration is pending for an approval, the national body
shall issue a formal letter categorically demonstrating their preliminary intention to
afterwards issue a certificate of approval to the requested local chapter.
f. Fourthly, Upon the receival of the approval letter from the national body and pending for
the issuance of the certificate of Approval, the concerned local chapter shall pay the
registration fee to the national body as may be prescribed by the board of trustees.
g. No certificate of approval is valid, which has been procured from any other person or
persons not expressly or impliedly conferred with the power to do so by this constitution.
h. The certificate of approval of any local chapter can be treated as forfeited, suspended or
even revoked if their activities found to be carried out not in accordance with the provision
of this constitution partly or wholly.
i. As soon as any particular local chapter is dully certified and saved with the certificate of
approval in accordance with this section, it deemed to be bound by the provision of this
constitution.
SECTION 6: THE OFFICIAL LANGUAGE OF THE ASSOCIATION
The Official Languages of the Association shall be English and Hausa; Being English our
Nations official language and Hausa our native language.
SECTION 7:
PATRONS OF THE ASSOCIATION
i. The patrons shall be categorized into three namely; The Royal Fathers, The Grand
Patrons and the Patrons.
ii. The Royal Fathers shall include the districts heads in Malumfashi Local Government
Area.
iii. The Grand patrons shall be the Stakeholders/political authorities such as The Local
Government Chairman etc.
iv. The Patrons shall be the elderly according to their personalities to the association.
v. The Patrons shall be appointed by the EXCO and LC.
vi. The patrons shall serve as the advisory and disciplinary body hence to be considered
supreme.
vii. In conjuncture with trusted members of the congress and parliament, serve the
Judiciary Committee.
ARTICLE TWO
AIMS AND OBJECTIVES OF THE ASSOCIATION
SECTION 8: The aims and objectives of this association shall be:
i. To promote unity within the Malumfashi indigenes studying at various higher institutions.
ii. To project the image of Malumfashi, Katsina across the various campuses.
iii. To foster mutual respect and understanding as well as cooperation among all the
members to tackle Students' Problems.
iv. To improve the academic welfare of its members.
v. To promote academic excellence of Malumfashi Indigenes through organization of
guidance
& counseling sessions, seminars, lectures, symposia, quiz, debate, tours etc.
vi. To improve the social norms and enlightenment of Malumfashi Indigenes.
ARTICLE THREE
ORGANS OF THE ASSOCIATION
SECTION 9: COMPOSITION
The Organs of the association shall include;
i. The board of trustees(BT)
ii. The Executives Council (EXCO)
iii. The Legislative Council(LC)
iv. The Committees
SECTION 10:
FUNCTIONS AND POWERS
A.THE BOARD OF TRUSTEES
i. The board shall be the most powerful and supreme organ of the association.
ii. Sec.2a There shall be an establishment of a board to be refer to as the board of trustees
b. The board shall consist of the national president, national secretary general, grand petron I
and II national body one grand petron from each local chapter and such other members as
may be determined by the above listed personalities
c. The board shall be vested with all powers to intervene, interfere, object, review, disagree,
affirm, revoke, compel, suspend, take over and continue any duty given, any benefit
conferred upon, any appointment granted by any committee or individual by virtue of the
provisions of this constitution saved with the power to declare elected any person whom has
already been declared by the eclectoral commission as a loser, or to declare a loser whose
election has been conclusively declared by the electoral commission to returned elected.
d. The board shall commit itself actively in ensuring peaceful co-exististance amongst the
existing committees and individuals subject of the provisions of this constitution.
e. In furtherance of its commitments and discharge of it's outstanding functions, the board
shall devote itself in promoting strict compliance with the provisions of this constitution.
f. The board shall have and exercise both advisory and supervisory powers in respect of the
duties and powers conferred upon it.
g. The phrase 'vested with all powers' in the above subsection c does not extend toamending
this constitution partly or wholly without the consent and approval of judicial commission.
h. Newly inclusion of any person or group of persons to the board of trustees requires the
consent of all the existing members and the approval of not less than two-third of them.
