MODIFIED MUFFLERS
AND RIGGED EXHAUST
SYSTEM
AN ORDER FOR THE STRICT IMPLEMENTATION OF
MUNICIPAL ORDINANCE NO. 04-97 AS AMENDED BY
MUNICIPAL ORDINANCE NO. 27-2016 (AN
ORDINANCE IMPOSING STRINGENT PENALTIES TO
OWNERS/DRIVER/S OF PUJs, ALL KINDS OF PRIVATW
VEHICLES AND SINGLE MOTORCYCLES WITH
MODIFIED MUFFLERS OR RIGGED EXHAUST SYSTEM
AND TO LOCAL MOTORCYCLE AND AUTOMOTIVE
SHOPS MODFYING THESE MUFFLERS.
WHEREAS, drivers whose motorcycles create
unbearable and destructing noise due to rigged
eshaust system or with no working muffler continue
to plague the local streets and roads thus violating
peace and causing public nuisance;
WHEREAS, as a basis noise measurement, the
implementing rules and regulations set forth in “Nuisances
and Offensive Trades and Occupations of the Code of
Sanitation of the Philippines (P.D. 856) and pertinent rules
and regulations formulated under Presidential Decree No.
984 commonly known as the “The Pollution Control Law”
and that noise level shall be measured by a standard sound
level meter that meets the American National Standards
Institute (ANSI) S1 4-1974 or other specification accepted
by the Department of Environment and Natural Resources
(DENR);
WHEREAS, Section 444 of Republic Act (RA) 7160 and
Article 87 of the Implementing Rules and Regulations (IRR)
reiterate that the Local Chief Executive is mandated by laws
and ordinances relative the governance of the Municipality
including the exercise of its corporate powers and relative
thereto issue orders as are necessary for the power
enforcement and execution of laws and ordinances;
NOW, THEREFORE, I JOSE “JOEY” M. SALTING JR.,
Mayor of Municipality of Bamban, Province of Tarlac,
by virtue of the powers vested in me by the law, do
hereby order and declare that;
Section 1. Prohibition. Drivers or owners of private cars,
public utility jeepneys (PUJs), motorcycles and all kinds of
vehicles with no working mufflers, no silencers or with
rigged exhaust system or who installed noise-producing
part or parts in their vehicle, are hereby prohibited from
driving the roads and streets in the Municipality of
Bamban, at any time of the day. Owners and operators of
local motorcycle and automotive shops who install or
stores who sell motorcycle parts are likewise prohibited
from accepting jobs of removing or modifying the mufflers
of these motorcycles/vehicles.
Section 2. Penalties. Violators of this ordinance shall suffer
the following penalties:
2.1 Owner/driver of motorcycle, PUJs and other vehicles:
First Offense: Impoundment of vehicle/motorcycle and on
the spot destruction of the modified muffler or noise-
producing part by the owner/driver himself in the presence
of the PNP personnel. The motorcycle/vehicle shall only be
released upon replacement of the muffler.
Second Offense: Similar to the penalty under first offense
and Php 1, 500.00,
Third and Final Offense: Similar to the penalty under first
offense and Php 2,000.00 or imprisonment of seven (7)
days or both upon discretion of the court.
2.2 Owner/operator of motorcycle/automotive shop:
First Offense: Five Hundred (Php 500.00) Pesos
Second Offense: One Thousand (Php 1,000.00) Pesos
Third Offense: One thousand Five Hundred (Php 1,500.00)
Pesos and revocation of business permit.
Section 3. Apprehension of Violators. Aside from PNP
personnel, barangay officials (kagawad and or CVOs) are
hereby authorized to apprehend violators in their
respective jurisdictions. The barangay officials are hereby
authorized to impound and bring to the barangay hall the
Impounded vehicle. The offender driver shall be required
to bring a replacement muffler within twenty four (24)
hours. Otherwise, the vehicle shall then be turned-over to
the local PNP.
Section 3.1 Proceeds from penalties. Proceeds shall accrue
to the barangay that has jurisdiction over the road or place
where the vehicle was apprehended and shall be utilized
for maintenance of peace and order in that barangay,
provided that since it will not form part of the general fund
of the barangay, there shall be a resolution approving it as
such providing for its utilization. Once the vehicle is turned
over to the PNP, it shall have authority to issue the traffic
violation ticket and as such, the corresponding fine will
accrue to the Municipal Treasury.
Section 4 Exemption. Drivers of motorized Tricycles-for-hire
shall be exempted for the penal provisions of this
ordinance and shall be instead penalized under Section 15
Municipal Ordinance No. 10-2012 otherwise known as
“Tricycles-for-Hire Regulatory Ordinance of 2012”.
Section 5 Effectivity. This Order shall take effect
immediately.
Let copies of this Order be furnished the Chief of Police of
Bamban, Tarlac and all Barangay Chairman of Bamban,
Tarlac and respective barangay Tanods within their
respective jurisdiction, for their information and strict
implementation.

a. Classification of General Areas:
i. Class AA – a section or contiguous area which requires quietness such as area within 100 meters from
school sites, nursery schools, hospitals and special homes for the aged.
ii. Class A – a section or contiguous area that is primarily used for residential purposes.
iii. Class B – a section or contiguous area that is primarily a commercial area.
iv. Class C – a section primarily reserved as a light industrial area.
v. Class D – a section that is primarily reserved as a heavy industrial area.
b. The division of the 24-hour period are as follows:
vi. Morning – 5:00 am to 9:00 am
vii. Daytime – 9:00 am to 6:00 pm
viii.Evening – 6:00 pm to 10:00 pm
ix. Night time - 10:00 pm to 5:00 am
