RESOLUTION NUMBERED 07 (Series of 2012) EXPRESSING OPPOSITION TO THE CUTTING AND/OR EARTHBALLING OF 182 TREES FOR THE PLANNED REDEVELOPMENT PROJECT OF SHOEMART (SM) DEVELOPMENT CORPORATION AT LUNETA HILL, BAGUIO CITY AND SUPPORTING ANY MOVE FOR THE WITHDRAWAL OF PERMITS REGARDING CUTTING AND/OR EARTH-BALLING OF TREES THEREON. WHEREAS, Article 2, Section 16 of 1987 Constitution provides: Section 16. The State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature. WHEREAS, on June 14, 2011, SM Baguio Mall, submitted to the City Government of Baguio a letter expressing their desire to build a three (3) storey building extension of its existing building in a forested area between SM Baguio and University of the Cordilleras which includes Earth-balling and transfer of 182 trees comprising of Benguet Pine Trees and Alnus Trees. WHEREAS, SM Development Corporation was able to obtain an Environmental Compliance Certificate (ECC) with Tree-Cutting permits from the Office of the Secretary of the Department of Environment and Natural Resources. WHEREAS, the site of the expansion plan is one of the few remaining forested areas within the central business district of Baguio which helps in the maintenance of clean and fresh air in the city. WHEREAS, beginning January of this year, several protest from different groups, concerned citizens and Baguio residents were already conducted to air opposition to the expansion project of SM.

WHEREAS, residents of Lower Quirino Hill Barangay had also expressed their opposition to the expansion plan through the Social media Facebook and through joining the filing of a case against the Secretary of Environment and others. WHEREAS, the barangay council of Lower Quirino Hill Barangay joins its constituents, concerned groups and Baguio residents in any drive against the plan expansion of SM Baguio and the cutting, earth-balling and / or transfer of 182 trees in Luneta Hill. NOW THEREFORE, on motion of Kagawad Van Oliver M. Dicang, duly seconded, be it. RESOLVED, as it is hereby RESOLVED, to express opposition to the cutting and/or earthballing of 182 trees for the planned redevelopment project of ShoeMart (SM) Development Corporation at Luneta Hill, Baguio City RESOLVED FURTHER, that concerned agencies, groups or individuals be furnished with copies of this resolution. UNANIMOUSLY ADOPTED.