SECTION 3
a. There shall be a judicial body of the association to be known as the judicial commission
and to be vested with the following powers:
b. To conduct and ensure, in collaboration with electoral body, a free and fair election at any
material moment in which it is due; whether locally or nationally.
b. The body shall ensure it's presence in a representative form, where possibe, in the
conducting of each local chapter's election when its due.
c. The body shall have the exclusive power to hear and determine any dispute emanating
from any electoral matter or matters or any other issue (s) connected therewith
The body shall consist of the president of thejudicial commission who, at must, be sound in
electoral matters, adjudication and dispute resolutions.
d. As soon as the national body election was conducted and declaration as to winners and
losers was made, judicial commission shall ensure setting aside a committee to be refer to as
election petition committee to try the cases in event any contestant(s) is/are aggrieved or
dissatisfied with the so far declaration.
f. No petition is answerable which was made outside the time limit stipulated by the judicial
commission within which petitions may be heard and determined.
g. Petitions in oral, gesture or even silence form are of no value and of no effect whatsoever.
h. any decision arrived at by the judicial commission shall stand to be final and irrevocably
fixed to be overthrown by a side-wind.
B.THE EXECUTIVE COUNCIL EXCO
This shall:
Operate as the governing body of the Association and shall exercise its powers and
formulate policies in accordance with the provision of this Constitution.
The executives shall;
i. Be responsible for the formulation and execution of policies on behalf of the association.
ii. It shall also have the power to appoint members to the standing committee as may be
deemed necessary with the approval of Legislatives Council.
iii. The executives’ organ shall have the power to enforce the law(s) passed by the board of
trustees and Legislatives Council.
iv. Hear the report(s) on the activities of the committees and deliberate upon them.
v. Represent the Association on all government and technocratic related issues.
vi. Negotiate for financial and material assistance to promote the activities of the
Association; as far as such assistance is not selfishly driven and doesn't negatively affect
the Association.
vii. Be the chief Coordinating body of the association's activities.
viii. Compile annual report of the Association’s activities for approval and adoption by the
board of trustees at the last meeting of the year.
ix. Exco of MALSA shall be responsible for defending and upholding the constitutional
aim and
objectives of the association.
x. Exco shall resist any attempt by any individuals or any organizations to use/misuse the
association for his/their personal interest.
xi. The EXCO offices shall be occupied by a Simple Majority Poll Election.
xii. Elected EXCO shall not exercise any power before their inauguration.
C. THE LEGISLATIVES COUNCIL:
The council shall:
i. Be the law-making body of the union;
ii. Be consulted by Executives on all major issues or decisions;
iii. Hear the reports of the activities of the Excos and deliberate upon them;
iv. Have the powers to discuss, approve or disapprove all proposals of the Excos on
reasonable grounds;
v. Have the power to set up any committee or panel not provided for by this Constitution;
vi. Have the power to summon the President or any other executive officer on any matter
as they may deem necessary;
vii. Have the power to discipline any officer(s) of the union or any member of the council by
resolution of not less than two-thirds (2
/3) majority of the council;
viii. Submit all bills passed into law to the President for assent. Where the President fails to
sign the bill into law within two weeks from the day he receives it, either by reason of
incapacity or refusal, the bill shall be returned to the council; and after due
consideration, the bill shall be passed into law by the two-thirds majority of the council
and the bill shall thereafter become a law and the assent of the President be not
required again.
ix. The LC shall not exercise any function or power before their official inauguration.
D. THE COMMITTEES:
Without prejudice to the EXCO to constitute ad-hoc or standing committee, they are
empowered to constitute under this constitution, there shall be for this association standing
committees.s
The standing committees shall include the following;
i. The Caretaker Transition Committee (CTC)
ii. Independent Electoral Committee (IELCOM)
iii. Disciplinary Committee
iv. Audit Committee
v. Publicity/Publication Committee
vi. Such other committees as the need arises e.g., Sports Committee, Welfare Committee,
Socials Committee etc.
E. THE CARETAKER TRANSITION COMMITTEE (CTC)
There shall be for the Association a Caretaker Transition Committee herein referred to as
CTC which;
i. Shall be nominated by 2/3 majority of the Congress present in a meeting.
ii. Shall compose of five members of outstanding experience and proven integrity.
iii. Shall have a chairman, a secretary, and a PRO nominated by the members of the
Committee.
iv. Shall not be composed of any member of the out-gone EXCO member.
v. Shall not exercise any function whatsoever, except in the advent of dissolution of EXCO
or resignation of certain officers of the Executive Council within the provisions of this
constitution, in which cases, the committee shall conduct another election, or save
thesituation in accordance with the provisions of this constitution.
vi. Shall be a standby committee, with a minimum life span that lasts as long as they have an
unfinished task and a maximum of four (4) weeks, starting from the day in which their
attention was called upon.
vii. Shall not have the ability to undertake any capital-intensive project under this
constitution.
viii. The congress shall have the ability to constitute or de constitute any or all members of
the committee, and that they have a good reason to do such, according to the provisions of
this constitution.
ix. Such decision by the congress above shall be confirmed by a 2/3 majority vote of the
members present in a meeting, provided they form a quorum.

