Discuss with reference to relevant case law.
Q1. Mr. A gives money to Mrs. B, a married woman, to obtain a divorce from Mr. C, her
husband. Mr. A promised to marry Mrs. B subsequently. Can Mr. A recover the amount, if
promise is not fulfilled?
Q2. A husband executed a registered document in favour of his wife. After referring to the
quarrels and disagreement between them, he promised to pay for her separate maintenance and
residence. On his failure to pay, the wife sues him in the court of law. Will she succeed?
Q3. Ankit offered to sell a Farm to Shobhit for Rs. 10,00,000 but Shobhit gave the offer to buy
it for Rs. 9,50,000. Subsequently Shobhit offered to purchase the farm for Rs. 10,00,000. State
with reason, is there any contract between Ankit and Shobhit?
Q4. Rahul, a minor, bought six luxury clothes from Raghav Traders on credit. Later on, after
the refusal from the Rahul to pay off the price for luxury clothes. Mr. Raghav filed a suit against
Mr. Rahul. Can the sum be recovered from Mr. Rahul? Also discuss the minor's liability for
necessaries.
Q5. X intends to sell his horse to Y. The horse is unsound and X prepared a forged certificate
of fitness by a veterinary doctor and put it on the door of the stable. Y without looking at the
certificate on stable's door purchased the horse and later came to know that horse is not sound.
Can Y cancel the contract on the basis of fraud of X. Give reasons.
Q6. Mr. Rahim, a renowned tailor for sherwanis delivered a lot of clothes at Surat railway
station for consignment to Lucknow on 1st November 2022. Mr. Rahim needed this lot to be
delivered by the end of November as the order for sherwanis would be at peak during that time.
He did not bring this to the notice of railways. Consignment was delayed by one month. Is Mr.
Rahim entitled to claim the loss of profit?
Q7. C agreed to let out his musical hall to T for a series of concerts. The hall was accidently
burnt before the date of the first concert. T sued C for damages for breach of contract. Can T
recover damages for breach of contract?
Q8. A minor after misrepresenting his age as 20 years, takes a loan of × 50,000 at 10% interest.
Can this loan be recovered from the minor as he has presented himself as major. What other
remedies are available with the Lender.
Q9. Discuss "suit for Quantum Meruit" and "suit for Specific Performance" under the Indian
Contract Act, 1872.
Q10. The status of finder of goods is just like a bailee. Comment.
