The Court made the following ORAL ORDER:

Heard Sri K. Chethan, learned Counsel appearing on behalf of M/. CKR


Associates, learned Counsel for the Writ Petitioner and Sri Arjun Chowdary,
learned Asst. Government Pleader for Revenue.

2. Learned Asst. Government Pleader has submitted the Written


Instructions, dated: 19.01.2025 furnished by the Tahilsdar, Guntakal Mandal
along with the Village Record. Copy of it has been served on the learned
Counsel for the Writ Petitioner and the same is taken on record.

3. The Written Instructions would raise two issues, which are as


follows:

(i) That the subject land falls under the Guntakal Municipality.

(ii) That the subject land is uncultivable and therefore, the


Pattadar Pass Books cannot be issued.

4. This Court has noticed that the Writ Petitioner has made Form-6A
Application way back on 29.04.2021. This Court, without going into merits
and demerits of the contents of the Written Instructions, is of the opinion that
the Official Respondents have certainly caused inordinate delay in considering
the Form-6A Application of the Writ Petitioner, since the same has been
pending from 29.04.2021. If there are any legal and technical objections on
the part of the Official Respondents for not granting the necessary relief to the
Writ Petitioner, the same could have been conveyed to the Writ Petitioner
within the reasonable time, but keeping the Application of the year 2021
pending till date is certainly an act of gross dereliction of duty on the part of
the Official Respondents.

5. In this view of the matter, this Court is inclined to dispose of this


Writ Petition at the admission stage, without going into merit by issuing the
following directions:

(i) The District Collector, Anantapur District


(Respondent No.2) is directed to enquire into the
matter and fix the responsibility on the concerned
Officials, who are responsible for causing inordinate
delay in responding to the Application made by the
Writ Petitioner and initiate Departmental Proceedings
for gross dereliction of duty that tantamounts to
‘Malice in Law’. In any case, this whole exercise shall
be completed by the District Collector within four (04)
weeks from today.

(ii) The Application submitted by the Writ Petitioner


shall be disposed of within a period of four weeks
from today by passing a Speaking Order in
accordance with law and communicate such Order to
the Writ Petitioner forthwith.

6. With these observations and directions, this Writ Petition stands


disposed of. No order as to costs.

7. Interlocutory Applications, if any, stand closed in terms of this order.