ARTICLE FOUR
OFFICES OF THE EXECUTIVE COUNCIL AND THEIR DUTIES
SECTION 11:
The Offices of MALSA EXCO shall include;
i. President
ii. Vice President
iii. Secretary General
iv. Assistant Secretary General
v. Financial Secretary
vi. Treasurer
vii. Auditor General
viii. Publicity Secretary/Public Relations Officer PRO I
ix. Publicity Secretary/Public Relations Officer PRO II
x. Welfare Director
xi. Sports Director
xii. Socials Director I
xiii. Socials Director II
xiv. Liaison Officer
xv. Editor-in-chief
SECTION 12: DUTIES OF THE EXECUTIVE OFFICES
A. PRESIDENT:
The President shall:
i. Be the Chief Executive, Representative and Spokesperson of the association
ii. Issue press release on matters other than those dealt with by the Public Relations Officer
PRO.
iii. Coordinate activities of the EXCO.
iv. Give necessary directions to other officials to assure proper execution of their duties.
v. Be the overall custodian of the association's properties.
vi. Have the power to approve or reject voucher(s) raised by any EXCO member.
vii. Perform or delegate to other EXCO member(s) duties not mentioned by this
Constitution but are in line with the aims and objectives of the association.
viii. Direct the Secretary General to summon EXCO meeting(s) over which he shall preside.
ix. Cast a vote only when there is a tie in EXCO meeting.
x. With the approval of the Senate President, summon emergency meeting(s) of the union’s
officials, provided that a notice of 48hours is given to that effect, and shall preside over such
meetings.
xi. Have the power to make new appointments with the approval of 2/3 majority and
approval of the legislatives.
xii. Preside over meetings of the association, and represent the association in line with
Secretary General and PRO in public occasions.
xiii. Be a co-signatory to the association’s bank account.
xiv. Office of the President shall be open for both male/female students.
B. VICE PRESIDENT (VP):
The Vice President shall:
i. Assist the President in carrying out his duties and shall deputize in his absence.
ii. In the event of suspension, death, dismissal, resignation or withdrawal of the President,
the Vice President shall be the substantive President;
iii. The resolution must be passed by two third majority of the executive council and there is
evidence ted by the Legislative Council.
iv. Be responsible for employment bureau and commercial ventures.
v. Office of the VP Shall be open to both male/female students.
C. SECRETARY GENERAL (SG):
The Secretary General shall:
i. By the directive of the President, summon Executive Council and Congress meetings.
ii. Take and keep minutes of proceedings of EXCO and Congress meetings.
iii. Be responsible for safeguarding all documents, except otherwise stated by this
Constitution.
iv. Compile a report on the union’s activities and report same to congress.
v. Office of the Secretary General Shall be open to male/female students.
D. ASSISTANT SECRETARY GENERAL (ASG):
Assistant Secretary General shall:
i. Assist Secretary General in all his duties.
ii. Deputize for the Secretary General in his absence.
iii. Assume the Office of the Secretary General when its rendered vacant, and must be
approved the EXCO and Legislative.
iv. Office of the ASG shall be open to both male/female students.
E. FINANCIAL SECRETARY:
The Financial Secretary Shall:
i. Keep record of all monies and expenditure of the association.
ii. Prepare the publication of all statements of accounts as may be required by the EXCO
and Legislative Council.
iii. Be in custody of receipts and duplicate of voucher(s).
iv. Be a signatory to the association's bank account.
v. The Financial Secretary may the first to be called upon to present records of the financial
transactions, in the prevailing circumstance.
vi. Office of the Financial Secretary shall be open to male students only.
F. TREASURER:
The Treasurer shall:
i. Account for monies of the union received and/or make payment on behalf of the union
and communicate same to the Financial Secretary for record;
ii. Bank all union monies within forty-eight (48) hours of receipt.
iii. Jointly with the President and Financial Secretary sign cheque(s) for withdrawal, with
the approval of the Legislative Council.
iv. Issue out all duly signed cheque(s);
v. Submit a statement of the bank account transactions to the Legislative Council.
vi. The Treasurer may be liable for negligence, misappropriation of the association monies
hence;
vii. The Office of the Treasurer shall be strictly for female students.
G. AUDITOR GENERAL:
Auditor General shall:
i. Be the chairman of the audit committee
ii. Have access to all documents of financial transaction of the association.
iii. Audit the association's bank accounts and submit the report to the Legislative Council
and the congress time to time.
iv. Have the power to query any monies meant for expenditure, under the directive of the
President or Senate President.
v. Office of the Auditor General shall be open to both male/female students.
