CYBERCRIME OR COMPUTER-ORIENTED
CRIME
is a crime that involves
a computer and a network.
The computer may have
been used in the
commission of a crime, or it
may be the target.
CYBER LIBEL
• It is the unlawful or prohibited
acts of libel as defined in Article
355 of the Revised Penal Code,
as amended, committed through
a computer system or any other
similar means which may be
devised in the future.

UNDER THE REVISED PENAL CODE
Libel means by writings or similar
means. The crime of libel is committed
when a person makes, against another, a
public and malicious imputation of a
crime, or of a vice or defect, real or
imaginary, or any act, omission,
condition, status or circumstance
tending to cause the dishonor, discredit
or contempt of a natural or juridical
person, or to blacken the memory of
one who is dead.
THE ELEMENTS OF LIBEL
(a) the allegation of a
discreditable act or condition
concerning another;
(b) publication of the charge;
(c) identity of the person
defamed; and
(d) existence of malice.

DOES “LIKING” OR “SHARING” THE POST
CONSTITUTE CYBER LIBEL?
• No.
• Hitting the “Like” and/or the
“Share” button on Facebook
does not make you commit the
act of libel.
HOW ABOUT WRITING COMMENTS?
• In depends.
• If mere agreement, not liable for cyber
libel.
• if the "Comment" does not merely react to
the original posting but creates an
altogether new defamatory story against
the victim, then that should be considered
an original posting published on the
internet. Therefore liable.
PENALTY
• the penalty is imprisonment for
a minimum six years and one
day to a maximum of 10 years,
per offense.
