What is Workplace Harassment?
• Workplace harassment is when someone harasses you while you
are doing your job, or on your way to or from work. A harasser
can be anyone you come in contact with because of your work.
That person might be a:
• boss;
• supervisor;
• manager;
• Member of your board of directors;
• coworker;
• customer;
• patient;
• delivery person;
• person in your union.
Types Of Harassment

1) Bullying:- is a complex phenomenon of unwanted offensive and malicious


behaviour which undermines an individual or group through persistently
negative attacks. There is typically an unpredictable and irrational abuse of
power or position that can manifest itself in physical, verbal or non-verbal
forms. There is usually an element of vindictiveness attached to bullying and
the behaviour is calculated to undermine, patronise, humiliate, intimidate or
demean the recipient.

2) RACIAL HARASSMENT is unwanted behaviour based on race, ethnic or national
origin. It includes written or verbal threats or insults based on race, ethnicity or skin
colour, abusive comments about racial origins, ridicule based on cultural grounds,
derogatory namecalling, racist jokes, damage to property, the display of offensive
graffiti or insignia and incitement of others to commit any of the above

Legal Definitions for Sexual Harassment in the Workplace

Two specific legal definitions of sexual harassment have been established in


employment law:  
Quid Pro Quo Harassment:  "Something for something;"  this is the "you
do something for me
and I'll do something for you" type of exchange.  This occurs when a job
benefit is directly tied to
an employee submitting to unwelcome sexual advances.

Hostile Environment Sexual Harassment:  This occurs when an


employee is subjected to
comments of a sexual nature, offensive sexual materials, or
unwelcome physical contact as a
regular part of the work environment

New Delhi, July 22 : Defence Minister A K Antony
today informed the Rajya Sabha that in the last
five years 11 cases of sexual harassment have been
reported in the armed forces.
Antony said: “During the last five years, 11 cases
relating to sexual harassment have been reported in the
armed forces.”
He said that necessary investigations have been
instituted in all these cases and punishments have been
awarded wherever charges have been proved.

"brutal legal and public-relations
battle" which ensued during the
mid-1990s. The case was
resurrected in the public eye
during the Monica Lewinsky
scandal, and it is suggested that
"allegations of perjury in [the
Paula Jones] deposition are among
the 11 possibly impeachable
offenses that [Ken] Starr outlined
in his ... report to Congress" in
1998.

• Maxine Henderson and Gwen: In
1996, artist Maxine Henderson's
impressionist portrait of a nude woman
named Gwen rocked the small town of
Murfreesboro, Tenn. A local assistant
superintendent noticed the painting when
it was hung on a wall in City Hall and was
so offended by its alleged vulgarity that
she "submitted a sexual harassment
complaint to the city legal department."
The city ultimately decided that the
painting violated its own sexual-
harassment policies and removed it. As a
result, the artist sued the city "for violating
her First Amendment rights." Henderson
won the case in a U.S. District Court, under
the pretenses that the painting hung in a
public space and that the city's sexual-
harassment policy was not detailed
enough in its description of what
constituted offensive material.