H. PUBLIC RELATIONS OFFICER I
PRO I shall;
i. Be in charge of projecting the image of the association.
ii. Be in charge of decimation of information on the association.
iii. Publicize congress meetings at least seventy-two (72) hours before the meeting by the
directive of the President or the Secretary General.
iv. Be responsible for publicizing the association's activities.
v. Serves as the association's Publicity Director/Chairman.
vi. This office shall be open to both male/female students.
I. PUBLIC RELATIONS OFFICER II:
PRO II shall:
i. Assist the PRO I in carrying out his duties
ii. Deputize the PRO I in his absence.
iii. The office shall be open to both male/females students.
G. WELFARE DIRECTOR:
Welfare Director shall:
i. Promote and coordinate all welfare activities.
ii. Shall recommend to the EXCO the welfare programs of the association.
iii. Shall chair any welfare gathering
iv. The Office shall be open to both male/female students.
H. SPORTS DIRECTOR:
Sports Director shall:
i. Be in charge of the association’s sports activities
ii. Liaise with other associations to organize friendly sports activities.
iii. Be the chief custodian of all sports equipment belonging to the association.
iv. Organize a training session for the association's team.
v. Be the chairperson of the sports committee.
vi. The Office shall be Open to male only.
I. SOCIALS DIRECTOR
Socials Director shall:
i. Organize all social functions of the association, except where specified otherwise.
ii. Be chairperson of the socials committee.
iii. Be the accounting official of socials committee, and hand over any proceeds from any
social functions to Financial Secretary within forty-eight (48) hours of receipt.
iv. Give report of the socials committee at the proceeding union meetings.
v. Organize a social welfare at least once a tenure.
vi. The Office shall be Open to both Male/female students.
J. DIRECTOR OF SOCIALS II
The director of socials II shall;
i. Deputize the director of socials I in his absence
ii. Assist him in organizing social gatherings
iii. The Office shall be Open to both male/female students.
K. EDITOR-IN-CHIEF:
The Editor-in-chief shall:
i. Be responsible for all the publications of the association.
ii. Be the chairperson of the editorial committee.
iii. In conjunction with Financial Secretary, sell copies of the association's magazine or
journals and issue receipts to such effect.
iv. Be responsible for the intellectual upliftment, Enlightenment of members of the
association.
v. The Office shall be open to both genders, a person with good English & Communication
skill.
L. LIAISON OFFICER:
The liaison officer shall:
i. Be in charge of connecting between local chapters and other unions
ii. Be the chief correspondent of the union in other unions gatherings
iii. The Office shall be open to both male/female students.
ARTICLE FIVE:
LEGISLATIVE COUNCIL, OFFICES AND DUTIES
SECTION 13: COMPOSITION OF THE COUNCIL;
i. There shall be a Senate President for the council to be elected by the members
immediately after constituting the Legislative Council.
ii. The Senate President shall last for one-year tenure similar to the Executive Council.
iii. There shall be a Deputy Senate President for the council to be elected by the members.
iv. There shall be Clerk for the council to be elected by the members.
v. There shall be Deputy Clerk for the council to be elected by the members.
vi. There shall be a Chief Whip I for the council who shall be responsible for maintaining
law and order during proceedings.
vii. There shall be Chief Whip II for the council to be elected by the members.
SECTION 14: DUTIES OF THE LEGISLATIVE OFFICES;
A. SENATE PRESIDENT:
The Senate President shall:
i. Presides over all meetings of the council;
ii. Summon meetings through the Clerk of the council;
iii. Ensure the observance of rules and regulation governing the sitting of the council;
iv. Have power to send any erring member out of the council meeting whose conduct is
prejudicial to the proceedings of the council;
v. Notify and direct the electoral committee to conduct a bye-election in the event of any
vacancy in the council.
B. DEPUTY SENATE PRESIDENT:
i. There shall be a Deputy Senate President.
ii. The Deputy Senate President shall:
iii. Without prejudice to the powers of the Senate President assist in all his duties;
iv. Deputize for the Senate President in his absence;
v. While he presides, he shall have all privileges attached to the office of the Senate
President.
C. CLERK OF THE COUNCIL:
There shall be a Clerk for the council.
i. The Clerk shall hold office for the lifespan of the council.
ii. The election of the Clerk be conducted in similar manner as that of the Senate President.
iii. Shall be in charge of Recording the proceedings of the meeting;
iv. Publicize the activities of the council as directing by the Senate President.
