1) The EU legal basis for Human rights

Article 2 EU: “The Union is founded on the values of respect for human dignity, freedom, democracy,
equality, the rule of law and respect for human rights, including the rights of persons belonging to
minorities”.

2) The forthcoming accession of the EU to the European Convention of
Human Rights
Art. 6 EU:
• “2. The Union shall acceed to the European Convention for the Protection of
Human Rights and Fundamental Freedoms. Such accession shall not affect the
Union's competences as defined in the Treaties.
• 3. Fundamental rights, as guaranteed by the European Convention for the
Protection of Human Rights and Fundamental Freedoms and as they result
from the constitutional traditions common to the Member States, shall
constitute general principles of the Union's law”.

Relationship between EU & ECHR
– The ECJ refers to the ECHR since the 1970’s
Case 11/70, Internationale Handelsgesellschaft, §4 and Case 4/73, Nold v Commission, §13
– Since 2009, the EU has created its own Charter of Fundamental Rights (Art. 6, §1
EU)
– Since 2009, is also foreseen the adhesion of the EU to the European Convention of
Human Rights (Art. 6, §2 EU)
– Cf. Opinion no 2/13 on 18 December 2014: The CJEU invalidated the project of
adhesion of the EU to the ECHR
– Since 2009, the ECJ refers principally to the Charter:
• Ex.: Case “Facebook” : Case 362/14 Maximillian Schrems v Data Protection
Commissioner [2015]: Invalidates the agreement “Safe harbor” relating to
European measures permitting the transfer of private data to the USA (+
opinion of the AG) Articles 7, 8 & 47 of the Charter
Case C-311/18, Schrem II [2020]: invalidates Decision 2016/1250 on the
adequacy of the protection provided by the EU-US Data Protection Shield
