RULE 1:
GENERAL PROVISIONS
SECTION 101. TITLE

These Rules shall be known and cited as the


“Revised Implementing Rules and Regulations of
the National Building Code of the Philippines (P.D.
1096)” and shall be referred to as the “IRR”.
DECLARATION OF
POLICY
(SECTION 102)
The State aims to protect life, health, property, and public welfare in alignment with
environmental management principles. The Code establishes minimum standards for buildings,
covering their location, site, design, materials, construction, use, occupancy, and maintenance.

SCOPE AND
APPLICATION
(SECTION 103)
• The IRR applies to various disciplines (architectural, civil/structural, electrical,
mechanical, sanitary, plumbing, and electronics) and regulates public and private buildings
and structures, excluding certain cases.
• Existing buildings without proper permits may be legalized if they adhere to the rules, but
they may face penalties.
• Allied professional codes and government agency codes approved by the DPWH Secretary
serve as reference codes.
GENERAL BUILDING
REQUIREMENTS
SECTION 104
• All buildings and structures, along with associated facilities, must adhere to safe
construction principles and suit their intended purpose.
• Buildings used for manufacturing must implement environmental safeguards.
• Buildings and facilities must be maintained in safe, sanitary, and operational conditions.

SITE
REQUIREMENTS
SECTION 105
The land for constructing buildings or structures must be sanitary, hygienic, and safe. For
structures used for habitation, they should be at a safe distance from polluted air sources,
bodies of water, volcanoes, or potential fire/explosion hazards, as determined by
competent authorities.

RESPONSIBLE FOR THE FOLLOWING DUTIES (SECTION
ENFORCERS OF THE 203):

CODE? • formulate policies, plans, standards, and guidelines in accordance with the Code.
• issue additional rules and regulations, specifically through Memorandum Circulars, to
implement Code provisions.
• holds appellate jurisdiction over decisions and orders made by the Building Official.
The Secretary's decisions are deemed final and executory, subject only to review by
the Office of the President.
• responsible for evaluating, reviewing, approving, and taking final action on changes
and amendments to existing Referral Codes.
• prescribe and impose fees and other charges
• Appoint a Building Official, distinct from the Office of the City/Municipal Engineers,
in all cities and municipalities.

T E C H N I C A L S TA F F :
The National Building Code Development Office (NBCDO) created through
DPWH Department Order, shall serve as the technical staff of the Secretary.
Building Officials

1. A Filipino citizen and of good moral character.

2. A duly registered architect or civil engineer.

3. A member of good standing of a duly accredited organization of his


Q U A L I F I C AT I O N S profession for not less than five (5) years endorsed or recommended by
Section 206 the accredited professional organization.

4. Has at least five (5) years of diversified and professional experience in


building design and construction.

5. Has attended and successfully completed a seminar workshop on PD


1096 and its IRR conducted by the DPWH.
Building Officials

1. responsible for enforcing the Code, its IRR, and related directives, guided by orders from the
Secretary.

2. handles permit applications and certificates.

3. ensures that modifications in design plans during construction are evaluated before implementation,
requiring the issuance of the necessary amendatory permit.

DUTIES
4. Conducting annual inspections of all buildings and structures and maintaining up-to-date records of
Section 207
their status

5. Upon complaint or motu propio and after due notice/s and hearing, initiate action towards:

a. Non-issuance, suspension, revocation and/or invalidation of a building permit or certificate of


occupancy;
b. Issuance of work stoppage order, or an order for discontinuance of the use or occupancy of the
building/structure or portion thereof;
c. Declaration of a building/structure as ruinous or dangerous; and/or
d. The imposition of appropriate fines/penalties.
WHAT HAPPENS TO THE FEES
COLLECTED BY THE
MUNICIPALITY BUILDING
Not more than twenty percent (20%) of the fees will be retained

equipment) of the office. The rest shall accrue to the general

WHAT BUILDING ARE EXEMPTED

PROCEDURE FOR Based on inspection findings, the Building Official may
order the closure of a building, which is lifted only
ABATEMENT/DEMOLITION OF after necessary corrections are made.
DANGEROUS/RUINOUS
BUILDINGS/ STRUCTURES
Written notice is served to the owner and occupants,
providing at least fifteen (15) days to vacate, repair,
renovate, demolish, or remove the building/structure.