D. CHIEF WHIP:
There shall be Chief Whip II for the council;
i. The Chief Whip shall be responsible for:
ii. Maintaining law and order during the proceedings of the council;
iii. With approval or direction of the Senate President to ease any member who in the
opinion of the Senate President is unnecessary causing disturbance;
iv. Putting the house in order and arranging the sitting position of the members, under the
directives of the Senate President.
ARTICLE SIX
TENURE, DISSOLUTION AND ELECTION
SECTION 15: TENURE & DISSOLUTION
i. The tenure of the Executives council shall last for one year.
ii. The executive shall be dissolved at the end of the session and new ones shall assume
power.
iii. The legislatives are to be send by their chapters while the council offices last for one
year.
iv. If the Exco fails to call a board of trustees members meeting for the dissolution, the
board
members shall call a board and dissolve them through the legislative council, provided they
form a quorum.
v. Tenure elongation maybe implied on reasonable grounds.
vi. A caretaker committee shall be nominated to take control before the elections.
vii. Electoral Committee shall chair the election in which none of them will have an interest
of contesting.
viii. It shall be after a general board meeting where all the activities and expenditures of
the outgoing administration have been presented.

SECTION 16:
ELECTION AND ELECTORAL COMMITTEE
i. There shall be an election within two weeks after dissolution of the Exco and legislature
ii. The election shall be a secret ballot and to be conducted by the independent electoral
committee of the union
iii. The election shall be conducted in accordance with the provisions of this constitution;
iv. The candidate willing to contest for any office must purchase a form
v. Candidates must go through a series of thorough screening and successful candidates
shall proceed
vi. Candidates must go through manifestation process
vii. The manifestation shall be organized and conducted by the IELCOM
viii. The following shall be eligible to be voted for;
ix. All the of members of the association who have met or fulfilled their financial
obligations to the union,
x. All members who have completed one full academic session at their institution save as
otherwise provided by this constitution,
xi. Have at least 50% board of trustees attendance.
xii. At the end of the election, any candidate with simple majority shall declared winner,
save where the candidate contested unopposed in which case, he/she shall be declared
winner.
xiii. In the event of a tie, the IELCOM shall order for a re-election within twenty-four (24)
hours of announcement.
xiv. Withdrawal of candidate shall be within 24 hours before the election commences. Such
withdrawals must be communicated to the chairman of IELCOM in written.
xv. A candidate shall be disqualified if he/she;
xvi. Has been indicted and convicted by any committee established by law for abuse of
office, corruption, embezzlement or any misconduct.
xvii. Short of any of the electoral guidelines stipulated by this constitution
xviii. Violate any of the electoral rules and regulations stipulated either by this constitution
or
independent electoral commission.
SECTION 17: INDEPENDENT ELECTORAL COMMITTEE (IELCOM)
i. There shall be an independent electoral committee formed before upon dissolution of
the Exco.
ii. The committee shall comprise one member from each local chapter of the association.
iii. The committee shall be led by a chairman to be elected by the IELCOM members and
must be experienced and familiar with the provision of this constitution.
iv. There shall be a secretary and a number of the offices as may be deemed necessary by
the board of trustees for the committee to be elected by members of the IELCOM
v. The committee shall be formed immediately before dissolution of the Excos and
organize and conduct election within (14) days from the date of its formation
vi. It shall have to:
vii. Register all candidates for election,
viii. Conduct elections into the Exco and legislative councils Offices,
ix. Ensure that all elections are free and fair,
x. Organize a bye election, reelection, etc.
xi. Commence counting of votes immediately after election in the presence of all agents,
xii. Declare the result of each election and the winner of the election, not later than 24
hours of commencement,
xiii. Disqualify any person found to be short of the requirement as provided by this
constitution,
xiv. Make bye rules and regulations not foreshadowed by this constitution,
xv. The tenure of the IELCOM shall last for a year/tenure of the election otherwise stated.
xvi. Shall organize the inauguration, hand over all document to the newly elected
administration within the period of seven days, otherwise due to a petition on the basis
of this constitution.
xvii. The committee shall present all their tasks, expenditures and might be subjected to
audit if deemed necessary.
