MUNICIPAL ORDINANCE

NO. 55 - 2019
ORDINANCE
MANDATING STRICT
IMPLEMENTATION OF
CURFEW HOURS
AN ORDER FOR THE STRICT IMPLEMENTATION OF
MUNICIPAL ORDINANCE NOS. 55-2019 AND 103-2023
(ORDINANCE MANDATING STRICT IMPLEMENTATION
OF CURFEW HOURS).
WHEREAS, for the protection of minors (persons
below 18 of age), and as provided under Municipal
Ordinance No. 55-2019 or Ordinance Mandating
Strict Implementation of Curfew Hours;

WHEREAS, pursuant to the General Welfare Clause of


the Local Government Code, every local government
shall within their territorial jurisdictions promote
health and safety of its residents;
WHEREAS, the policy of the state recognizes the vital
role of children and youth in nation building and shall
promote and protect their physical, moral, spiritual,
intellectual and social well-being. It shall indicate in
the youth patriotism and nationalism and encourage
their involvement in public and civic affairs;
WHEREAS, Section 444 of Republic Act (RA) 7160 and
Article 87 of the Implementing Rules and Regulations
(IRR) reiterate that the Local Chief Executive is
mandated by laws and ordinances relative to the
governance of the Municipality including the exercise
of its corporate powers and relative thereto issue
orders as are necessary for the proper enforcement
and execution of laws and ordinances;
NOW, THERFORE, I, JOSE “JOEY” SALTING JR., Mayor
of Municipality of Bamban, Province of Tarlac, by
virtue of the powers vested in by the law, do hereby
order and declare that;
Section 1. CURFEW HOURS ON MINORS. The curfew hours on
minors from loitering in public places or moving outside their
residences between 10:00 o’clock in the evening to 4:00 o’clock
in the morning; should there be necessary for them to be
outside their residence during curfew hours, they should be
accompanied by their parent/s, responsible elders or
guardians.

Offenders found to be under the influence of liquor or illegal


drugs and/or causing harm, alarm and scandal to himself or
others shall be temporarily held under the custody of the
Barangay until the child offender is sober, calms down and
ready to be sent home.
The matter shall be referred to MADAC and concerned
parent/s or guardians of the minor shall be immediately
summoned before the Barangay Council for the Protection
of Children (BCPC) for orientation and counseling.

The same parents/ or guardian/s shall be prosecuted for


violation of the pertinent provision of the Parental
Responsibility under Article 220 of EO# 209, as amended,
otherwise known as the Family Code of the Philippines.
Section 2. Fines and Corrective Measures

First Offense: Offender will be brought by barangay officials


to the Barangay Women’s Desk for councelling or if the
barangay has no Women’s Desk, to the PNP station for
counselling.

Second Offense: Five Hundred Pesos (Php500.00) and


Four (4) hours of utility work in a barangay facility.
Third and Final Offense: One Thousand Pesos (Php1,000.00)
and imprisonment of parent/guardian for not less than ten
(10) days but not more than fifteen (15) days or both such
fine and imprisonment at the discretion of the Court.

The Barangay shall issue official receipt for fines paid.


Proceeds from the penalties shall go to the barangay funds
for peace and order operation.
Section 3. Separability Clause. Should any provision of this
Order be declared unconstitutional or inconsistent with any
existing laws, ordinances or presidential Issuances, the
same shall not affect the validity and effectivity of the
other provisions hereof;

Section 4. Implementation. The Chief of Police of Bamban,


Tarlac and the Chairman and Barangay Tanods, are directed
to strictly implement this Order.
Let copies of this Order be furnished the Chief of Police of
Bamban, Tarlac and all Barangay Chairman of Bamban, Tarlac and
respective barangay Tanods within their respective jurisdiction, for
their information and strict implementation.

Section 7. Effectivity.

This Order shall take effect immediately.