Within the fifteen-day period, the owner may appeal


the finding or declaration to the Secretary, requesting a
re-inspection or re-investigation.
If the owner seeks reconsideration from the Building
Official, a decision is rendered within fifteen (15) days,
which can be appealed to the Secretary.

If the appeal is meritorious, the Secretary may


designate a competent representative/s to conduct a re-
inspection or re-investigation within thirty (30) days
from the date of termination.
If the re-inspection upholds the original finding, the
Secretary notifies the owner, giving fifteen (15) days to
comply with the affirmed finding.
If repairs or renovations are required, the order
specifies that necessary permits must be secured, and
work must commence within a determined reasonable
time.

If demolition is necessary, the order requires the


building/structure to be vacated within fifteen (15)
days, permits to be secured within the same period, and
demolition completed within a reasonable time.
The decision of the Secretary on the appeal is final.

If the owner fails to comply with the order within


fifteen (15) days, the Building Official may proceed to
repair, renovate, demolish, or remove the
building/structure at the owner's expense.
The repaired building or the materials from the
demolished building is held by the Office of the
Building Official (OBO) until full reimbursement is
made by the owner within thirty (30) days.
After thirty (30) days, any remaining materials may be
sold at public auction to satisfy the OBO's claim.
Excess funds, if any, will be returned to the owner.
RULE III:
PERMITS AND
INSPECTION
SECTION 301: BUILDING PERMITS
No person, firm or corporation, including any agency or
instrumentality of the government shall construct, alter,
repair, convert, use, occupy, move, demolish and add any
building/structure or any portion thereof or cause the same to
be done, without first obtaining a building permit therefor
from the Building Official assigned in the place where the
subject building/structure is located or to be done.

APPLICATION FOR
PERMITS
SECTION 302
1. Any person desiring to obtain a building permit and any ancillary/accessory permit/s
together with a Building Permit shall file application/s therefor on the prescribed application
forms.

2. Together with the accomplished prescribed application form/s, the following shall be
submitted to the OBO:
a. In case the applicant is the registered owner of the lot:
i. Certified true copy of OCT/TCT, on file with the Registry of Deeds,
ii. Tax Declaration, and
iii. Current Real Property Tax Receipt.
b. In case the applicant is not the registered owner of the lot, in addition to the above; duly
notarized copy of the Contract of Lease, or Deed of Absolute Sale. 34

3. Five (5) sets of survey plans, design plans, specifications and other documents prepared,
signed and sealed over the printed names of the duly licensed and registered professionals

ISSUANCE OF THE BUILDING PERMIT
The processing of building permits is under the administrative control and supervision of the building official’s office.
Once the plans and specifications are approved, it shall not be altered and construction shall be strictly in accordance to the
approved plans unless the changes are approved by the building officia

VALIDITY OF BUILDING PERMITS


• One year after the date of issue if the construction is not commenced
• One hundred twenty (120) days after suspension or abandonment of work.

NON-ISSUANCE, SUSPENSION OR REVOCATION OF BUILDING


PERMITS
• Errors in plans and specifications
• Incorrect data provided  Plans and specifications do not conform with the code
• Construction has deviated from the approved plans and specifications
WHO IS RESPONSIBLE FOR THE SUPERVISION AND
INSPECTION OF THE SITE CONSTRUCTION?
• A registered and licensed architect or civil engineer engaged and hired by the owner shall be responsible for the full-time
supervision of the construction site.

• A logbook shall be kept at the construction site and updated with the progress of the construction. This logbook shall be
signed and sealed by the supervising architect or civil engineer and submitted to the completion in order to obtain a
certificate of occupancy.

WHAT IS A CERTIFICATE OF OCCUPANCY?


• A certificate issued by the office of the building official to indicate that the building suitable for use and occupancy.
• It shall be issued within thirty days after the final inspection and submission of the certificate of completion.
• Buildings and structures shall not be used or occupied until a certificate of occupancy is issued.