SECTION 18: ELECTION GUIDELINES;
i. The election shall be by secret balloting in accordance with the following rules:
ii. Only three students from each registered local chapter are eligible to vote.
iii. Election delegates must be lead from each local chapter baring the name of the
institution.
iv. Delegates list must be forward by through the leader of the union before
commencement of elections.
v. The delegations shall include; The President, Secretary & PRO 1 or their equivalent as
may be deemed necessary.
vi. Each voter shall be entitled to only one vote for each election.
vii. At the end of the election, the candidate with a simple majority shall emerge as the
winner.
viii. In the case of an unopposed candidate, he/she shall emerge as the winner at the end of
The election.
ix. At the end of the voting exercise the members of the Electoral Committee shall count
the votes in the presence of the Accredited Agents of the candidates.
x. The result of the election shall be announced immediately after counting; the Electoral
Committee shall publish the detail list of candidate(s) and number of votes obtained within
twenty-four (24) hours from the time of announcement and circulates copies of
the result to the appropriate persons and offices concerned, that is to say;
xi. The Patrons,
xii. Each of the candidates,
xiii. Constituted Authorities.
xiv. Members of the Electoral Committee are neither eligible to vote nor be voted for.
xv. Where there is a TIE, a rerun election shall be held by the Electoral Committee.
xvi. Where an office is constitutionally found to be vacant; a Bye-election shall be
conducted within two (2) weeks.
xvii. If a candidate is dissatisfied with the conduct of the election or result of an election;
such a candidate may within forty-eight (48) hours of publication or announcement of
the result lodge a petition duly signed by him to the Electoral Committee.
xviii. Where an election is declared null and void, the sit shall be declared vacant.
SECTION 19: ELECTION PETITION
a. There shall be a judicial body of the association to be known as the judicial commission
and to be vested with the following powers:
b. To conduct and ensure, in collaboration with electoral body, a free and fair election at any
material moment in which it is due; whether locally or nationally.
b. The body shall ensure it's presence in a representative form, where possibe, in the conduct
of each local chapter's election when its due.
c. The body shall have the exclusive power to hear and determine any dispute emanating
from any electoral matter or matters or any other issue (s) connected therewith
The body shall consist of the president of the judicial commission who, at must, be sound in
electoral matters, adjudication and dispute resolutions.
d. As soon as the national body election was conducted and declaration as to winners and
losers was made, judicial commission shall ensure setting aside a committee to be refer to as
election petition committee to try the cases in event any contestant(s) is/are aggrieved or
dissatisfied with the so far declaration.
e. No petition is answerable which was made outside the time limit stipulated by the judicial
commission within which petitions may be heard and determined.
f. Petitions in oral, gesture or even silence form are of no value and of no effect whatsoever.
g. any decision arrived at by the judicial commission shall stand to be final and irrevocably
fixed to be overthrown by a side-wind.
ARTICLE SEVEN
RESIGNATION, SUSPENSION AND TERMINATION
SECTION 20: RESIGNATION
i. Any member of the EXCO who wishes to resign from office shall signify such wish in
written to the secretary general of the Association.
ii. Any documents in his/her possession shall be submitted to Secretary General within
48hours of resignation.
iii. In the case of the Secretary General, all documents shall be submitted to the President,
then forwarded to the Legislative Council through the Clerk.
iv. Causing matters of resignation must be properly investigated.
v. A bye-election shall be conducted after acceptance of the resignation.
SECTION 21: SUSPENSION AND TERMINATION
i. An Officer of the association shall be terminated from Office if;
ii. His/her conduct adversely affected the reputation or dignity of the association.
iii. He/she contravene or fail to comply with the provisions of this constitution.
iv. If He/She has financial charges confirmed against him/her.
v. Any member who resigned or expelled from membership shall not be entitled to refund
of his/her subscription or any other fund contributed at any time.
vi. Any member of the executive council resigned or expelled shall immediately handover
to the secretary general all records, documents and any other property of the
Association in her possession, and in the of case of secretary general shall hand over to
the president.
vii. No executive shall be suspended or terminated from offices without proper
investigation.
viii. An officer of the association has the right to defend his/herself before the charges or
allegations are taken on him.
ix. Any suspension or termination outside the protocol of this constitution shall be nullified
as far as this constitution is supreme.
ARTICLE EIGHT
DICIPLINE/CODE OF CONDUCT
SECTION 22:
i. Any official or member of the association against whom a case of financial
mismanagement is established shall refund the monies involved as shall be
recommended and approved by the Disciplinary Committee and approved by the
congress.
ii. In such a defaulter is an official, in addition to refunding the money he/she forfeit
his/her post with immediate effect.
iii. In case of failure to redeem the money, the matter shall be taken to further authorities
for the appropriate action.
iv. Any official who fails to go in line with the provisions this constitution shall be liable to
discipline.
v. No official shall be removed without proper investigation.
vi. Any official who has financial charges has the right to defend his/herself before actions
are taken.
vii. The Association shall not put itself in a situation where its personal interest will conflict
with its functions, duties and responsibilities under this constitution.
viii. Any officer who absents himself from any EXCO meetings for three (3) consecutive
times
without any genuine reason shall subject to the provision of this Constitution be
punished.
ix. Any member of the Association who carries out direct physical and/or verbal assault on
any other person shall be handed over to the appropriate authority.
x. An officer of the Association shall not be a member of any society club or association by
whatever name or designation, whose activities are incompatible with the sanctions,
dignity and integrity of his office.
xi. Any officer who intentionally behave in a way to sabotage, misrepresent or damage the
effort, image and for the sanity of the Association be suspended from his office
immediately, pending a preliminary investigation into the causes and circumstances of
such a behavior by the said member. If the guilt of the said officer is proved beyond
reasonable doubt, he shall be dismissed by the 2/3 majority.
xii. The EXCO shall have the power to recommend for dismissal of an officer either in the
EXCO or a constituted Committee found ineffective, negligent and fraudulent in the
discharge of his official duty. Any other member can as well be dismissed if the EXCO is
satisfied that his behavior is prejudicial to the Association.
xiii. It is advisable to consult the advisory committee before any legal action is taken on any
defaulting official.
ARTICLE NINE
FINANCE AND PROPERTIES
SECTION 23: THE ASSOCIATION'S BANK ACCOUNT
The Association shall operate a Bank Account with any well-established financial Bank or
Banks
by the names " MALUMFASHI STUDENTS ASSOCIATION ” as may be
deemed necessary.
SECTION 24: SIGNATORIES OF THE ASSOCIATION
The account shall have three signatories:
i. The president
ii. The financial secretary and
iii. The treasurer.
SECTION 25: ANNUAL DUES
i. All affiliate unions of the association shall pay an annual registration due to the
association as determined by the Legislative Council and MALSA Court of Law.
ii. The financial year of the union shall coincide with the tenure of the association.
SECTION 26: DONATIONS
The union shall receive aids, grants and gifts from individuals(s) provided such aids grant
and
gift donation are in accordance with the aims and objectives herein stated in this constitution
or any other provision thereof.
SECTION 27: FUND RAISING
i. The union shall undertake fund raising activities when and where necessary.
ii. The union shall collect all profit due to it or accruing from its activities and utilities.
iii. The union shall collect any other money accruing to it from any other sources.
SECTION 28: FINANCIAL PROCEDURE
i. The secretariats shall maintain a record book in respect of each committee under the
control of the financial secretary who shall under the control circumstances receive or
pay any money in cash or cheques.
ii. Each Exco member shall keep a record in respect of his office financial transactions.
iii. The record book shall contain all the allocations of the committee and the expenditures.
iv. All payments or receives of money cash or cheques shall be by the treasurer who shall
issue an acknowledgement note upon which the financial secretary issues a union
receipt and makes into the book.
v. The union audit committee shall scrutinize all financial record books at least once in a
month.
vi. All accounts shall if possible be supported by receipts.
vii. Record books of financial transaction shall bear;
viii. Date and number of payment voucher,
ix. Recipient’s name,
x. Balance.
xi. Before the Exco assumes office, they shall be given a brief induction course in
rudimentary accounting procedures by the out-going President, Treasurer and Financial
Secretary.
xii. No union transaction shall be valid until backed by a union receipt.
xiii. Union officials shall be accountable for all proceeds realized from any activity
organized
by their office and shall remit such to the treasurer within 48 hours.
SECTION 29: UNION PROPERTY
i. Anything belonging to the union is regarded as union property.
ii. The president shall be the overall custodian of the union’s property.
iii. Every union officer shall be responsible for properties directly under their offices.
iv. Union property shall not be put to private use and any such of action in contravention of
this sub-section shall be subjected to discipline.
v. Major repair of union property shall not be undertaken unless with the consent of the
LC.
vi. All union property shall be subject to verification time to time by a committee to be set
up by the legislative council.
ARTICLE TEN
RENUMERATION
SECTION 30: RENUMERATION AND SALARIES OF UNION OFFICERS
i. The remuneration of the officers of the union shall be fixed by the executive subject to
the adoption, amendment or rejection of the parliament bearing in mind that such
remuneration shall not constitute financial burden to the union.
ii. Officers embarking on a trip for purpose of conducting the affairs of the association shall
be entitled to allowances.
iii. The officers for the purpose above are the President, Secretary General, Financial
Secretary, and Treasurer; Speaker and Clerk of the Parliament.
iv. Each committee of the association is entitled to a certificate award after successful
completion of their task.
v. Every member of the Executive Council parliament is entitled to a certificate award at
the end of the year/tenure for his services.
ARTICLE ELEVEN
MISCELLANEOUS PROVISIONS
SECTION 31: CITATION
This constitution shall be addressed as Malumfashi Students Association National Body
(MALSA) as amended 2023.
SECTION 32: COMMENCEMENT OF THIS CONSTITUTION
This constitution shall commence into action from 14TH SEPTEMBER, 2023As drafted by
the
committee and passed by the board of trustees of the association, hence regarded as the
Supreme
Governing Body of the association.
SECTION 33: MEETINGS OF THE ASSOCIATION:
A. STANDING ORDERS
i. The standing order shall be adhered to in all meeting of the Association.
ii. The President shall be held in silence and any member holding the floor shall resume his
seat when the President indicates his wish to speak.
iii. All speeches shall be addressed to the chair.
iv. The President shall have power to put an issue, and to order for adjournment.
v. Voting shall normally be by rising of hand.
vi. The President shall have the power to interpret the mode of the meeting.
vii. After a motion has been moved and seconded, it shall be open for discussion and
amended successfully then such amendment be tabled and voted upon in proceeding
order.
viii. A seconder shall be required for every motion or amendment.
ix. No motion of amendment may be withdrawn without the consent of the meeting.
x. Members shall not swear or blaspheme in the course of their speeches; the chair shall
have the Power of removal of such a member after due warning.
B. ORDER OF BUSINESS:
Order of business shall be followed in sequence as follows:
i. Opening remarks by the chairman of board of trustees
ii. Minutes of previous meeting reading by the Secretary General.
iii. Matters arising from the Secretary, noted and communicate to the board of trustees
present.
iv. Other reports to be read and questions on such entertained.
v. The formal business of the day shall then be open.
C. MOTIONS
i. All propositions shall have a proposer and a seconder and shall be submitted to the
Secretary General or Clerk (in the case of LC) before or during the meeting.
ii. A proposition lapses in the event of two absences of its proposer and seconder in a
meeting to consider it.
D. DEBATES
i. A member shall stand up when speaking and shall address the chairman and the house
before speaking.
ii. The proposer of a proposition shall be invited by the chairman to introduce his/her
proposition and a seconder shall follow him.
iii. Debates shall be limited to immediate questions on issues.
iv. The proposer of a motion shall reply to a debate on the motion limiting himself/herself
to answers or statement or arguments made in the course of the debate.
v. Members shall restrain themselves from the use of foul and obscene language,
interrupting or doing anything that may/will disturb proceedings.
vi. The chairman can send out any person committing offence in (v) above.
E. VOTING
i. A simple majority vote shall determine any proposal not expressly provided for in this
constitution by members present and voting in meeting.
ii. Voting shall be open ballot, except when otherwise decided upon by congress.
SECTION 34 ORDER OF ZONES
Sec6. For ease of analysis and administrative conveniences, the framework of the
association shall take a zonal image as herein set forth by the below subsections b,c,d, and e
respectively:
b) The mighty Katsina state as zone A
c) Kano, Jigawa, Bauchi, Gombe, Yobe, Maiduguri and Adamawa as zone B
d) Kaduna, Jos, Niger, Nasarawa and Lagos as zone C
e) Sokoto, Kebbi and Zamfara as zone D
Note: the above zonal divisions is made by way of a rough, but not infallible test. It is
therefore open for more divisions where and when necessary.

iii. Absolute orderliness shall be maintained during voting process.


SECTION 35: OATH OF OFFICE
Oath of the Officers;
i. Every officer of the Association shall take an Oath of Office as indicated in this
Constitution.
ii. All Oaths shall be administered by the Patrons of the association.
iii. The oath shall be administered on the elected EXCO by the Patron Chairing the
Inauguration Ceremony.
A. OATH I: OATH OF ALLIGIANCE

the
Malumfashi Students' Association National Body (MALSA) and that I will preserve, protect
and defend the Constitution of the Malumfashi Students' Association National Body
(MALSA) So, help me God.
B. OATH II: OATH OF OFFICE OF MEMBERS OF THE EXECUTIVE COUNCIL
I ……………… do solemnly swear that I will be faithful and bear true allegiance to the
Malumfashi Students Association National Body (MALSA) that in my capacity as
the ………………...
of the Association, I will discharge my duties to the best of my ability and faithfully in
accordance with the Constitution of the Malumfashi Students' Association National Body
(MALSA)and always in the best interest of the Association; that I will strive hard to
preserve the fundamental aims and objectives of the Association as provided in the
Constitution; that I will not allow my personal interest to influence my official conduct or
my official decisions and that I will; to the best of my ability preserve, protect and defend
the provisions of this constitution; that I will devote myself to the service, unity and
wellbeing of the entire members of the Malumfashi Students' Association National Body
(MALSA). So, help me God.
